Finally AHMSI SUCCESS!! - Page 2 - Loan Modification Forum

Good morning TX.....

It seems to me that AHMSI is more difficult to deal with than Option One....I'm not sure why but it seems like they are predatory in their servicing, meaning they are charging high fees for everything and conducting business in such a way that it takes advantage of us the borrowers. At least Option One was helping many borrowers with loan modifications....I''m still unsure about AHMSI and how they will be handling the modifications but their record so far does not look good.....I also noticed in some other posts that they are now charging $500 just to process a modification, that is predatory being as Option One never charged a fee for a loan modification......hate to say this but it looks like bad news for all AHMSI borrowers. I am hoping that it'll turn around and we'll see some success with AHMSI.....I take that back, wasn't there a success just this weekend? Maybe there is hope.

My plans moving forward are to continue to hammer at them until I get the modification I need to stay in my home. I am going to stop making payments in August (can't afford the adjustment) and am going to have my attorney use the violations in my documents to hopefully get me a modification. Moe has stepped in on my behalf because I've been at this since December 2007 and he will be working with me and my attorney to get this modification done......now I don't know exactly what they (Moe and my attorney) are planning as of yet but I do know it has to do with the violations I have. You know, you'll have to ask Moe about his background......not sure what the whole story is and I don't want to speak on his behalf.

It is possible we have the same investor but unlikely....the investors hire the servicers (AHMSI) to collect payments, etc. on their behalf so that they have no contact with the borrowers themselves.....sometimes our loans are held by banks or pools of investors, it just all depends. You can ask who your investor is, sometimes they'll tell you sometimes they won't....it doesn't hurt to ask. Oh and if you're in foreclosure your investor should be listed on that paperwork.

Hope I answered your questions....I'm no expert, just been at this for a REAL LONG TIME!

Erika - I have noticed the new fees, where there weren't any before. I think that is CRAP! I do not understand how they can begin to charge these misc fees, when we didn't have to pay them before. I hate to say it...but I think I would rather have stayed with Option One. They seem like the lesser of two evils.

We seem to be in very similar situations. My mortgage reset this month (July 1st), and we did not pay it. I have to admit, though...I am freaking out about it. We are not in foreclosure yet...but if our modification request continues to be denied, we most definitely will be.

I asked my negotiator who my investor was, but she didn't know and she said she was too busy to even pull my file. WHATEVER!

I'm proud of you and how you have been going through this process. It's hard and you have hung in there remarkably. Your story is helping so many people! Thank you!!

Oh yeah, I think we are in trouble with AHMSI...the excessive fees are just the beginning, the tip of the iceberg! Option One was difficult but at least it seemed like they were working with borrowers without charging them for it.....all we can do at this point is pray, pray that things change for the better and they wise up and start helping people.....but like Moe told me the other day, they are in the business of making money and forclosure is a money making business.....they are out to make what they can.

Thanks for the kind words and support......it's been a long road for me just to get this far in the process and I plan on hanging in there until I get the result necessary to stay in my home. I have my good days and my bad days but I come here when I'm feeling down and out and I try to lend support to others and possibly advise them on their situation.....I feel like if I can make someone else's day better then maybe my day will be better, just trying to pay it forward. Posting on this forum and having a strong faith in God is what gets me through my days almost every day because my house is all I think about and it''s all I've been thinking about since December 2007....I refuse to give up on OUR dream. My husband works way too hard to provide for us and I will not let him down on this one I will not give up on OUR home!

What's your next move?

Erika - Things are kind of up in the air for us right now. We are still working with the law firm and currently waiting to hear back from the lender. I will let you know as soon as I have more information.

This is very interesting.....I e-mailed Moe and called my attorney and left a message for him that I wanted to talk to him regarding this situation. I'm not sure how we can MAKE them modify our loans if they are just flat out saying no....OR do they want us to apply several times charge $500 a pop and somehow NEVER return the money.....I know caligirlsteph said that they are supposed to apply that money to your payment if you are denied but that just doesn't sit well with me.......AHMSI is a bunch of scum sucking bastards!!!! Sorry in advance for the profanity but I'm really jacked up about this right now!

I just got two letters in the mail from them today...both of which frustrate me. I am going to talk to my attorney's office before posting any information. I should be hearing from them later today.

Hi Tx and all,

My lender is not Option One/AHMS now, but we started with Option One. I responded because your initial experience from the sale forward was like ours. Anyway, as I read I realize OOM is the most surly of the lenders. Our servicing company is Select Portfolio Servicing (once called another name and with a dubious reputation)-we think our lender/investor group is Chase Bank.

Believe it or not, we never were told when OOM sold us who we really went to, except for one sentence in a letter from Select Portfolio.

It could be we have a different experience because of the lender.

Are the attorneys able to offer you any other direction? or are they just being comforting? Again, I know you can't really talk about specifics, just trying to gather whether they are throwing in the towel or not. Thanks for your patience with my questions.

Hey Persistence - My towel has not been thrown in yet. I spoke with someone at the law firm last night and went over everything. We talked for over an hour (REALLY AWESOME of him...waaaay above and beyond the call of duty) and now I have a pretty good idea of what to expect from this point forward. He was straight forward and answered all of my questions honestly, without telling me "everything is going to be fine," once...which is something I appreciate immensely. I am one of those kind of people who only deals in facts...and I can handle any situation if I have 100% truth about what is going on.

The problem is that AHMSI is one of their more difficult lenders to work with. So, honestly...it could go either way...no one knows for sure at this point. I can appreciate my situation now because I know exactly where I stand in it. Although it's not ideal, I can deal with it because it is true.

That being said -
The law firm is comforting, for sure...but they are also very knowledgeable, so I feel like if my loan can be modified, they will be the ones to get it done. I think AHMSI may be too difficult to deal with individually at this point, so having a law firm backing me will only force them to negotiate. If anything good comes from those negotiations it is anyone's guess right now...but I am hopeful, and I will keep y'all posted.

Wow! I didn't know they filed for bankruptcy.....maybe that's why they are charging so many fees....who knows.

txhomeowner, hello and welcome to this mess...sorry...but im sure if your here you know what i mean...ive been doing this now since our rate changed in December07...yep that long...Was reading your story about the YSP, yeah found out later that our broker got 15K for putting us into a higher rate and the lovely two year ARM....wasn't that nice...well hang in there...lots of ups and downs...saw your Q's above..Moe founded this site and i don't believe he is an attorney but a advocate for homeowners rights...He would be the man who is fighting for us every sec...he does watch this forum too...as for Option One, AHMSI is supposedly their new name...but from what i see is they may have actually sold option one to AHMSI, this just happened in June, we got a letter about it...I think we are about see it go from bad to worse since this change, who knows who is who...they lie so much, im at the point i don't trust any of them....Well for the investor, as far as i know they don't tell you until your denied, and even then can you really believe the "why" your denied.....not trying to be negative but been in this a while and anything can happen....

I am not sure why AHMSI is denying what seems like all of the Option One mods that were in progress............this is crazy.........

Steph was waiting to receive a call from the VP at AHMSI.........I would think that would be a good person to ask wtf is going on here............
