    Please Help Quickly

    I'll give you the rundown: Loan with PNC/National City and I am told Wells Fargo is investor.

    May 2009 - requested modification. Denied. Told to resubmit request.
    June 2009 - 4 month forebearance. Paid the new lower amount every month until October. Resubmitted my financials in September like they asked me. Told that I would soon be contacted.
    October 2009-December 2009 - Called every week. Told constantly not to pay but to save my money as I was not on a repayment plan, and that a negotiator would contact me soon.
    December 9 - told that a glitch in the system. No one had looked at my packet. For some reason my loan had gone to the collections people and I was no longer in loss mitigation. They would send out a new modification packet for me to fill out.
    December 15 - Received modification packet and a check for the amount I paid from June through September AND ANOTHER LETTER FROM COLLECTIONS STATING I WAS IN DEFAULT AND HAD UNTIL JANUARY 15 TO PAY OR FORECLOSURE PROCEEDINGS WOULD START. Filled out new modification packet.
    December 21 - Now the "system" has me as 7 months behind. Told that because I resubmitted modification packet the "system" sees it as a new request and could be another 12 weeks to get to a negotiator. In the meantime the loss mitigation counselor was going to "tell it to me straight" that I should contact collections and pay or they could foreclose and loss mitigation could not tell collections what to do even though it was their fault that my modification had not been looked at.

    After a sleepless night, I decided to call collections the next day and scrape up all my savings to pay or get a repayment plan from collections. Collections told me that I should not pay as alot of activity was going on in my file in the last 24 hours and I had been assigned a negotiator. They could not connect me to the negotiator. The phone number they gave me to the negotiator has been busy since (no voice mail or anything). My "processor" called and said that I had been sent a letter on Wednesday but would not tell me what it was...

    I do not want to get this close to foreclosure, and the letters (same letter sent 4 times, and certified) all threaten foreclosure if I don't pay the whole past due by January 15. I feel like they are trying to get me to foreclose?ANY ADVICE WOULD BE APPRECIATED! Thanks.

    Wow, they have really messed your case up. I suggest at this point, following the advice you got from collections, which is to not pay. You do have some time; until the middle of January to get this straightened out, and they did tell you you are assigned to a negotiator.

    If you don't hear anything by Tuesday of next week, I suggest you call the office of the president of PNC. I don't know if their number is listed on loansafe or not, but do some digging and you might find it.

    Do you know why you were turned down in the first place? What is your DTI including tax/insurance vs your gross income? What is your monthly payment currently including tax/insurance and your monthly gross?

    Good luck and keep us updated on your progress.

    Thanks. I do need to take a deep breath. They sent one of the letters certified mail so my wife thought it was a Christmas present and almost cried when she read it at the post office.

    I was originally denied in May because I had a "deficit income" or something. It was kind of ridiculous and so that's why I called customer service and they encouraged me to apply again but this time I got into a "forebearance" program that should lead to a modification after the 4 month period (but as you can see above didn't). It is confusing because now it seems that loss mitigation is discouraging me and telling me to pay collections and they have always been positive in the past and collections (a different dept) is telling me to hold off on payment. But I think things are happening so fast the customer service people can't keep up?

    I can't tell if this letter was an official Notice of Default letter since they didn't say that they recorded anything. I really don't want them to record a notice of default and feel they are playing games or messing things up to get me in foreclosure.

    Oh and I called the number collections told me was the number to do an "auto-pay" to pay it off just to check if it would work and when I put in my loan number it will not process. The letter says it needs to be a "certified" check whatever that is. What a mess. Any thoughts?

    The documents you mention are asking you to go to the bank and get a certified check to send in to them. I still think you should call again this week during the week days and get some straight answers before you send any money to them. You have a little time still. See if you can escalate this to management and don't just take the word of whomever answers the phone. They don't always have the correct answers.

    Avery, put my name at the top of your post and it's virtually identical.
    THREE (3) times we've submitted our packets. 3!!! Just got the foreclosure letter yesterday. It came with an 800 number and 4 digit extension to call PNC. I called. There are NO 4 digit extensions at PNC. I finally got a human (I use the term loosely) and I asked why I can't speak to Brad Coldwell who we've been sending everything to for almost a year. His phone always goes into voicemail, but it won't accept any because it's full. Anyway, this "human" asked why on earth would I be sending him anything as he's not on our case. "Who is on our case" "Shelia" I was told. But Shelia has no phone, no extension and no email. Like you, I'm now about 7 months in arrears and nobody at PNC gives a shit.

    Question Should I go outside PNC for Help?

    I got a phone call from some firm saying they can get me a 2% rate and a modified loan for $3,000.

    Anybody know if this is a scam or legit?

    Heading into the holidays with foreclosure hanging over our heads sure ain't fun!
