Long story short, my parents have had a rough five years. They are both immigrants turned citizen who spent/spend their entire life working. Because of recent health issues with my sister and I and both of their siblings, they have fallen unto some very difficult financial times. The person who refinanced them a couple of years ago said they were getting the best deal with an adjustable rate. Well just this March, that rate went from 8.5% to 10.5%. The monthly is just too difficult for my parents to afford. My mom is currently on disability and my dad is a retired from the military. They have a lot of past due history last year due to being strapped financially because of the health issues. First I was in and out of the hospital with complications with pregnancy and next with my sister being diagnosed with breast cancer. Our parents did not turn their backs on us and helped us with the medical expenses. As if that wasn't enough, my mom's sister died of breast cancer that spread to her brain and she of course could not turn her back on her brother and did what she could to help with the costs. But another incident that really sent them over the edge financially was when my dad's sister was diagnosed with stage 4 cancer. There is no healthcare system in the Philippines, so my parents could not in their right mind not help, so they helped to treat my Aunt. It is hard to see my parents go through this especially when all they have done is give, give, give. We tried to help them out by catching them up with their payments, which we were able to do, but they have just been through the ringer and cannot afford the new mortgage payment. When they first saw signs of financial problems they tried to work with Chase and ask if there were any programs available. They were consistently told that there were no programs and that they just had to make the payments or lose the home. After watching Good Morning America, I learned that there was a department called Loss Mitigation, so urged my mom to contact them to see what could be done to help them. My parents, like I said, have always been hardworking, responsible citizens. The last thing they want to do foreclose on their home. They tried on several occasions to work something out. Well, they submitted all the paperwork the second week of January. My mom has been calling weekly and they keep telling her that there is no news. Then she heard that the papers had been sent to underwriting on February 19. My mom called today to find out the status because she had been advised to make a payment when a decision had been made. (Tomorrow her loan will be 30 days past due). A representative told my mom that she HAd to make a payment and that it could not be a partial payment, it had to be in the new amount. My mom cannot pay that. The last time she made a partial payment, it was applied to her late fees and she fell even further behind on her payments. She was also told that there would be no decision for another 60 days. So what are my mom's options at this point? Does she have to make that new larger mortgage payment while she is going through a loan modification? What would be my mom's options should her request be denied? By the way, my parents' financial situation has stabilized now that my sister's treatments are over, I have recovered, and my aunt is progressing well. So they can afford to still pay their mortgage, just not at the more expensive rate. Any help would be truly appreciated. |

| Re: Need Help For a Chase Modification At this point you may want to get HOPE 888.995.HOPE or ACORN ACORN: Home involved to intervene on their behalf. They are non-profit agencies that can intervene with no cost. Additionally you were speaking to collections trying to get a payment not the Loss Mitigation department, there job is to extract $$$ not modify. Call the Loss Mitigation department tomorrow and see what the time frame really is from the people at Loss Mitigation not the dolts in collections. Try HOPE or ACORN, use the one that can assist you the best and that fits the best for all parties. Some of the counselors are great, some are duds, if you get a "dud" call back and get one assigned that will help you in your endeavors. |

I spoke with my mom and told her about the wealth of information I found on this site. She was concerned that she was not told to submit a budget and was wondering if she should submit another hardship letter asking for a lower interest rate. I guess she sent a hardship letter stating why she was late on her payments and why she was having a difficult time. She did say that her loan was resetting to 10% which was far too difficult for her to pay. She plans on calling ACORN to see what they can do to help with the situation. Chase Loss Mitigation said that the underwriters just received the packet last week, which confuses her because a couple of weeks ago she was told that it went to the underwriters february 19th. My mom submitted her papers Mid-January. Does it normally take this long? Thanks again for your response. |

Acorn or Hope can help your mom with the budget and the hardship letters...... Here is the direct number to San Diego Loss Mit.......so you don't go to Collections... So just call the direct line to San Diego Loss Mit and also either Acorn or Hope......and you should be fine...... Keep us posted on the progress.........

I hope it is lower than the 8.5% she had when she first signed. We should find out in 5 business days. Please keep your fingers crossed for us. THANK YOU GUYS for all your help and good advice. My mom said that the underwriter approved her paperwork last week and she was told today that the manager approved the loan mod as of today but didn't have any details. They said we would know before they did what the terms are. Just wondering how long it takes from this point. Thanks. |

Chase stopped telling people what they are receiving on the modifications, although I don't know why...............my docs just showed up via Fed Ex before they gave me the final approval.........so you should be really close.......the same thing might even happen to her......so tell her to just keep an eye out for Fed Ex.......

Call.........1-888-310-7995 ask them could they please take a look to see why she was modified to her adjustable increased interest rate.........instead of a more affordable rate....... This is the Executive Resolution Team.......tell them that they modified your mom's loan to the rate that the adjustment has gone up to and you need them to review this because that is incorrect....... Tell them that you need it to at least go to her original rate or lower if they can........ You really need to push this issue.............it isn't easy.........I am not sure that they will be able to do anything, but it is worth the try.......

We have been referred to someone in Loss Mitigation and apparently no budget was included in our package (I faxed it after the fact because I learned from here that we needed to submit a budget.) Anyway, so we are told that we must wait another 1-4 months for an answer but must make sure not to fall more than 4 months delinquent on payments. So we have to pay the higher mortgage until they figure this out? I can't believe they thought that 10% was doing us a favor. I am a little annoyed and the stress is killing my mom. (she has MS and she has been having flare-ups because of all this and my dad hasn't been home in a year trying to keep working in order to keep up with the mortgage payments). |

Did you leave a message? You can also dial the number and not put an extension and speak with the first person that answers.........they are all in the same dept. I don't know the reason why your mom got the 10% rate fix, but they might, and they might be able to help her...... 10% isn't even one of the modifications that Chase is offering...........so I still believe you should fight it....... What did the the modification papers say exactly............were they labeled "Modification Agreement" I am sorry Blynmalyn for what is happening to your mom.............I am trying my best to help you here..............every Chase success we have doesn't have an ending interest rate over 6.80%...........so I don't know why this is happening to your mom....... Please don't give up yet............

My mom was told that based on my dad's income last year, it looks as though they can afford the payments, so they threw us a bone and made it fixed for 10% instead of the 10.75% variable. But this was also without the budget. My mom said it did not show the budget being included (so we included the budget with a new set of docs that we faxed over). This is showing that my dad isn't getting his overtime pay too (which is a $4000 difference in pay a month). I really do hope they take everything into consideration. |

I know you are being strong for your parents.........and they have been through alot.......so I hope together, you and I could figure this all out and have a great outcome...they certainly deserve one..... I know what they are going through........I have been through the same thing with Chase.........they doubled my second job income so it looked like I made more than I did too...... I have a good feeling that this will work out.........hopefully you will get to speak to the Executive Resolution Team too.......

I must say it is starting to cause her to have a reaction and she is starting to have MS episodes. So I am trying to shoulder the burden but getting as much research done on my end. Please tell me there is something I can do for my mom. |

Short of hiring an attorney to fight this.......which you might have to end up doing..........my only other suggestion would be to try to contact the CEO's office and to also file a complaint with the OCC.......
