ASC offered a forebearance plan that wanted 2200 down then 1400 a month for 3 months then 4th payment of 3500. But they claimed after successfully completing 3 payments we would put the past balance behind us. The other paper we had at home was for us to pay 1999.99 by dec 31 or go into foreclosure. We decided we did not trust this forebearance since we never heard of it. We paid the 1999.99. The next month we called to make a payment and was told we were in foreclosure. We ended up paying (name removed) to talk to ASC for us. April 9 2008 we were served with a complaint to foreclose. We have to respond within 30 days. The killer is (name removed) has gotten ASC to offer another forebearance agreement. This time they do not want any money down and we must pay 1452 a month for 3 months than the 4th payment will be 8400. They said as soon as we make the 3rd payment we need to contact ASC to have the 8400 rolled into a modification. The papers say that it will suspend foreclosure. It wanted payments to be mailed. but (name removed) has gotten them to give us a western union account so we can pay that way and it would be documented. Does this sound right? has anyone paid for 3 months on a forebearance and had the 4th payment put onto the end of the loan? I have 3 kids and a wife I have no intent on leaving our home.:confused by the way the court papers says my lender is us bank associates Last edited by Moe Bedard; 04-15-2008 at 06:22 PM.. Yes this is normal for a lender to do a forebearance plan then roll to modification........they want to make sure that for the first 3 months.....you are going to hold up your end of the bargain and make the payments in full and on time........before they modify the loan. However, you did end up paying a third party to do what you could have done yourself.........or contacted a non profit to do for you without paying........

I shelled out money I could have used towards my mortgage defaults. I don't understand why the forbearance doesn't state that the last payment of 8400 would be rolled into nod. It says we need to make all payments on time and in full. It does not say anywhere that we do not have to make this payment. After the company I hired got the forbearance done I started researching everything and came across this site. i wish I had come here first. As of now I hve no sale date. my first payment is due april 30th. I am going to pay it this weekend(saturday). Now since ASC made this forbearance and my loan is with US bank associates how does the lawyer know to suspend the foreclosure? And has anyone completed this forbearance with the balloon payment and not had to pay the 4th largest payment? Thank You |

Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Re: ASC, served foreclosure papers april 9 Not yet..........this is something that we are seeing more of the lenders start out with.......just make the first payment and then speak with ASC yourself and begin faxing the necessary modification paperwork..........just tell them that you would like some sort of confirmation that they will in fact seek a modification when you have completed the 3 payments under the forebearance..... I am sorry you didn't find us sooner too..... But you are here now........

THis is why we scrambled for help. Like I said before I have no intention in leaving our home. Funny thing is we received a letter letting us know that our ARM would not adjust. It is at 9.5% right now. I know its high but we thought we would get our credit rating up and then things just went wrong. I know the company asked for a reduced interest rate and fixed rate away from this adjustable. They collected lots of info and asked all kinds of questions. When we called all we got were the collections people nobody who would or could do anything. SOmehow this company got a case to a negotiator than this forbearance comes up again. I have been reading that a few people on the board here have started this forbearance. I am avidly looking for someone whom completed it. I am just looking for some comfort that ASC is honoring the 3 month payment they are preaching about. still no mention of the 1100 we have in suspense account. What happens to the foreclosure? Do i take the forbearance to the court house? I have approx. 30 days from April 9,2008 to appear. There is no sale date just the motion to foreclose. I am in Illinois |

ASC is very hard to deal with.......but at least you have some hope........there are some success stories you can read in the Success Section for ASC. You also have to get out of the collection dept. and into these depts. for the modification........ It is due on June 30 but we paid it on June 2. I called ASC yesterday and was told that my last payment was going to sit in the suspense account. I have a total of 2700 dollars in the suspense account. My other 2 payments went to interest and a little to principal. I was told that the remaining 8400 would be added on the modification. I was told that the would probably not start working on the modification until early July and it will take 30-45 days. The foreclosure was suspended on April 23rd. |

I was told that we do not have a payment due for July and that the money we have in suspense will be used for our contribution amount. They have not asked for any papers,w2's bank statements or anything this time around. Is that normal. I know the company that we were using to help us with this matter had submitted out hardship letter and financial papers months ago. I asked if there were any notes of what was needed from us they said no. |

It would seem the financials you submitted 3 months ago are the still the ones that are being used. However...I had a loan modification completed on my 2nd and although they took my imonthly ncome vs debt over the phone. I was not required to submit bank statements etc.. rj |

I told the lady we have mailed a copy and faxed 3 copies. Then she tells me they just received our June payment. I explained to the lady we made the June 30th payment on June 2nd. She said our loan would be reviewed for modification soon and it would be done by the July 30th. I told her last week I was told by "person's name" that it is in review now. The lady said oh sorry for the call I have 3 copies of the signed forebearance here. and our payment was received on June 2nd. Our loan will get to a negotiator soon. She also said to call once a week to check the status. |

I am happy to say that ASC called today. The lady on the phone even adjusted our expenses so the mod could be approved. My payment has went up $100 a month. my arm is gone I am now at a 9.5% fixed for the remaining 28 years. I was going to fight for a cheaper rate but my loan originally was 9.5%. So it' smy bed and I will gladly lay in it. I do not have to come out of pocket any amount but the money we had in suspense will be used for our contribution amount. All things considered we have saved our house and our next paymnet is October 1st. DHL should be arriving with our documents. |

ASC forebearance is a very strange program beause it doesn't offer any protetion that the default amount will be forgiven if you make the 3 payments. ASC has kept approx. 3000 we had in suspense for our "contribution amount" they also added 10,000 onto our loan so now we owe 170k instead of 160k. This actually pissed me off because we love our house and made some very bad 1st homeowner mistakes. We have chalked this up as a learning experiene. We have setup a 2nd bank acount for auto pay and we will be paying biweekly so we can pay mortgage off early. our 9.5% interest rate we will try and get refied to get a lower rate after we make some ontime payments. Please move us to the success stories |

They have been unable to get a phone number for our negotiator (although apparently, one has been assigned). The only way of communicating is via fax and they keep getting the runaround. Do you have a phone number of your negotiator? I'm trying to find some way of breaking through to talk to someone directly. Thanks for any info!!! ETA: Congratulations!!!! |
