Talking Everyone, CW/NACA SUCCESS!!!!

We filed 13 in nov 2005, then had all kinds of "rainy day types of emergencies"couldn't hardly keep up with groceries and utilities...we were week to week...basically penniless, then we got back on track somehow between june 2006 and jan 2007..great righ!!!! .....wrong...we both lost our jobs in March of 2007unexpectedl...now what.. since we were in the bullet proof 13 protection since 2005,and our trustee payments were making partials ever since, we were hit and miss on mortgage, then in oct 2008 the hammer fell, they would't accept our hit and miss any longer, they had our stay lifted shortly afterwards, then I thought what the f@#k what is there to lose, so we applied for the retention program,dec 14 2008, now the real fast slow jack, a big cluster f#$k..
wait..wait wait... all info they requested has been submitted, everything is posted on the Countrywide site on our account it just says, wait..until after 1/21/2009 then and only then should you attempt to call us, ok... I did and they said...wait some more, a negotiation team has been assigned your loan and until they say they have something....wait we do have viable income, we have shown a minimal monthly surplus with checkstubs and the whole bit...unfortunatly our pay is about 60% of what it was 1 year ago...where is my bailout..Oh.. I..forgot...BOA is next in line again for their next 20 billion, at my /our (the taxpayers) expense..I must be an idiot, I forgot that it was the BONUS season for the thieves and con arists....sorry ...just venting.....

I've been in my short sale for a year. CW takes so long that after about 2 months the buyer walks and I have to start all over again. Just walk away it's not worth the headache anymore. The only bad thing is if my job hadn't transferred me cross-country I could have been living rent free all this time.

Jblase, I'm in the same boat too. House listed for 15 months, no payments for 10 months and been in the short sale process the whole time. Countrywide has been a black-hole. I should have walked-away right from the start when I was unemployed.

Sheriffs sale date papers 2/13/2009, denied by cw also have already submitted with naca!!!

ok..went to open the front door 2/13/2009 found sheriffs sale papers in my door!!sale date 3/17/2009!!
the puzzling thing is this, i have been working with every actor at cw since 12/14/2008, i have sent my financials at least 10 different times, every rep i try to talk to asks me the same sh@t, at first i was in the active processing until 1/21/2009, then they cancelled, because i never returned requested info, then i called back to see what the hell was going on, they didn't know!!! So, cw rep took my financials over the phone on 2/2/2009 ,she said she would re-submit. Ok.. It shows up on my account 2/4/2009 active processing do not call back before 2/23/2009.
ok...2/06/2009 cancelled by investor, i called cw back 2/06/2009, they said i may qualify for a different program, i was not qualified for the dec 1st program, so i gave my financials again, 2/06/2009, then a lady called me at home and said she was from the workout dept and wanted my financials faxed to a different fax number within 72 hours ,so i thought new number , we may be getting somewhere, i checked my cw account online and it said, don't call back until 3/3/2009, that was 2/11/2009. Ihad 4 sets of info showing up on my account within 12 hours, then i checked on the morning of 2/12/2009 everything listed had been cancelled, normal collections have resumed, so i called cw and they said that i didn't qualify for any programs!!!i did not meet wells and fargo investor guidelines!!!what guidelines?? They couldn't answer. Cw re-submitted 2/12/2009, now it shows don't call back until 2/23/2009 normal collections have resumed, since you have not been pre-qualified for any type of assistance. I wake up to find papers in the door, i called cw and they didn't know anything about it!!!
i then contacted my naca counselor , and told her about the pending sale date, she immediately submitted my info to the sale date dept., hopefully naca will have better luck than i did with the idiots at cw!!! I am now waiting on naca, screw cw and there dumbass reps!!!

Ok.. I have been making calls, trying to get my 3/17/2009 sale suspended, cw refuses to work with me even though as of today and since 2/19/2009 my account says in active processing all account collections have been temporarily suspended??? My local sherriff's office that handles the sales said the sale will go on unless cw lawyers call off the dogs , i am also submitted for restructure with naca since 2/13/2009, cw said they have never heard of naca!!! I then pointed out to the bad cw actor that it shows naca on their website as an advocacy group that they will work with!!! So, i called naca a few minutes ago and the gentleman that i spoke with said that the retention team or customer service or any of the other depts., will know nothing about naca and cw dealings, they are merely reading off a screen, and apparently i need to call the loss mitigation dept. Only!! No other dept. At cw will be able to do anything, so does any body know the loss mitigation dept. At cw phone#?? I would appreciate it,also besides all of these servicers and investors jumping on the temporary suspension programs waiting on march 4th announcement bandwagon, i am in homeowner purgotory, closer south it feels like right now!!! I was told by naca this morning that cw and naca have a contract agreement , that once they are working on a deal cw is supposed to suspend all sales and foreclosures, so i a m trying to see if they received my doc's from naca or what!!!! Back tomy original question, does any body have cw loss mitigation dept ###

I think members using Naca have been calling the Advocacy dept at CW 877-327-9225

I know when I got my Mod using Naca the letter that came with it had the Advocacy dept phone number on it. Give them a call, also call Naca back they are suppose to help if you have a sale date also use the online feature on Naca's website for urgent situations

mshanie, you need to call NACA back and let them know about your foreclosure. I think there is a place on their website that you click on if you are in a foreclosure process (Urgent) area. Good Luck.

UPDATE..Ok I called CW retention/loss-mitigation/customer service/bankruptcy dept/ it didn't seem to matter which number I called they all took me to collections!! When I asked the actor from CW "WHAT EXACTLY IS YOUR COMPANY'S DEFINITION OF WORKING WITH HOMEOWNERS ?", she got a bit snippy with me, then I responded with It appears that you people are just "acting" like you are working with homeowners, when in reality you are just doing business as usual, the only reason you guys are acting like you give a ****, is because you are just waiting on your next handout from the government. Obviously she was furious at this point, my financials prove I can qualify for several of your programs and if you people wouldn't have sent my payments back to me several months ago, I wouldn't be in this deep, so it appears that your company is intentionally sabatoging loans, to foreclose and steal properties! Like I said earlier, business as usual. Next, I called back and spoke to a semi-intelligent individual and I politely asked her about obtaining information about my docs that were submitted for restructure from NACA, 2/13/2009, she said she wasn't privy to that info, for the fact that I signed an agreement with NACA to let them deal with CW on my behalf, so even if she did have info, she wasn't at liberty to discuss it with me. I have literally called every dept at CW and I feel as if I just got off of a 6 hour carnival ride!!! I know everyone is anxious to see their situations improve, but my meter is running and I don't know how much more we can take, very frustrating and depressing SALE DATE 3/17/2009 , I am hoping NACA will be able to help out, that appears to be my only hope at this time, unless I hit the lottery or something.

I was told originally by the NACA rep that I needed to call loss mitigation dept, but he didn't have the number ,so I posted here and you have read the rest. I am in stall mode now...trying to wait until the 3/04/2009 announcement dust settles, I have been told by my couselor at NACA as well as several CW reps, that they didn't see a problem with my financials, only showing surplus of 300.00 a month, I guess my main concern at this moment is to postpone this sale date, I have been trying to deal with CW and NACA, but I realize I am not the only one, unfortunately as of today my days are numbered..I'm afraid.

have you called the advocacy number and the executive team? I posted the numbers above. Also call Naca back on monday and tell them you have a sale date. they have a dept that works on getting that postponed while your proposal is being reviewed, others members have been sucessful with Naca getting their dates postponed. if you get someone that can't help you ask for a supervisor, keep trying and don't give up!

thanks for the help,i have already sent all urgent sale date info to NACA that was on the 13th when i received sale papers in my door from the sherriff,also like i said in one of my postings, any number that i call ultimately sends me to collections, when i ask them why they keep cacelling and denying my attempts to modify/restructure they act like it's their first day on the planet. I'm tired I have/had high hopes working for a resolution with NACA but each day, no news the sale date is closer and closer... and i fully understand that i am not the only one NACA is working with, everyone just keeps saying..be patient ...wait ...at this point i have went past that stage no time left. thanks anyways

I think you should keep calling Naca and asking what is going on. Every single day until you get an answer. And if you are intent on saving your home be prepared to file bankruptcy a week to a couple days before hand to stop the sale until Naca can do something about it if they have not acted by then. Or maybe by then the new legislation regarding bankruptcy will have been approved and the bank will be more likely to work with you.

Thanks for the encouragement, if you read this thread at the top, I already filed 13 back in nov 2005, in a repayment plan everything going well until we both lost our jobs march 07, made hit and miss payments as we could, even kept in touch with CW, they said its ok ,try to get caught up ASAP, you're protected in the 13 as part of that money is coming to us as well, keep us informed. ok did that...july payment accepted, sep payment sent back in oct, then all hell broke loose. New rtention program in dec, my lawyer thought I should try it. Called CW in dec, thay said need a letter to speak to your lawyer. ok...did that.sent them everything they requested dec 14 2008, they didn't get it.. fax machine problems... I kept sending the docs to them, dec 27 2008 their lawyer filed a motion of default, had my stay lifted, then the house was out of the 13, I called CW, they assred me that that is standard operating procedure to have the stay lifted for renegotiation purposes, my docs finally showed up on my CW accont 1/14/2009, got sherriffs sale papers in the door signed 1/27/2009, I feel I got tricked into getting the letter from my lawyer, to supposedly let them help me on a workout plan, and meantime they acted like they never got my docs, and proceeded with my foreclosure sale!! BEWARE OF GETTING A LETTER FROM YOUR LAWYER TO RELEASE OR DISCUSS ANY BANKRUPTCY INFORMATION, CW WILL COME AFTER YOU!!! I don't think their workout/modification percentages are very high, I would assume their numbers are about as high as the last presidents approval rating!!!
good luck, I feel that the only hope i have is NACA...

mshanie, what about filing for chapter 7? You don't have to have the chapter 7 discharged, but at least you can file for chapter 7 and take advantage of the automatic stay under chapter 7. Its worth asking your lawyer if you can do that. You might be able to buy yourself more time to see if you can qualify for the new programs that were announced today if your loan is with fannie or freddie.

Then another strategy you can try also that I have read about is to file a motion (in your case you would have to file it soon) to have Countrywide's attorney produce the original note as evidence they are even legally entitled to foreclose on you. I have read that in Ohio this has been successful in many courts, so what do you have to lose?

SALE DATE CANCELLED BY CW LAWYERS, on 3/3/2009 I had my sale date cancelled by cw. I was shocked. I found out on 3/5/2009, my sale date was set for 3/17/2009!!!So I began doing some researching,it was NACA.....

Although this is not a guarantee of anything, I understand that once your NACA paperwork is submitted and received by cw, they have an agreement with NACA to stop the sales and foreclosure proceedings, until they review the solution from NACA , as to the workability of the deal. Even though this may not workout, I did get a couple of nights of semi-stress free sleep. Thanks solely to NACA we still have a chance at saving our home at an affordable payment.

Al of these responses from cw seemded pretty generic, we wouldn't have been trying for a restructure through cw if we had a ton of money lying around, but apparently thats all they want. All of their responses concluded with, if you have a change in your financial situatio, please call us back, continue to explore other options to bring your loan current!!!!blah..blahhh

mshanie, did you have your sale date w/ names and address advertised in your local paper? I did! Of course after CW told me that it was cancelled. Yet, now my boss at work knows and pretty soon everyone else will too. How embarassing. My sale date was set for March 20th. I'm going to see what CW has to offer. If not good then, I'm going with NACA.

Yeahh we are going through that now, it has been in the paper for 4 weeks, also still on the local sherriffs web site, pretty embarrassing , I know, but unfortunately it is what is is..I don't like that end of it at all..I submitted with NACA in january, after reading the info on this site,cw just wants their money. I tried countless times to deal with them, they flat quit accepting payments, now I am that much more behind, I still have income , although its about half of what I used to make, but NACA says its workable. I hope and pray this mess all gets straightened up for everyone, for all I know my process will all start over again, not sure at this point ,but NACA and LOANSAFE have been an abundance of info for us. I would strongly suggest to start with NACA ASAP, like today if possible, its not at all like cw...

I understand about the 1/2 of income you used to make. That was my story too. You'd think that CW would want to work with the homeowners and keep them in their homes instead of selling for so much less. Then, again, I'm not CW.

From my experience on this sight the folks here actually understand what its like to go through this as well, unlike the actors, you get in touch with at cw, I too have had a negative experience with them, I am strictly working with NACA from this point on...I don't want to chance there being too many offers on the table at the same time, like Dan said, god forbid you confuse them any more, all you can do is hang in there, if you call cw lawyers to confirm that the sale has been cancelled or postponed, it may make you feel a little better, it also has an auction company listed on your sale papers, contact them as well, to verify that they did in fact get the cancellation from cw lawyers, then finish with the locals sherriffs office or whoever is listing your sale, it doesn't hurt to double-check anything you can, there is a chain of information that you can follow up with, I did it just to make sure that my sale date didn't magically happen, when I was told otherwise. I have high regard for the people at NACA , they got my sale cancelled....hopefully this is the last time, we'll ever have to do this.. CW lied to me or the left hand didn't know what the right hand was doing.. I would definately follow up with cw lawyers first......take a deep breath...then go back at it.
