Well, it's all I can hope for.....a fixed rate for the life of the loan would be great and is what we really need to be able to stay in our home indefinitely. So, thanks *** and Michael for the responses and positive comments, I will definitely pop in from time to time to keep you all updated on my progress. Marshall has been really great and I would love to hear from anyone else who has hired him to do their modifications.

**UPDATE**

Today I received an e-mail from Marshall stating that our loan had quite a few violations that were discovered during our audit. He thinks he could use this to negotiate us into a fixed rate for the remainder of the loan.....I know it's not much of an update but I was so excited that I had to share it with you all.

Alright....today has been one of those days, you know the kinda day where you just cannot take the bu%^$*!# any longer WELL that day is today for me! I found out that my interest rate is going from 7.75 to 9.25 in August making our payment go up by $700 or so to $5034 per month with impounds (ouch)! I found that out yesterday but have been thinking about it all day long and have come to one very important conclusion.....WE ARE NOT PAYING OOMC/AHMSI ANOTHER DIME AFTER JULY'S PAYMENT!!! Yes, I am screaming cuz I am not doing it. You know, every day I come to this forum and read the stories about people losing their homes and what they have to go through just to pay their mortgage (ie no McDonalds, no cable, no internet, selling personal items etc, etc.) and putting their payments on credit cards or borrowing money from family members just to get by.....and it makes me so sad that sometimes I cry for others who are suffering so, and I pray that each and every person on this forum can save their homes....I decided today that I am not going to live that way just to pay my mortgage, it's just not worth it to me. I've been feeling this way ever since I found out that I had major violations in my loan docs......if they can't treat me honorably then why should I honor our contract? So, with that being said, I'm going to tell Marshall to play hardball with them and if they still won't negotiate then they can have this frickin' house!!! All 6 acres too!! I'm so tired! I have not given up, I am just mad that we were taken advantage of bigtime......I guess I always knew that and it's why I hired Marshall in the first place. So sorry for the rant but I am just a little pissed today!

PS *** can you move me to the OOMC section.....I think this fits in better there, thanks so much ;-)

Thanks so much (not just for moving this post) but for what you said about me cheering others on and working so hard for my home......it brought tears to my eyes to read that. I do cheer others on because they need support and help during such a difficult and stressful time, it's nice to feel that in return.

Hi!

I just posted my first thread and keep on reading stories here. Quick question: what is QWR? I apologize in advance for not being as savvy as other people on this forum. I just started my loan mod. submission process and have no idea about how it will end. I am a bit scared since I have to go through this all on my own after my ex-hubby gave up and left me due to an uncertainty of the future on the verge of the real estate market collapse. He was the one who did the loan for me since he used to work for a broker. Now I can only guess if he didn't care at the time whether or not I will get screwed or simply didn't know about an upcoming disaster. I appreciate any responses and promise to post any updates about my situation to share it with other forum members.

Hi there.....

I know it's scary going through this process but we are here to help. The QWR is in the homeowner toolbox, you'll find a great example there. You have to have a lot of patience during this process as it can take upwards of 90 days.....

Anyway, welcome and be sure to keep us posted on your progress.....post your updates in your thread so we can keep track of your story and how it's unfolding.

**Update**

Well I just got off the phone with my attorney's office and my negotiator from OOMC (his name is Christopher) and we are in the final stages of negotiation for our loan modification. We went over in fine detail every bit of our financial information......the negotiator assured me that we are in very capable hands and he is definitely looking to help us out. The only problem may be the investor.....apparently they are sort of difficult to deal with. So, keep your fingers crossed and say a prayer for us that this nightmare will finally be over.

Thinking positive thoughts.......I am hopeful.

If they don't want to deal, they can take this house and shove it!!!!!

At this point I am leaving to the professionals and it's really in God's hands....there's not a whole lot more I can do. It's so scary to have so little control over something so important in your life, that's what is getting to me. We're hangin' in there but I honesty believe that we wouldn't have gotten this far without Loansafe, YOU, Moe and Marshall's office......I don't know where we'd be if I tried to do it on my own......I give everyone who has done it and is doing it on their own credit because it is such a difficult process to go through.

Hi Mikka....dontcha love it....if they don't like it they can shove it! LOL You know this process is so long and arduous....it's not for the weak at heart. You are so right about some day being good and some being bad, I go through that all the time.....it's like being on a rollercoaster, if you let it, it can break you down. For me, today was a good day (at least I know we're getting somewhere) talking to the negotiator.....now it's just hurry up and wait Uggghhhh...it's just crazy!

During my conversation, the negotiator asked me if we wanted to skip July's payment and capitalize it etc. etc....I said no I have the money for July, it's August I'm worried about. I'm hoping that will show AHMSI that we are trying to keep up by paying what we can currently afford. The negotiator also said that our investor is difficult to deal with....so, I just don't know what's gonna happen.......only time will tell.

How's your sister doing? You guys are still in my thoughts and prayers.

PS I sent Christopher (the negotiator) a note thanking him for his time and effort.....hopefully he get's it a works just a little harder for us......

Good luck. I here the process is dragged out. My suggestion, as it is to most, is to retain a licensed, bar certified, real estate attourney, whose record and accomplishments can be verified by the Bar Association. No better modification can be had than by a lawyer representing YOUR INTREST IN THE LOAN! It does not matter if it is current or not, which is what the lenders always say. A lender will always, if they even consider modification, make it in thier best interest one way or another.

Cool Re: Update on Option One

It's nice to be back! I took a few days off to go to Ft. Bragg (get out of the smoke) with my family for a much needed break, my husband finally got a few days off from fighting the fires here in Northern California, and I haven't heard anything yet.....the only thing I heard was that Marshall sent a letter to the negotiator outlining the violations in my loan docs so that he could pass that info onto the investor.....nothing else though. All I can say is let the games begin! Because that is what this is turning out to be, one big game......hopefully, we end up winning but we'll see how far and hard we have to push it before we do win.

Thanks for all the prayers, support and responses....it's ALL appreciated!!!

PS good lookin out ***, as usual you're all over it!!! LOL

Angry Re: Update on Option One....THEY SUCK!!!!

As you can see I have an update and it's not good news....I got an e-mail from Marshall stating that my loan modification was denied because my investor doesn't do loan modifications.....WTF??? Why in God's name didn't they tell us that to begin with so I wouldn't have gone through so much trouble? Initially I was so upset I couldn't speak.....it's taken me all day long to get the courage up to come here and post my distressing and disappointing news. I felt so depressed and overwhelmed, I couldn't even type.....

BUT now that I've had all day to think about this, I'm MAD no PI$$ED would be a better word......

It's not over though....not by a longshot.......we've got Moe backing us along with the violations in my loan docs, we'll get er done! I have absolutely no doubt in my mind that our house was meant to be ours and we deserve to keep it....so, fight on, fight on!!!!! I'm gonna keep going with this until the wheels fall off ...... I WILL NOT GIVE UP AND GIVE THEM MY HOME!!!! NOT NOW NOT EVER!!!!!

Please, please pray for us that we can get a modification soon.....I'm not sure how much more stress I can take!
