Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Hello Everyone, My story is long and I am sorry about that. Here we go: I had a mortgage with Wilshire Mortgage. I was working on cleaning up my credit so we could get out of a sub-prime mortgage. Things became difficult in July 2007 so we contacted a broker and he said he could help us. Our mortgage was going to adjust in 6 months from July. Well our broker said he could refinance us with a 10.7% interest rate but all we needed to do was to pay the first 3 months and we could refinance into a lower rate after our scores come up. He suggested we work with credit people and they would get our score up to 680. The credit people is a group that cleans up your credit report. It cost us $2200 for them to work on our credit. The guy at the credit people and our broker were friends. I trusted our broker and i trusted the credit people. 1) OK. first of all we refinanced on July 26, 2007 from Wilshire mortgage to EMC mortgage and I paid for the money to be wired to Wilshire on the 31st of July. Well they did not wire the money they mailed it to them and wilshire received the payment on August 1, 2007 and so they put a late on our credit report. I have been fighting it and fighting it with no good results. 2) OK after the refinance we were in contact with the credit people and our Broker about cleaning up our credit report. Things were going good. 3) The 3 months were up and the credit people said they could not get our score up to 680. WHAT. we had our score up to 654 and our broker said he could not help us until our score was up to 680. Things got really bad because we told our broker we would not be able to keep up with the payments because we trusted his word. 4) December rolls around and he said that there is still nothing he could do for us because now the late was showing up from the refinance with Wilshire. We did not want to get behind on our mortgage so we borrowed money from my mom and i sold my engagement ring to make our mortgage on time. Our broker keeps on giving us false hope and my husband and i are at our wits end. 5) I called the broker in January and i sad that we are going to be late on our mortgage. we can not do this anymore. We paid for our january mortgage but it was late. I am fighting that because i fed expressed it to EMC and they received and processed the check on January 31, 2008 and they said we were late. 6) we have been trying to get out of this mortgage for 6 months now and no one will go near us. HELP US PLEASE. We have 5 kids. my husband works 2 jobs and i work 2 jobs. we have a jumbo mortgage and we are not losing our house if we can help it. my kids are settled and i will work 3, 4 jobs to keep my house. | Re: MY STORY - Please Help Thank you for telling your story and welcome to the forum.... The Closing of the refinance with Wilshire in 7/2007 was a bit tricky as there is that 3 day cancellation period that fell between the signing and the actual funding, even with wiring that can go awry....and the title folks do not proceed as instructed. The issue with that payment is not an issue with Wilshire it is with the Title Company as it was incumbent for them to have wired, not mailed. Wilshire is only reporting an accurate representation of what they have of record. The error was a Title error. Now having said that when we are underwriting a file, we are painfully aware that these things happen, we can see that a refinance has occurred and that the 3 day was at the end of the month and as such we will discount the late payment due to just what happened to you. This is on a manual underwrite, now there are more and more that are forced to be done through the automated systems, the automated system does not think.....it is a machine and can not consider that issue. We are forced to use the Automated systems as now we are not doing the nichy, manual EMC, Wilshire, ALS....ALT-A product, they are gone, hopefully not to return. The Agency products require an AUS (Automated Underwriting System) to review the file and return findings. We do it on just about every loan and the decision that the machine arrives at is GOD. We can not change it unless it is seriously egregious and proven to be seriously egregious, like a foreclosure that did not happen or repossession that did not happen....not for late payments can we overturn the AUS findings. Our hands are tied. We are using AUS for every loan that we look at just about, even the more esoteric loans have an AUS behind them with certain findings....we are bound by the decision of the machine. We use the AUS on jumbo, conforming, FHA, everything, nothing is really not run through the AUS. FHA will allow a manual underwrite on a Refer, the underwriters are quite careful on them or should be, we are very paranoid. With your situation I would discount the 30 day in July, but not the 30 day in January and would not be able to approve the loan until the January 30 day was removed....I could not do it without danger to my DE Underwriting status. So you do have to get that January 1X30 day off. So you have the problem with the EMC loan that did not post the payment sent...if you can without a doubt prove that the check cleared your account prior to the end of the month....then you can compel EMC to remove the 1X30 mortgage rating. Not hard, just do not speak to the clone who answers the phone, get the manager of the department and fax them directly that documentation so that the rating can be repaired. Now you used a Credit Cleaner....NO NO NO, you spent a lot of money to line the pockets of SCUM, anything that they did you can do...it is work, but you can do it and frankly the one thing that they do not tell you is that they can get it off for the time being....but in the long run some of it may reappear on the credit report in time. Is this legal, well, there are loop holes, cracks in the system and the old saying garbage in garbage out. The data contained in the credit reports are generally tape to tape and you have to monitor the credit reports to let the bureaus know that if a derogatory trade line that was removed shows up....you had it removed before, that it now has to be removed again. They can not pick and choose to take the trade line off one month, then reestablish the same trade line 60 to 90 days later due to the tape reattaching it to your credit file. Once disputed and removed through proper dispute channels, then OFF it goes permanently. Anything that you paid the 2200.00 for to "fix" your credit report you could have done fairly easily and without tremendous brain damage, just a raft of tedious work on your part. The broker that said "Oh, take this and refinance in 2 months or so...." that is known in the industry as "Churning", highly naughty....if you had taken the new loan with extreme financial benefit to the Broker i.e. refinanced one month then 2 months later.....Broker is in deep whatever if they lined their pockets with buckets of change. Churning will in concentrated amounts in one shop land Brokers in prison and rightfully so. Since they did not do a back to back refinance on you with this loan there is only the issue that they told you they could and will....but did not. This is a constant refrain, oh they told us in 2 months, 1 year, 2 years that they would refinance this awful loan and we would be OK, well they could not, did not and you are not OK. I am sorry to say that with Jumbo loans 680 FICO(that magic figure was history about November or December of 2007) is no longer the magic number, Jumbo product is harder than heck to place, the markets for it are very tight and very picky. The best you can hope for and the best that will be available is the new mandate by FHA and FNMA/FHLMC of the chance of 729,750.00 conforming loan amounts for certain high cost markets in the next 30 days or so. They have not defined the high cost markets yet.....soon we hope. So in this case the thing that is highest and utmost is to keep the payment current at this time toward that product being available to you for a refinance. You can not get the 1X30 day off from July of 2007, it will not come off, it is what it is. The January 30 day should drop if you have a canceled check that reflects clearing your account prior to the end of the month, if not it will have to remain. If you do have the 2X30 in the last 12 months then even the higher loan amounts are not going to help, we would not be able to approve the loan due to the 2X30 in prior 12 months and even 24 months at this loan amount is going to be tough. So....get that January 1X30 off, the 7/2007 1X30 will be explainable to an FHA product, they can and will be underwritten manually on many levels. Of course there are investors out there that will require an Accept/Approve on the Scorecard AUS for the Jumbo FHA's, but there will be some that will accept a manual underwrite on the Refer finding. There the underwriter can discount the 1X30 in July due to the refinance. We are hoping that the jumbo FHA product will have manual outlets built in, we are very concerned that the investors will purely take and only take the Accept/Approve findings on these large loans. Frankly we do not know, the programs are not up and running, and it has never been done before. I can tell you that FNMA/FHLMC will not be the same as the FHA and that those will have to be run through the AUS and the findings can not be manually changed with that product. It remains to be seen how they are going to do the FHA, the situation that you find yourself in is a wait and see position. Until the investors, lenders and TSA's determine how they are going to handle these high loan amounts, we are all in limbo on them. However, the best product for you if you are in the high cost area, can remove the 1X30 in January and have the income, DTI 33/41%, consumer credit that is well rated, to qualify with collateral (property value) support for the request would be the FHA product, manually underwritten by a LENDER. Do not go back to a Broker ever again in your life. Find a Direct Lender to make loan application to from here on out. Stay away from Credit Repair and the silky smooth Oh we can help you crap. They help themselves and their pocket book, not your best interests. Sometime in late March they should have at least identified the High Cost Areas, by early April hopefully some of the investors will be on board with their guidelines for these products...this is the best time line that I can provide for you. I have mailed the credit bearus the check number and amount, a billing stement from EMC saying it was processed on the 31st. I have contacted BBB to investigate this. Now I have to wait and see what the results are going to be. Thank you again for you help. |

| Re: MY STORY - Please Help You also need to go to the supervisor at EMC to get this resolved....they are the driving force behind the reporting and actually the bureaus can not change this reporting even with the checks.... Sorry but true, BBB can help if they are not overwhelmed, this is a situation where you need to be entirely the motivating force with EMC directly....you need to go to them and push the fact home that the check was received and processed within the month. The bureaus will investigate, however if EMC upholds their position their hands are tied, this direction for the 1X30 is completely from EMC. |

| Re: MY STORY - Please Help I will be fairly fast as far as the reporting is concerned...30 to 45 days for scores to catch up....maybe less we are at the end of the month here soon and scoring may reflect the change if they get it in prior to the 1st of the month by the 10th or 15th of the month. If necessary you can always request a rapid rescore from a lender if it does not catch up in time. All in all the lender issue is not germane as you need to wait for Agency product...that will be over 30 days....so...you should be fine. Just keep an eye on things through the bureaus. |

I thought it might be more but that will help a lot. I wrote a letter to EMC about my situation. I also faxed the letter to JP Morgan and everyone else I could find a fax number for. Today I received a phone call from JP Morgan saying they called EMC and they assigned me a case worker. First of all what does that mean? I called him and left a message. He has not called back yet. Should I call him again tomorrow if he does not call me back today? I know I am going on and on and I am sorry about that. Also here is the letter I sent out: Dear EMC, I spoke to someone in regards to help that I needed from your company. My Husband and I refinanced with(removed names and addresses). We did a stated no income refinance. We faxed over all of our w-2’s and a 1099 form. My Husband and I were in a tuff situation when we were refinancing with(removed name). Our Interest rate was going to go up with our old mortgage company. (removed name) said that he new someone from Bear Stearns who would help us. He was (removed name). Phone (removed number). (removed name) was informed of our situation and said no problem. We received a 10.7% interest rate on the day of the signing. We were panicked we did not know what to do. We could not afford these payments. (removed name) told my husband and I that this would be short term because he told us to go to the (removed company) which would get our credit scores up to 680 and then (removed name) from EMC said no problem. So on the work of an EMC employee and (removed name) we did this stupid loan. After 3 months we got our scores up to 680 and tried to get in touch with (removed name) from EMC and (removed name) and they said there was nothing they could do for us. We said what you said that you could help us after we brought our scores up to 680. I had to sell my engagement ring, bring back some of my kids Christmas gifts and borrow money from my mother, and mother in law. We have 5 children ranging from 13 to 5 years old. We love our house and do not want to loss it. We have been working hard to keep our payments on time. After all of this I got in touch with an attorney and had him look over our documents. It has come to our attention that our income was wrong. We bring home $5000 a month and it was documented that we bring home $10000 a month. We faxed over our W-2’s, Paychecks, bank statements, and our 401-k information and there is no way that you can figure out that we make $10000 a month. Since this mess with EMC we have tried to work with EMC and they are not willing to work with us. I can not refinance because our LTV is to high. We are not looking for cash all we want is TO STAY IN OUR HOUSE AND LOWER OUR INTEREST RATE. My Husband works 2 jobs and I work 2 part-time jobs. All we want is to work with EMC so we can lower our interest rate so we can stay in our home. Can you please let us know how we can go about getting a modification of our loan as soon as possible. | Re: MY STORY w/ EMC - Please Help Call back tomorrow, they have assigned a Negotiator to you from EMC through JP Morgan Chase...they now own the old Bear Sterns "stuff", aren't they lucky. You should then get the name and number for the negotiator at EMC and call and introduce yourself and see if they need any further information, paycheck stubs, budget, more on the hardship letter....2007 W-2's...etc.... Keep calling and have the fellow at JP Morgan in the loop so that they can keep tabs on the progress of the modification/forbearance process. |

They asked me all these questions and said that they are sending EMC a letter and it will take 30 to 40 days to hear a responce if they will help with a loan modification. That is good news don't you think? I also called and left another message with a emc counselour that was assigned to me from JPMorgan. He still has not gotten back to me. I will call everyday if I have to. I think I am on the right path I hope. Any input would be great. |

Financial information. I answered her questions and she said that a loan modification is going to be very difficult. Talk about letting the wind out of my sails. Well I got up this morning and I am determined. I called back the lady (Anna) from the Executive Office to see if there has been any updates. I am waiting to hear back from her. I faxed EMC and JP Morgan an update on my modification and situation. I made copies of my loan documents emails from the loan officer who refinanced me and a QWR letter to send to the companies. I am going to call everyday and fax them my updates every day. What do you guys think? |

Does not make sense. These people need to learn people skills and those words should never be said, unless they have fully underwritten your file. Gee whiz, they are doing this over the phone. My question is what is your income situation in regards to your mortgage and expenses. If you give me exact figures then I could guide you the best I can. As far as the calls and faxes, definitely keep that up!

You have to think that usually the best deal they can give you is the best prevailing rate and terms the market has to offer at the current time. As of now, you are looking at a 30-40 year fixed at 5-6% at best. In some cases you may get a lower rate and maybe a principle reduction. Some cases it is only a forbearance or fixed for a year or 2. I do not know how that broker qualified you for this loan based on your income? That throws up some serious red flags and I would take out those loan documents and start looking through them and consider getting a loan audit if there is "anything" fishy in them. This can be your golden ticket for a loan modification.

I sent him my w-2's for 2006, 2007, loan documents and the emails from my borker to me. Please tell me I am on the right track. |

Taxes and Insurance would add another approximate $400 per month. So from approximate $3,750-$3,465 for a mortgage at best prevailing rate and terms and add your monthly expenses of $1546 and you are at $5,296 on a 30 year and a 40 year you would be at $5,002 total expenses. 30 Year you would qualify with approx. $600 in surplus income so you may want to add whatever "other expenses"you may have not included in there to make it closer to $100 surplus or so. 40 year you would have aprox. $800 in surplus. You are a perfect candidate for a loan modification and you just need to keep fighting and make sure they know you can afford your home, just not your terrible loan

I put in the QWR, updates since December of 2007, expence report, copy of loan documents, and emails from my broker to me. What am I missing? I am also faxing tomorrow my expence report and update to the people who I have been faxing to. |

I received a phone call from the Executive Office of EMC(Bear Stearns) and they approved my loan modification. I am paying right now 10.7% and they gave me a 6% interest rate. I am going to be saving over $2000 a month. They are fed expressing my documents in the next week or 2. I can not believe this has happened. The lady from EMC was a bit mad because I faxed the President of JP Morgan and the President of Bearsterns a QWR letter. The President of JP Morgan called Anna from EMC and questioned why they were not helping me. HA JP Morgan. I will tell you something I would not have known what to do if I did not find this site. THANK YOU EVERYONE FOR YOUR INPUTS. I would love to help someone with my experience. THANK YOU AGAIN. P.S. Now I have to wait for the papers. |
