Question Countrywide Approved Success!!

My parents and I purchased a home back in Dec. 2005. The house is under my name because my credit report was better than theirs. When we bought the house, we expected to refinance after two years to avoid the jump in our interest rate. Because of the condition of the market, we were unable to refi and were introduced into a modification program with countrywide in Dec. of 2007, two months before our interest rate went from $2,300 to $3,060! On January of 08 I sent the workout department a hardship letter with a listing of my expenses and income. Our total expenses come out to be about $8,800 and our income is of about $8,900. This includes the increase of our mortgage and our second mortgage with another bank. We were allowed to include my parents’ salaries and that’s how we manage to pay for most of the expenses in our home.
Two weeks after I had sent in the documents, I was finally told that it had been assigned to a negotiator, but that I would not be hearing from her until about 30 days later. I called every week, twice a week, to obtain upgrades. It wasn’t until some 40 days later that I was finally ALLOWED to speak to the negotiator. The sent her an email and I was contacted within 2-3 days. She went over our finances and said that we were spending too much on things like food, car payment, etc.
$700 for a family of 5 seems to be too much to be spending in food. I have to commute about 60 each way to work because the salary that I make here in one month will take me months to make it around home.
She suggested the modification to work as follows: freeze the interest rate as it was, 9.99% with $3,060 per month. I told her that as much as we tried, we just couldn’t. She suggested that I call back the next day, I did. I modified the numbers in my expenses and they still came up to the same. How is a family of 5 supposed to live with only $64 dollars left over???
The following week I received a call from a different person calling on behalf of my negotiator who offered to apply for the interest rate to be brought down to 6.99% (the initial rate) and said that she did not see why it would be denied. She asked that I call back within 5 business days.
I decided not to wait and called two days later only to be told that my application had been DENIED, yesterday.
The customer service representative could not give me a reason why, but even she was surprised that it had been denied.
March was our second month with the increased payment and we are struggling to make those payments, yet we are. We are tapping into savings accounts and credit cards to not fall behind but it seems like we just keep making them think that yes in fact we can make payments and everything is fine and dandy.
As of right now I await a call back from the negotiator to tell me the WHY of the decline in the modification.
Where do I go from here?

Welcome to the forum and thank you for joining....

They should be able to at least give you an idea why it was denied, that response is unacceptable. You need to QWR the loan and I will include that below, meanwhile get a hold of HOPE 888.995.HOPE and have them start working on your behalf.

You can apply for another modification, this time using the QWR and HOPE you may have much better prospects of success. There is a reason and I am suspecting it is from the Investor/Pool end of the request. However, you need to find out why and that means, going through the numbers below and seeing if you can find someone to give you a specific and relevant reason. Do not back down, call, call, call.....get answers and hold their feet to the fire.

Meanwhile, contact HOPE, and also do the QWR...- there are examples of the letter in the Tool Box. In that letter demand your Life of Loan History, copy of Note, Deed of Trust, Riders, all Assignments of the Deed of Trust, TIL, Right of Rescission (if refi), Lender Final HUD-1, copy of initial loan application and final lender loan application, all disclosures and all loan documents in your file, copy of appraisal. Send this three times certified return receipt required and also send it to the Broker, Title Company and all others in the Chain of the Transaction.

Question Countrywide Approved Success!!

After having been told on Friday that my modification application had been denied, i contacted the office of the president of the president, the paralegal of CW, the supervisor of the negotiators, all three of them as advised by Poppy.
This morning, I contacted countrywide this morning to find out if there was any status on my modification and was told that the modification file had been sent back to the negotiator for corrections. Apparently, there were documents missing and it needed to be audited by the negotiator and worked on within two days. She stated that in fact it had been denied on March 6th, but that on March 7th it was sent back to the negotiator. As of right now, it is in the hands of the negotiator to obtain the “information needed.” She told me that an email would be sent to her for her to contact me.... fine. I will wait.

I called back about an hour later to speak to an different set of ears. She told me that my “file was still being reviewed and that it was close to being finalized.” (HUH?!)

According to her, it was not under “Closed and ready to be closed” (as I had been told last Friday) and that I just had to wait for my neg. to call me back.

Why would they say it was denied and now that it is under review. COuld the messages i left to those people on Friday have anything to do with it?
I continue to wait.

Nothing in this process is a science, they miss things and when I underwrite a file I have been known to decline it as the information that was presented was not sufficient to allow approval. With submission of additional documentation or re-review of the file with different standards, program, or guidelines I have been able to over turn the decline and make the loan approved, with conditions of course.

This is not much different, apparently someone may have missed something or not reviewed some documentation and information properly, all you can do is wait. These gals and guys are only human, they are under the gun too.

Your contact with the President's office and with the Legal Department had some effect, give it time and call them tomorrow, remember call, call, call and fax, fax, fax....let them know that you are concerned and that you want to work this out and keep the house.

You are willing and ready to work on this too, they need to know that...

This morning, I read on this site that it would be beneficial to write emails. I wrote a joint email to pressroom@countrywide.com, david_bigelow@countrywide.com, angelo_mozilo@countrywide.com, chris_oltmann@countrywide.com, vice_president@whitehouse.gov, OCIP@do.treas.gov, customer_service@countrywide.com, service@naca.com
I also included my negotiator's e-mail address.

It worked!

Within the hour I received a call from my negotiator first appologizing for the misunderstanding. My modification HAS NOT BEEN DENIED. It is under review process with the managment department. Yay! That gives hope.

She was very apologetic and much nicer this time. She said that as of right now she was unable to give me an answer as to when it would be resolved, but at least I am being heard!

Wow, I sent my e-mail this morning and by the end of the day i had received three phone calls! One from the negotiator, the second one from the CEO's office, the third from a different negotiator from the office of the president.
Because I contacted the office of hte president, the modification had been transfered to her for an more in depth look. From now, she said, she will try to work on getting me a response within the next 24 to 48 hours.

here is the deal. We are requesting a modification after only having $64 left over after we have paid all of our expenses. We are trying to lower the rate from 9.99 to the 6.99, the original rate. She stated that she understands why we are trying to modify the loan, however, they have to look at it from all angles, meaning what happens if the market does not improve in 5 years?

hmmmm How about we try to save the house for the next five years and worry about that later.

I have read that if you are negative in income, you are likely to get denied. We are $64 up, however, if the car breaks down we have no money allocate for that! We are not behind. We have managed to make the payments, but we are struggling.

Right now it's being reviewed by managment and i will be contacted within the next 24-48 hours. Again, i wait.

They are trying to make some permenant solutions to a very long term problem...the economy is not getting better, it is going to really have some problems here in the near future....

The goal is to modify and meet the needs of the investors and of the borrower...so maybe not 6.99%, maybe 7.20%, the goal is to get everyone in a win win situation on these, the homeowner and the investor. They have an anticipated rate of return that now they are not going to get...so the best that they can do at Country Wide is try to make each side manageable.

Does it always work, no, but you are getting a fair look now with this recent turn of events. Toes and fingers crossed for you and saying a few....

Wow, I sent out an email today and nothing! I have faxed, emailed and mailed today. I called the presidents office 800-601-2522, ext8026 and I got routed to customer service and then they wanted to send me to the home retention group (hold time 4-5 minutes). That didn't work.

Well, I got a very nice man at the retention group that gave me the negotiators name spelling again, her extension, her supervisors number and then transferred me to her supervisor. I left a message. He said this is not the only time this happens. That alot of people are going through this so he was going to help me the best he could. AT least he was honest and helpful. I was very thankful just to hear someone that tried to get someone on the phone for me. Everyone else can care less.

Great News! I just got a call from my negotiator in less time than what she had anticipated. It only took her 23 hours.
We have been approved for a three year freeze back at our initial rate of 6.99%. So we go back to paying $2,119 instead of $3,200. Although it is not what we originally wanted, we asked for a five year freeze, it is the best we can get and we will take it. She said that after that we should hope that we are in better shape to refinance.

She said that after that my loan would go back to being an ARM, but she wasn't able to tell me how it would adjust after that. The paper work will be prepared tomorrow morning and i should have it by friday. another good thing is that our first payment will not be due until May 1st.

How does this look? I am happy. We will worry about the time after the three years when the time comes. right now, we are in better shape than what we were yesterday, right?

Hi, I got my modification envelope his past friday. However, two things that were listed on the letter were missing. 1 the Addendum to the loan and 2 the application for automatic payments. The only things on the envelop were the letter letting me know about the modification and the modification agreement.
I contacted my negotiator and was unable to reach her, i think she was out for the day bc in teh past, she's been pretty good about calling me back or answering my calls since i was assigned to her last week. I will try her again on Monday to find out the status of these documents.

They are running out of paper and they are leaving out the less important documents.....?????? You are the third person with this problem on the mod packages coming to them short the necessary documentation.

Have them fax you the missing pieces and if they forget the Automatic payments, so be it, you do not want that to be something that they control anyway....so do not get treated like a second grader.....that is my opinion.

As for the other document...The Addendum to the Loan is pretty much sets out the terms of the Modification as an Addendum to the Note on the loan....

They can and will fax it to you, saves them that valuable paper you know....

I have called my negotiator a few times and I have not been able to get a hold of her regarding my missing document, i.e., the addendum and the application for automatic payments.
I am guessing the addendum is important, but what do i do if it wasn't sent to me? Do i just send them the agreement for modification back? I have a completion date of March 28th.

Fine - you have her full name - e-mail her firstname_lastname@countrywide.com and tell her to e-mail or fax that stuff to you ASAP.

They are all the same can not return a phone call, besides the valuable paper, they do not want their phones to wear out.....

Liz, you are with a different servicer/lender this member was with Country Wide, you really need help with that budget, did ACORN help you put that together? You really need to have them assist you with the budget process.
