I just emailed all the suits @ CW using the email addresses you posted...thanks! Hopefully my phone will start ringing today. How long did it take from the time they told you they would fix your rate until you actually got the paperwork in the mail. I am going on 3 weeks now and am getting nervous. Thanks again! |

They also asked if they could fax me the letter along with mailing it. It also looks like they are about to file chapter 11 bankruptcy, dont know how that would affect the mods in process. |

I just called 866-767-4142 and April told me that I have been officialy approved and as of march 2008 my interest rate will be fixed for 5 years @ 5.99% (initial teaser rate). It is a fully amoratized loan so I will be paying pricipal and interst, not just interest like before. great news!! After almost 6 months of battle I have finally won!! I am having a very good day! |

If not I will be all over it. You know I will....haha. My next battle will be to try and get them to give me back some or all of the extra $610.00 a month they charged me for the past 5 months. I have to make 2 more $1975.00 payments and then it goes back down to $1364.00 for 5 years. Moe / Brian..any advise on how to get that money back since their website says a loan modification should only take 30 days or so and I have been waiting almost 180 days? If anything, I want to force them to change their website to be more truthful. I am not done with Countrywide!! |

Per HUD; Loan servicing complaints Section 6 provides borrowers with important consumer protections relating to the servicing of their loans. Under Section 6 of RESPA, borrowers who have a problem with the servicing of their loan (including escrow account questions), should contact their loan servicer in writing, outlining the nature of their complaint. The servicer must acknowledge the complaint in writing within 20 business days of receipt of the complaint. Within 60 business days the servicer must resolve the complaint by correcting the account or giving a statement of the reasons for its position. Until the complaint is resolved, borrowers should continue to make the servicer's required payment. A borrower may bring a private law suit, or a group of borrowers may bring a class action suit, within three years, against a servicer who fails to comply with Section 6's provisions. Borrowers may obtain actual damages, as well as additional damages if there is a pattern of noncompliance. Go get em!

Then called me back with the info after she looked into it. But that same day I received a call from the loss mitigation manager cant remember his name and the head of their press dept. |

The first five years are interest only payments, the first 3 years the interest rate was fixed at 5.99%, which adjusted on 1/1/08 to 8.59% and raised the payment $320.00. Due to adjust every six months by 1% to a max of 11.99% We are current with payments. Also have a second w/GMAC that is fixed for 20yrs. Started working w/CW in 11/07. I have had only one negotiator thru this whole process. Sent the RESPA letter yesterday by fax and email and received the call from Adrianne today, got her voicemail. Just called her and left her a message. Sorry for the brevity I am at work. |

She mentioned that the negotiator wanted to go over my financials again and asked if we had rental income. I told her that there was no rental income and that my financials were the same as they were 4 months ago. I also told her that CW makes all these public relation statements about no homeowner should lose their house because of a rate reset, and that I feel that because we are current that CW wants me to go deliquent to make more money off me. She assured me that was not the case and promised to contact me on Friday. One other thing...she asked if I would be okay if they froze the rate at the adjusted level, and I said if I could make the payment comfortably at my new rate, why would I be asking for help? |

Shortly after sending my emails on Monday, I received a phone call from my Negotiator and Misty, from the office of the president. The following day Tuesday I received a phone call from Christy from the Home Retention Team stating the modification was a done deal with a 5 yr freeze at my original rate of 6% not the adjusted rate. Wednesday I received the modification paperwork. I also have received 2 follow-up phone calls from Christy asking if I had any questions and I have a direct # to reach her. The paperwork is due back 1/23 with a certified check and my new payment begins 3/08. I did not send a RESPA letter though. I just sent a very long complaint letter detailing my ordeal and a phone log but nevertheless I am thrilled with the results. I would be encouraged that you have some people working on your modification and that you have a direct # to contact someone with any questions instead of having to deal with Customer Service or Workout Support.
