    I used the list of emails addresses provided here Friday morning. I emailed a letter I wrote, a summation of events over the last two years. From loan modification to upcoming bankruptcy and continuing foreclosure. Four of emails were kicked back. The one to the Board of Directors did go through. I left the house for a couple hours and when I got home had a voicemail from a man from the Office of the President. He "appears" to be jumping on my situation. He said he would be my contact. I have a 2nd mortgage judgement Sept. 30, which he is aware of. He is getting summaries from 1st & 2nd, contacting short sale and retention depts., and said he would see about getting the judgement delayed. I'm still very surprised that I was contacted in two hours after sending the email. I am not getting my hopes up, as I have had NO LUCK in loan mods, short sales, settling with the 2nd., etc. The 2nd mortgage has been the thorn in my side. I offered them 15% of total loan amount and they rejected. Part of me isn't sure I can trust any of this, but he did seem genuine. My short note in the email, while tactful and professional, did elude that my situation and other like me needs to come to the forefront, and contacting them was my first start. My lawyer is surprised by all this. Anyone else get help this way, from Office of the President?? Not sure if I'll hear anything from Board of Directors.

    Received my final call from my caseworker, and was told the only thing they could offer me is to go back to the 2nd and try another settlement. This is after having tried this summer, and having a 15% offer rejected.

    Got the address of John Stumph, and sent a restricted letter with all of the documentation from start to finish of this process. Should be there Thursday. Friday is the court date for judgment for the 2nd mortgage, which they will likely get.

    I may try another settlement but it won't be 15% as before. Will likely go bankruptcy, as this is the only avenue I have left once they get judgment. And if they won't settle. I can't do anything with the 1st mortgage with the 2nd continually getting in the way.

    When you go into court explain to the judge that you are trying to negotiate with Wells and give a copy of the recent letters, to the judge and to the Plainitiff's attorney and ask for a contuniance. Say I respectfully ask the court for a continuance. It should be granted.

    If I'm present, is this something my lawyer can do. I would love to give the judge everything, as my initial letter stating ALL the things I've done to avoid foreclosure and bankruptcy is a great letter. I have emails of the whole settlement process we first attempted (15%) with the 2nd. I have all the correspondence with Office of the President. And my letter to Wells CEO. Not like I've been sitting on my backside doing nothing. Why didn't my lawyer mention continuance???

    Don't know all of the specifics but you have made a good faith effort to settle and you are still in negotiations and to continue; the lender must act in good faith also. so if you ask for a continuance to finish negotiations it should be granted. No offense but is your lawyer charging you to go to court and lose a case for you? You can do that yourself by just not answering the complaint.

    I emailed her last night, and asked about what you wrote. Bottom line is 1st is in foreclosure for almost 2 years now. Had a buyer last year for a short sale, but 2nd wouldn't work with us, and it fell through. This year in June, I offered 15% of total loan to 2nd and they rejected. They have had a judgment scheduled for Sept. 30, Friday, which I've been told they'll get. My lawyers said they had stalled as long as they could. Per Office of Pres, they said all I can do is try and settle again. If all this fails, then I'll do bankruptcy, which in some ways I'm okay with. Still, will see what my lawyer says about continuance. Thanks!

    These are the ones I e-mailed on October 17, 2012 when I got home from work. I got a call from someone in executive offices by 9:00 am the next AM. But I agree with Cat....it really depends on what you are wanting to achieve. Your request most likely will get delegated to upper/senior management for handling, but at least it will get you out mid-level management h*ll which is where I was stuck.






    I only wrote the WFHM executives; no reason to e-mail the WF Bank execs...they are two distinct businesses.

    Also, when I wrote them....I was respectful. Although I thought my negotiator and her mid-level supervisor were complete morons, I still minded my p's and q's when I e-mailed the executive team.

    Thank you for trying to help me on another thread…I came to this thread as it pertains to Wells Fargo...

    I am still trying to postpone my sale date Jan 7, 2013…I'm faxing a new complete updated package showing additional income for a Hamp Tier 2 request to Home Preservation Department...should I also send my request to John Stump and office of the President to escalate a request ? I am told not to send any violations of the trustee to the President….What about the other executives on list Evan Bedard provided above ?

    This is a portion of the letter my previous Home Preservation Specialist sent an automated letter Dec 12, 2012, informing me of changes in the status of my mortgage assistance and let you what to expect going forward..Please understand that, at this time, I am not able to help you find a mortgage assistance program at this time…The normal collections process will resume, if appropriate…You will begin receiving phone calls and notices from WF Home Mortgage collections department…They will keep you informed of the process and also inquire about any changes in my financial situation…The word DENIAL or CLOSED were not in his letter..Have NO IDEA what that means....
    I did update my HARDSHIP LETTER today to show an additional monthly income of $402
    …Not much, but an INCREASE...

    As you can see, I am extremely confused and scared to make a mistake….Since I am getting physically sick over this, I should probably hire the trustee delay service as I have done in the past..
    Would you agree?

    I don't want to bother people on these threads…I'm smart, but feel paralyzed...

    I didn't want to leave you hanging here, dogs, but the members who are helping in the other thread like Jeffrey, Freedomwon, and Isisis have all been through this personally and would have very sound advice when it comes to tactics for postponing a foreclosure.

    Is this on a rental property or your primary residence? Do you own rental property?

    This site forum had the best minds coming together to help one another. I am proud to be a member of this forum.

    I had being following this forum and it did have answers to my queries with regards to my WF's mortgage.

    Today i am reaching out to share events that took place and wanted some advise.

    Let me start with the facts of my mortgage.

    My Mortgage Balance is $529,000 in Principal on my primary mortgage.
    Accured Interests and Fees should be around $80,000 plus.

    I do not have a second mortgage.

    History of the case:

    Was considered for Home modification programs for a 5 year term in January 2012. But I lost my job in June and I went into default and never paid since.

    In April, 2013, WF had hired the firm P[FONT=arial, sans-serif]helan Hallinan to file the foreclosure proceeding against me.[/FONT]

    [FONT=arial, sans-serif]I hired a [/FONT][FONT=arial, sans-serif]attorney[/FONT][FONT=arial, sans-serif] at my end to represent me who made tall claims that he would be able to fight it on my behalf while I focus on getting my job so that I could get back to making my payments.

    I landed myself in my job and was set to start my new job in June, but I had an family emergency which required me attend to my mom. She died of meningitis.

    During this time I did apply for a loan modification program which was rejected. On my return in November, I learned that a trial date has been fixed on Dec 20th,2013 which was then moved to Jan 15,2014(which is today).

    Meanwhile since my return in November, I had been in contact with the WF to find out the various options I could exercise to avoid the foreclosure.

    [/FONT]It was agreed at our discussions, that I would like to be given 2 options in order to suspend the foreclosure proceedings.

    1. The first option being to keep my primary residence for which I would need to be reviewed for Loan modification programs which required a Income at my end. Since I had been actively applying for jobs and I could not find one, I was not able to peruse this option.
    2. The second option was to proceed with a Short sale liquidation process
    It was agreed in our discussions that I could go ahead with the short sale process and also apply for loan modification programs if I get a job and have income to be qualified for the modification.

    I was also told that when a first offer from a short sale from the buyer is received by the Bank, they would temporarily halt the foreclosure proceedings.

    All said, it gives me lot of pain that none of the promises were kept at their end.

    My Realtor confirmed that a buyer was interested in making the offer and I shared this information with the loan specialist who was assigned my case by WF. I left a couple of voice mails since Friday and I did not get any response. It was not the case before when I always heard from him.

    Since I did not understand the short sale process activities, I have faxed a signed copy "Authorization to release Information" to WF office so that my Realtor could handle the activities. My Realtor did confirm that he had the first short sale offer send to WF via the Equator.

    Today, inspite of all odds, I went to the court at Middle*** and waited outside the chambers of the Judge for the trial which was being scheduled at 9:30 AM. No one turned up while I waited for over 2 hours, to learn that the trial was cancelled last night because my attorney who represented me previously has send a consent order on my behalf. He was not authorized by me to do so.

    On January 14th, I also emailed to the Phelan Hallinam, the firm you have hired for the foreclosure proceedings explaining him that the short sale is in progress and that we also received a short-sale offer for my home. I requested him to request for cancellation of the the trial proceedings. I got a response back with a statement and I quote "I have forwarded your email to the attorney handling the matter for review". Since I did not get a favorable reply, I decided to go to the court with all the proof of communication I was having with your office and the attorneys.

    Just to let you know that I has been working with CredAbility Counseling and the NJHomekeeper program alongside with the shortsale process. I had exercised all the options.

    Now, I have 2 queries that need your valuable responses.

    1. First the Consent Order would have given the WF a default judgement against me. What is the time frame for the judgement to be passed. Is it a few days, one month, three months and more.

    2. Second, Shouldn't the bank suspend the foreclosure proceedings while the short sale is progressing.
