    File a Bank Complaint with the Treasury Department NOW!!!

    Hello,

    I just did this for my huge, long run around on a Bank of America HAMP modification application!!!

    When I complained directly to treasury, they referred me to the OCC who had already referred me back to HAMP, which is run by treasury. OCC did at least send a notice to the bank, asking for a reply, which the OCC never got. I think that going through HOPE, then HAMP escalations, and your senators and house reps are the only way to get any action until you feel it is time to talk to an att'y. Luckily I didn't have to get that far, but was preparing for it.

    Hi ****** how do you get to HAMP escalations? did you try to talk to supervisors, managers within the servicer? or they are just no help from your experience? I talked to my Chase rep earlier today, to my surprise, they actually have a designated person called relationship manager assigned to handle my case(with a specific phone extension though she is busy every time I called). So I think that is much better than talking to different person every time you call in other banks.

    Having one bad contact is probably better than ten different bad contacts, but if you get a good one, who is really working for you to get a mod, I could see how that would be positive. I think the fact that you have to leave voice mail makes it not much better, though. Wells Fargo has a voice system where it seems like they can decide to automaticaly send your call to voice mail even if the rep is sitting right there, not on the phone. I had a rep assigned to me who answered the phone about the first 2-3 times, then it went to voicemail and even though I left several messages, I never spoke to the same rep again. I got a lot of "oh. we are so sorry" after finally getting hld of another rep, about a month later. They told me he had been transferred a month earlier.

    As far as contacting HAMP escalations, the steps are suposed to be 1- try your servicer, if that doesn't work, then 2- try HOPE(888-995-HOPE) and ask them to escalate, and after giving them a chance, 3- try HAMP escalations/compliance/solutions(866-939-4469) and press option 2 to speak directly to a rep. If you haven't gone through steps 1+2, they may not want to help. For any of them, you need to know what the problem is as far as what the servicer might have screwed up. Supposedly, as I was told, if you already have a sales date scheduled for foreclosure, HAMP can help right then. The personnel at HAMP were very knowledgeable, compared to HOPE. I haven't had any contact with hope since March or April, and they were useless after the 3 way phone call. They did absolutley nothing to get an error by the servicer reversed, and I don't think they ever even checked the directives. HAMP on the other hand, checked the directives while I was on the line, and veriied that I should not have been denied. I had a mod offer 2 hours less than 3 full working days later.

    I don't guarantee they will help anyone, but it is definitely worth a try. I got help, but I was able to direct the rep to the exact page number of the directive in question.

    As far as other problems, if the bank won't tell you why you were denied, or your trial has lasted more than the original 3-4 months, you need to find out why there is a delay. The bank won't help with this, and they will say that you are still under review and your HAMP file is still open. The problem is, your HAMP file remains open even while you are in review for things other than a HAMP mod, like HAFA, keys for cash, a DIL, etc, right up to foreclosure after they have denied you for HAMP. The servicer has to note every step on your HAMP file. Then when they decide to proceed with the foreclosure, and you start getting notices, they will tell you that you were denied for HAMP months earlier, at the end of the 3-4 month official trial period.

    HOPE has been able to set up 3 way calls with the servicer to get a real reason for a denial, and I think that after the official trial is over, they should be the first call. The servicer's phone reps, even some from the executive office, or OOP, or whatever they call it, will see your HAMP file is still open, and it will say that you are still under review, so the idiot reps will tell you that you are still in review for HAMP months after a HAMP denial. But in reality, you are in review for an inhouse mod, or something else, but not a HAMP mod.

    I still have not seen a single post from someone with a trial over 3-4 months who did not later found out that their HAMP mod had been denied during the official trial or right after, if they ever found out. Many people still believe a HAMP trial can last 10-12 months or more. You may get a HAMP mod after that long, but it almost certainly had to be reopened, or reapplied for, or restarted. If you have to 'refresh' your documents, you have been denied for HAMP, or there is another issue. HAMP documents submitted when you apply require no refreshing if they were less than 90 days old when submitted.
