Another CW SUCCESS!!!

I have been reading this forum for months while going through the modification program through CW. Here is my story:

I began this process in July of last year. I called weekly and was assigned a negotiation, Michael Hernandez, 10/23/07. Since that time I have called weekly, turned in all the necessary documents and still appear to be no closer to modification despite my asking for help.

As it stands now, I spoke to Mr. Hernandez almost a month ago. At that time he told me that they would freeze my interest rate (it has adjusted) to the initial rate and that I would not need to make a payment unitl April. He directed me to call back in 10 business days in order to ensure it had been approved, which I did. At that time there was no indication in my file that it had been approved. I called back last week, and have tried him 3 times since then, with no response. I received a notice of default last week, and today have called twice, and left a message with his supervisor (thanks forum for the #).

My problem is that I have not documented all my calls..What should I do next?

Call daily, two to three times if you do not get through and fax them daily. Mail a copy of your request and a summary of your status by registered mail, with return receipt. Be sure to include all the identifying information your name, loan number, property address, last four digits of the primary borrowers social security number, your day and evening phone and fax numbers, your email address. Once a week is not sufficient. Since you have received a notice of default, I recommend phoning and faxing all of the numbers that Poppy gave you earlier. Write a summary of your story and send it to the regulatory agency in your state and your states offfice of consumer affairs. CC the regulators on every correspondence that you mail or fax to CW. If there was an attorney listed on the NOD call, fax, registered mail him or her also. You can not do this just once. Be a pest. Tell them that you understand they are swamped but your modification has been going on for months and that you are going to call, fax, mail repeatedly until it is successfully completed. See if you can reach a human at your states regulatory office over bank and mortgage lenders. Most states require the lenders to have a format and individual to handle complaints. I have found that sometimes it gets their attention if they hear from requlators or know that they have been reported. Best of luck with this and keep us informed of your progress.

The e-mail formula for Country Wide is as follows firstname_lastname.countrywide.com if the underscore does not work, use a "dot" between the first and last name....if you have his first name..and last name, send him "love" notes. Here are some other folks at Country Wide to send those caring notes to ---- caring is sharing....

Also QWR the file...here is the information on all of the above and the QWR -You need to be the proactive, responsible party with them and keep at them. It would not hurt to send a QWR demand - there are examples of the letter in the Tool Box. In that letter demand your Life of Loan History, copy of Note, Deed of Trust, Riders, all Assignments of the Deed of Trust, TIL, Right of Rescission (if refi), Lender Final HUD-1, copy of initial loan application and final lender loan application, all disclosures and all loan documents in your file, copy of appraisal. Send this three times certified return receipt required and also send it to the Broker, Title Company and all others in the Chain of the Transaction.

Well, thanks to you all, I sent off the modification paperwork yesterday..The day after I posted this I emailed and faxed every number/person Poppy listed above. Within two days I had three calls from my negotiator, then I got a call from the presidents office, and was told that my modification had been approved.

My documents arrived last Friday and were sent off Monday. My loan will remain at 7.625% for five years! The only thing I was unprepared for was that they wanted me to send a $2500 payment to close the deal. With some shuffling I will be able to do that and I am done!!

I never could have done this without the forum. It is so sad that I had to wait nearly 9 months for this process to be completed. The bottom line is that Countrywide will modify loans, but it is like a fulltime job to get them to do it!
