Try not to get yourself all freaked out with frustration and anxiety, otherwise, you will suffer in so many ways......physically, mentally and emotionally. I totally relate to your feelings of desperation.....I feel that way every day! Just try to relax, remain calm and stay focused...you'll get through this. The hardest part is the unknown and leaving it in someone else's hand to do......you just have to stay on them (the attorney) to make sure they are doing what they are supposed to be doing at all times....

I read in another post that you were feeling pretty low tonight.....I know what you're going through, I've been feeling pretty sad and depressed myself over the past few days. Try to do things to keep you mind busy so you don't obsess over this modification....I know easier said than done but there is HOPE...look at the two success stories.....they were miracles and that can happen to you as well.....just try to be patient....it'll all come together and the issue will resolve itself somehow...... I'm praying extra hard for you tonight that God gives you the strength you need to get through this......and you will get through it and emerge stronger than before......YOU WILL PREVAIL, I CAN FEEL IT! Just don't despair and lose hope.......if you need someone to lean on, WE ARE ALL HERE FOR YOU! Remember that!

They requested a YTD P&L Statement, which I sent over this morning...and now we waiting to hear back. It doesn't look like much of an update, but the fact that AHMSI is finally responding makes me feel very hopeful and a little excited. Please keep on praying for us and I will do the same for y'all. I will let y'all know as soon as I hear anything more. -TX |

Keep the chin up and be real with yourself on this. What I mean is, keep your goal in front of you and make sure your original goal is still the goal you want. I am very happy for this bit of news from you. Keep the faith. We have begun our journey through the Paiva law firm. The understanding I now have is that this is not a quick process. I think it is MAJOR that you are going through round two. I am sure that the Paiva firm has explained the hammers they use that ultimately would not be advantageous for the banks to have aired in a court of law. I know your pain with Option One and AHMSI conversion. We went from Option One to Select Portfolio Servicing for Chase Bank and that is how we were alerted to this whole train wreck of a situation and the realities of what we did know about our loan. I am very scared because we had to make some decisions to prepare for what we are planning to do and it is a calculated risk, but we believe that our particular situation is so out of line that our case will prevail. I am going to start a thread under "Loan modifications" in the forum giving folks an idea of how this goes, even if it is a " no news yet" post. Then, if we go to a lawsuit, when it is over I will share the results, good or bad. I want others to find a way to get legal protection to some extent. We found out that we COULD NOT deal with the bank, they simply won't play fair. I wish I could share the ridiculous conversations and actions that have occurred. I appreciate each and every one of you. Persistence - I think hiring Paiva is a wise move. AHMSI was awful to deal with. I am glad that I have someone else working with them on my behalf...let's just hope it turns out good. You and your family are in my thoughts and prayers and I am looking forward to reading about your journey to (hopefully) success. Sean (as Dan said) - YTD P&L Statement = Year To Date Profit and Loss Statement. They wanted me to provide one of these because I am self employed. Somewhere in my story AHMSI denied our modification based on "insufficient income"...even though I had provided them with everything they asked for and more actually...but because they didn't have the P&L Statement they did not count my income. And, keep in mind, they never asked me for one either, so I suppose reading their mind was what they intended. I had never even heard of one, so I couldn't have possibly predicted that they would have needed one. That has been the insanity of my situation throughout this entire ordeal. Anyway...they denied us and told me our file was closed, but we could start over again. NOT TRUE! I haven't resubmitted anything...and they are working on my file with no problems it seems. For all the heartache and sleepless nights I have gone through...let's hope they make an offer I don't deny. -TX |

I am more of a "lurker" on the site, but I am rooting for you and everyone else. I meant to tell you before, that originally our loan was with Option One and when they sold it to Chase (Select Portfolio is the servicer), that is when we found out the horror of Option One. I absolutely understand how horrible that OOM was and AHSMI is. I have a curiosity question. Did you go through a mortgage broker? Thanks Tx! Hang in there, and I agree, I am glad we are with Paive Law Firm. |

AHMSI called us this morning (supposed to be a regular collection call, I guess) and I told them to contact our attorney, blah, blah, blah...and then the collection guy informed us that they filed a notice to foreclose (!!!) on August 7th. I was like...whhhhhhaaaaaaaaaat?? As of today...we are only 45 days late. So they are moving fast. Also, we have never received anything from them stating this...NOTHING. Crazy! My husband spoke to our attorney's office this morning after they called and they said they would call us back with information later today. So...for now...we wait... -TX |

That seems pretty quick.....what does your attorney say about that? That is just crazy! Were you panic stricken or what? That is what I am most afraid of, being forclosed on quickly and having no time to get a place. Here's a copy of the Texas foreclosure law for you to review.... - Judicial Foreclosure Available: Yes - Non-Judicial Foreclosure Available: Yes - Primary Security Instruments: Deed of Trust, Mortgage - Timeline: Typically 60 days - Right of Redemption: No - Deficiency Judgments Allowed: Yes In Texas, lenders may foreclose on deeds of trusts or mortgages in default using either a judicial or non-judicial foreclosure process. Judicial Foreclosure The judicial process of foreclosure, which involves filing a lawsuit to obtain a court order to foreclose, is used when no power of sale is present in the mortgage or deed of trust. Generally, after the court declares a foreclosure, the property will be auctioned off to the highest bidder. Non-Judicial Foreclosure The non-judicial process of foreclosure is used when a power of sale clause exists in a mortgage or deed of trust. A "power of sale" clause is the clause in a deed of trust or mortgage, in which the borrower pre-authorizes the sale of property to pay off the balance on a loan in the event of the their default. In deeds of trust or mortgages where a power of sale exists, the power given to the lender to sell the property may be executed by the lender or their representative, typically referred to as the trustee. Regulations for this type of foreclosure process are outlined below in the "Power of Sale Foreclosure Guidelines". Power of Sale Foreclosure Guidelines If the deed of trust or mortgage contains a power of sale clause and specifies the time, place and terms of sale, then the specified procedure must be followed. Otherwise, the non-judicial power of sale foreclosure is carried out as follows: 1. Prior to proceeding with a foreclosure, Texas laws state that the lender must mail the borrower a letter of demand, informing the buyer he has twenty (20) days to pay the delinquent payments or foreclosure proceedings will begin. 2. At some point after the borrowers twenty (20) days have expired, but at least twenty one (21) days before the foreclosure sale, a foreclosure notice must be: 1) filed with the county clerk; 2) mailed to the borrower at their last known address; and 3) posted on the county courthouse door. 3. The foreclosure sale must take place on the first Tuesday of any month, even if said Tuesday falls on a legal holiday, but only after the proper preliminary notices have been given. The sale is on the courthouse steps by auction to the highest bidder for cash. Anyone may bid, including the lender, who bids by canceling out the balance due on the note, or some part of it. Lenders may obtain deficiency judgments, but they are limited to the difference between the fair market value of the property at the time of sale and the balance of the loan in default. Judicial - Texas foreclosure law states that a lawsuit must be filed to obtain a court order to foreclose. Upon receiving all claims, the court will make a judgment in favor of the lender and against the borrower for the balance due. The sheriff is directed to auction off the property to the highest bidder. Non-Judicial - Power of Sale - According to Texas foreclosure laws, the lender gives the debtor in default a written notice or demand letter. The borrower is given 20 days to cure the loan before the debt is declared due and notice of sale is given. The lender will then instruct the trustee to proceed with the foreclosure process. A sale of real property under a power of sale conferred by a deed of trust or other contract lien must be a public sale at auction held between 10 a.m. and 4 p.m. of the first Tuesday of a month. The sale must take place at the county courthouse in the county in which the land is located, or if the property is located in more than one county, the sale may be made at the courthouse in any county in which the property is located. The commissioners court shall designate the area at the courthouse where the sales are to take place and shall record the designation in the real property records of the county. The Texas foreclosure sale must occur in the designated area. If no area is designated by the commissioners court, the notice of sale must designate the area at the courthouse where the sale covered by that notice is to take place, and the sale must occur in that area. (b) Notice of the sale, which must include a statement of the earliest time at which the sale will begin, must be given at least 21 days before the date of the sale: (1) by posting at the courthouse door of each county in which the property is located a written notice designating the county in which the property will be sold; (2) by filing in the office of the county clerk of each county in which the property is located a copy of the notice posted under Subdivision (1); and (3) by the holder of the debt to which the power of sale is related serving written notice of the sale by certified mail on each debtor who, according to the records of the holder of the debt, is obligated to pay the debt. (c) The Texas foreclosure sale must begin at the time stated in the notice of sale or not later than three hours after that time. (d) Notwithstanding any agreement to the contrary, the holder of the debt shall serve a debtor in default under a deed of trust or other contract lien on real property used as the debtor's residence with written notice by certified mail stating that the debtor is in default under the deed of trust or other contract lien and giving the debtor at least 20 days to cure the default before notice of sale can be given under Subsection (b). The entire calendar day on which the notice required by this subsection is given, regardless of the time of day at which the notice is given, is included in computing the 20-day notice period required by this subsection, and the entire calendar day on which notice of sale is given under Subsection (b) is excluded in computing the 20-day notice period. (e) Service of a notice under this section by certified mail is complete when the notice is deposited in the United States mail, postage prepaid and addressed to the debtor at the debtor's last known address as shown by the records of the holder of the debt. The affidavit of a person knowledgeable of the facts to the effect that service was completed is prima facie evidence of service. (f) Each county clerk shall keep all notices filed under Subdivision (2) of Subsection (b) in a convenient file that is available to the public for examination during normal business hours. The clerk may dispose of the notices after the date of sale specified in the notice has passed. The clerk shall receive a fee of $2 for each notice filed. (g) The entire calendar day on which the notice of sale is given, regardless of the time of day at which the notice is given, is included in computing the 21-day notice period required by Subsection (b), and the entire calendar day of the Texas foreclosure sale is excluded. Do you know if they have escalated your request for a modification to the office of the VP yet? I wonder if they can get some answers from them. I totally understand how hard it is to have an attorney because you have to let them do their job without you getting involved....but times like this make you want to jump in and make some damn phone calls! Keeping my fingers crossed for you....update as soon as you hear anything....I'll be checking in frequently throughout the day. Try to stay calm (if that's possible) and remain focused, do all you can do from your end and be done for the day.. .then pick it up again Monday....it's all you can do.

I want someone down at my attorney's office to get on the phone with someone at AHMSI and stop this nonsense from escalating any further. This is RIDICULOUS!! I know we qualify for a modification...with NO problems. Why can't we get one?! That is the question. I want to call AHMSI so badly right now and work all of this out...but I can't. It's so fricking stupid to me! We, too, can afford a loan modification, but do you think we can get one? Well, you see here I am 9 months later.....still waiting.....it's total bull$hit what they put us through during this process. Why can't they just simplify it and approve people who qualify and have the qualifications the same across the board throughout the industry......just to make it simple but NO it has to be a f%$#@D up process that allows so many people to fall through the *****s and lose their homes.....all because they couldn't OR wouldn't get of their a$$es to help! Sorry for the rant but I am so pi$$ed for you right now I could spit!

We scraped together enough money to make July's payment today, which is leaving us still running 30 days behind, until Monday that is. The first time I called them this morning the girl on the phone would not take my payment. She said she needed certified funds and blah, blah, blah. I didn’t understand this because no one ever mentioned anything like that on any of their daily phone calls. They always ask me for money over the phone..."Can you pay this today." I politely informed her of what we have ALWAYS been told...and she said they were wrong. Whatever! Instead of arguing with her, I decided to call back and talk to someone else and GUESS WHAT...they took my money with NO problem whatsoever (BIG surprise!)...confirmation number and all! What a joke!! I suppose if you don't like what you are being told by one of their collection monkeys...you can hang up and try again. It worked for me. -TX |
