I haven't been around for a while Jeff, hope things are going well for you.
I am still fighting and I have filed a Quiet Title Lawsuit in the district court under Utah title 78B-6-1301. I have a lis pendens with judicial presumption and Freddie Mac has a trustee's deed that has been erroneously recorded. I am prosecuting for free and clear title inferring negligence under the doctrine of res ipsa loquitur. I filed it on the 26th of April. thank you for asking and I am glad you got your modification!............Jeff

I do have a question, your second was extinguished thru 2MP. What's 2mp??????
I played this very same game for 2 1/2 years with a different lender, all I can say is stay on top of it and keep reapplying!!!! I did get my permanent modification.

Thanks everyone, it was a huge relief to see how well 2mp worked after going through total hell to get my first modified.
As already stated, I had two separate banks for my first and second so I was more than a little worried about them being able to connect the dots.
I still can't believe my second is paid off and the lien is dropped, I consider myself extremely fortunate. For the record, my second was 120k.

HI garry..Big congratulations. how great you must feel and thanks for posting.. I read in your older posts that the bank offered you a settlement before giving you the 2MP. would you mind sharing what the time frame was from when they offered you the settlement to the time they came around with the 2 MP? Thanks much...!
The settlement offer was mailed out in late October of 2011, the offer was 10% which I had no way of paying so I didn't respond.
They sent me a Dod-Frank cert to fill out in January of 2012 with a letter stating they where forgiving my loan.
When I first started my trial the Dod-Frank cert didn't exist.
Thanks Evan, even though I saved my house I'm still going to pursue Bank Of America for the unnecessary hell they put me through.
As you know I rank among the top contenders for the worlds longest trial period which caused me an immense amount of grief, including my wife leaving at-least four times because she couldn't handle the stress and a trip to emergency for my blood pressure going through the roof.
It turns out they where stringing me along because they mis-recorded my first trial payment. What pisses me off is the fact they had it recorded properly at first and somehow it got changed internally, I was keeping track at the time with their on-line banking system and watched it happen. When I called and threw a fit about the change I was told countless times not to worry about it, countless months later I received my denial letter for this very reason which I fought and won.
Well at least you did a great job staying on top of your account and documenting everything you could every step of the way. If you were not so due diligent these past few years you probably would not be in the position you are in today and I applaud you for your efforts and staying strong through this extremely long journey!

Congratulations on the end of this ordeal. I also applaud you for wanting to continue to make BOA responsible for what they put you through. Don't let it ruin the rest of your life though. Its not worth it. ( but maybe you're younger than me) Hope you will find a good lawyer who can take most of the burden off your shoulders.

By pursuing I was referring to the Independent Foreclosure Review papers that came in the mail. I'm not big on lawyers and I've already gotten what I was fighting for to the T. If anything good comes out of filing the review papers it's just a bonus.
