A California homeowner is suing Nationstar Mortgage U.S. Bank National Association for alleged breach of contract and negligence for failing to notify her that she was approved for a loan modification.

According to the complaint, the plaintiff, Maria Del Rayo Vazquez claimed that she suffered damages because Nationstar and U.S. Bank allegedly knew that she had applied and was approved for a loan modification but failed to notify her before the program ended, thus putting her home at risk of foreclosure.

Vazquez is seeking a trial by jury, an injunction against the defendants, damages, disgorgement, compensatory and statutory damages, punitive damages, all legal fees and any other relief as the court deems just.

The case was filed on April 12 in the San Francisco County Superior Court – Case number cgc17558138.
