I got your emails and figure we might as well keep our discussions public so everyone learns. You said you were approved for a refinance also with Indymac. Is the refinance a better deal or is your loan mod? Meaning better rate and fees etc?

Brian I have a question if i sign those papers with countrywide will that screw me up with rescinding the loan that we talked about. If so how would i go about rescinding the loan with countrywide with the violations you found? |

Every single loan modification had a clause that said that by agreeing and signing to the loan mod, that you cannot bring suit against them in the future. So, essentially when you sign it, you give up all rights to legal recourse against your lender for anything. Fraud, TILA, everything. If you rescind successfully that 80% may go down to 70% and you would be in a much better spot. But, nothing is guaranteed. We'll see what Brian says.

Pretty much the same as that other members with the phone call log. That really didnt do anything i dont think. The letter i sent the other day did i think cause i sent it to all different email addresses some are below others were faxed and letters nextday air pressroom@countrywide.com, david_bigelow@countrywide.com, angelo_mozilo@countrywide.com, chris_oltmann@countrywide.com, vice_president@whitehouse.gov, OCIP@do.treas.gov, customer_service@countrywide.com, service@naca.com I originally took out a mortgage which was a 2/28 arm which adjusts come Feb. 1 2008 and my payment will go up 500+ dollars. Countrywide owns the loan. In October I had applied for a loan modification to fix my current rate for a certain set of time, because my wife went out of work last January due to medical reasons resulting from a twin pregnancy. The twins were born on XXXXXXXX but my wife has been unable to return to work fulltime (she only went back one day a week since child care would cost to much) I have made numerous phone calls to check status and kept on being told to call back in one week. I have phone logs to prove if you need them. Then every time I called they would ask for updated financials and I kept on telling them that it’s the same and my position didn’t change since I applied. Then when I called today 1/2/2008 A women with an attitude answered (she wouldn’t supply name but was in the workout dept) and said my file was declined and closed because financials were never updated. Meanwhile every week they asked for updated financials and I supplied it which has been the same since I started in oct. The phone call I made on dec 31st asked for updated financials too and John the representative told me my negotiator would call me today. But when I called today they said they had sent a request on the 31st to reopen my acct and it would be sent to another negotiator and start all over. I can’t wait another 3 months for this my rate adjusts Feb. 1st. I’m in a complete depression over this now. BTW I have been sending faxes and letters after each telephone call like my attorney has stated to do. Also my attorney has pointed out TILA violations and RESPA violations. Which enable to rescind the loan if I would like within 3 yrs instead of 3 days. I even asked about the President Bush proposal on loan modification for 5 yrs and was told it was joke. P.S. They said my acct is being monitored now because of the letter I wrote and they want to make sure everything arrives in a timely manner on the modification and is to my satisficiation. The lady promised to call me back tomorrow and gave me her direct line. Wow i cant believe all the phone calls. |

I had originally called in August and asked about it but was told since im not late they couldn't do anything. Then in October when I called again I was told that I could apply. After months and who knows how many hours on the phone (I luckily had the time to make all the phone calls or I would have probably used Brians Loan Mod service otherwise) I was finally approved for a 5 yr freeze on mortgage. This site along with the Help of Brian Korte reviewing my docs helped me tremendously. I even had to go as far as threaten to rescind my loan and send respa letters with the violations Brian had found. I really am very grateful of Moe for this site and Brian for his wisdom and guidance. I feel very stress free right now. I will be staying on this board to help others who were in my predicament too. OK, ladies and gentleman, sswiz is one of the first people to visit my blog when I fist started it 7 months ago and also a member of this forum from the beginning. He has been fighting Countrywide for 7 months, trying to get help and he never gave up. He was never late on his mortgage, but it had reset and was unfordable. With new twins and more bills, he knew he had to get Countrywide to modify his loan. This just show that with time, tenacity, persistence and good old fashioned "will power", you accomplished saving your home. Also now, you have peace of mind in a place where we all should feel calm and safe, our homes. Congrats sswiz. I truly appreciate the help you have been around here from day 1 and I hope you stick around and help others in their plights and fights!
