Funny, I was browsing through Oprah's website, and for a new show idea she had this question: Is your mortgage in foreclosure; are you faced with losing your home?

I wonder if this epidemic is buzzing in her producer's ears?

I've been A P P R O V E D!!!!!



The terms offered: 5.25% rate for a payment of $3,600 some odd dollars, but with a longer mortgage of 40 instead of 30 years!!!


This is $1,700 less than the fully amortized payment which is negatively amortizing like crazy right now!

So NO MORE NEGATIVE AMORTIZATION!!!! And a more affordable payment!

My mortgage right now at the rate of 8.0% is a whopping $5,300 a month!!!

PHeww, I know -- you might be wondering how I could afford that, but wait, I didn't -- I mean I couldn't, I really never could. What the LO advised me to do was pay the minimum, $2,400 and then alternatively the $5,300 every two months and then refi in two years -- she said I could pay down my principal no problem this way.

But it was BS -- the principal balance just kept growing and growing. Plus, my industry became slower and slower and money stopped coming in.

Then in ten short months my balance had risen $14K. I pulled out some money from my savings and forked over about 11K -- 6K to bring down the neg. amortization and about 5k to make a full payment in November.

Today, guess what? My balance is still 10k more than what I borrowed.

And Countrywide never responded to my RESPA request -- hmmmm, WAIT JUST ONE MINUTE!!!

I got three calls from my Negotiator yesterday (I left my cell phone in the car) and one call from T.J. Mullen from Customer Service Escalation.

Moes looking over my docs and we've agreed to wait for me to see if there are some MAJOR violations in there before I submit those papers.

I'll get them by Monday so we have time -- time enough for me to write a scorching letter to CW telling them,

Look here, that's a nice offer you're making but it looks like you guys owe me some money

Congrats on your first win. Those are great terms compared to what you had. Maybe Moe can find some violations and you can move to rescind. Once its all said and done, I'll move this thread to success stories unless you want it moved now since you won the first battle. Let me know!

So here is the letter from Countrywide.





I have to say, started the process 11/29/07 and now, 1/20/08 it's almost over.

I did not have the horrible experience that others unfortunately had and I'm not at all smug about it, I think part of the reason why is that I first went in person to a CW facility. Of course, I was already posting here so I went with ALL of my docs, tax returns, bank statements, et cetera.

The manager was able to put me in touch with a key player at Countrywide and I spoke to the Negotiator right then and there, in their office.

They faxed all 73 pages initially for me and when the fax wouldn't go through, THEY Fed-exed.

AFterwards I documented everything twice, by fax and then certified mail. Every conversation. I called about every two or three days, and towards the end called and contacted by email the people Andrew references in his success story page.

I sent a QWR stating a number of TILA errors and also disclosed that I had filed complaints with the FTC, NYS Banking Department and the Director of RESPA in HUD.

My rate is really good, 5.25% and it's permanent, forever.

They're giving me until the 31st to send the docs, and sent me a FED EX envelope, to boot.

Although I am still going to go ahead and try and get them to forgive some of the debt due to TILA errors in my doc I can't complain about my experience.

My negotiator always called back, and was never disrespectful. When I had to fax documents again, I quickly mailed certfied return receipt requested.

My Negotiator kept saying "We have A LOT of docs from you!!!"

So I don't know if it was all, a combination or some of these things that caused me to have a different experience but most certainly, with the help of Moe and all the priceless information he provided, I couldn't have done it!!!

So thank you Moe, your'e the greatest!

Do you have to send any funds in to get the mod?

Because I wasn't late, I didn't have to send any funds.

I want to give everyone hope, because I had a Jumbo Convo Option ARm with an 8.0% rate, neg. amor. at $2,500 per month above the minimum payment and set to go up to the fully amortize payment in less than 3 years -- the offer they gave me is really a good one.

Moe was kind enough to take time out of his busy schedule to send me over a letter which I could follow the format of to send a request to CW for foregiveness of some of the prinicipal on my loan due to the TILA errors. I'm very stressed out because after emailing a number of people, I want to head over to the post office but I'm not sure WHO exactly to send a certified letter to. I don't have much time, barely ten days, and I don't want to waste time.

I went through the list the Andrew posted -- some of those emails don't work. Maybe they changed them?

I received a response before from Ms. Jemison and Ms. Jariwala -- I also got a call from a T.J. Mullen, in Customer Service Escalation. I'm going to reach out to him and see if I get any results.

Also, there is another person that the manager at the CW center referred me to, Ms. Paula Edwards at the Home Ownership Advocacy Department.

You are so welcome Jac Mac. I feel like your a friend now an this is more then just a website. You have added color around here and I feel have been instrumental in bringing other homeowners on board to let their voices be heard and to be proactive.

I have to tell you that you have been a great inspiration to me. I have followed your threads, read your comments on Moe's blog, and read your comments here on the forum and I do believe that you are truly paying it forward. You may not realize it but your story gives the rest of us hope and courage to fight our lenders for a loan modification.

Again, I am so happy that you have been successful in getting an almost impossible loan modification (no one thought it could be done) from CW. You deserve it....and I hope you get some of your principal reduced, now that would be the icing on the cake! God bless you!

So here's another update. I send out a number faxes in the weeeeeee hours of the morning, and also faxed some this morning. I left a message with T.J. Mullen in the Customer Escalations Department and he did not call back so I called again.

He told me that my RESPA letter had been received and I was currently being assigned a person to handle my file. He said, though, I could go ahead and sign the loan mod papers because any relief I got or negotitations I made wouldn't affect the loan mod. He said to look to hear from him in 24 hours with a name.

I was in the process of writing a letter reflecting what was said when I got another call from him where he said, whoops, looks like if you sign you WILL waive a right to make changes to the principal of your loan. He also had the name of the preson handling my file.

She apparently works for Kay Jemison (did I say thank you, Andrew ) and already had my fax. She said she'd call me Friday after looking over my file but I told her I had until Jan. 31st to submit my loan mod papers so she said she'd call before Friday.
