Hello Again. I got my approval on Monday 4/7/08. EMC said it will take 1 to 2 weeks to receive the modifications papers. Should I call them tomorrow to see if the papers went out or would they call me if there was a problem. I think I am just nervous and I want the papers sign them and have this all over.

OK. Having prooblems. My March payment was returned and now emc has to get another approval. Do you think we will be denied?

I don't thing they will deny you.........they will probably have you send it certified funds with you modification papers, that is all.

OK. I got my final approval today. The paperwork will be going out on Monday. The only thing that they want me to do it write a retraction letter to all of the people that are trying to help me. Should I do this? Should I wait until I have the paperwork in my hands first? This nightmare is almost over. I saved my house.

FINALLY They want you to write a retraction letter????MMMMMMM....I feel you should tell them NO! Why? Wait till you have the paperwork and if they want to strong arm you and extort an retraction letter from you, then say you will bring it to an attorney and look into the unfair and deceptive business practices act.

I don't want to place a wrench in your progress, but I feel this letter is BS. However, it is your call Mother and you did save your home. I am a guy of principle and sometimes that gets me in trouble but often it gets me what is right and deserving as opposed to just getting whatever life throws at me.

Thanks Moe. I am not going to write a letter. I think they are scared because Senator Dodd called me. He is the Senator for my state - Connecticut. He was really hot under the collar to say the least at what has happened to me and my family. It made me feel good that someone in that position really cared. My question now is how do I go about going after the broker?

I have been trying to work with EMC for the last 9 months now and have gotten nowhere. Are you willing to provide the names of the people and their phone numbers (JP Morgan and Bear Stearns etc)? I would really like to get somebody to make EMC move on my mortgage.

No problem Mother.

The broker is going to be tricky. Especially if they are out of business and have no money to go after. Meaning, that is the FIRST thing a lawyer will look at to see if the case if won, is collectible. Often, they just want to go after the lender.

However, many have or had E&O insurance at the time when they made these loans and it may be recoverable from there. Not sure. The biggest problem right now is that there are not enough lawyers out there helping people or that know mortgage law. So, even if you find one, mots often they are too busy to take a broker case on contingency. You may find some who will take it on hybrid contingency or a fee. Pro bono. try National Association of Consumer Advocates – Consumer Protection Advocates and Attorneys.

OMG I received my paperwork today. My Husband signed them and I sent a money order they wanted and I called UPS to next day air them back. It is ALL DONE. I HAVE MY LIFE BACK. Thank you board because of you guys and your advice I got through this. I am going to get all the numbers I called and fax numbers together so other people who need help with EMC can start what I started.

First of All. I emailed the Governor in my state. I emailed and called the commisioner of banking in my state. I wrote letters to the Wall Street Journal. I emailed ABC News, CBS. I put together an expence report and a hardship letter. I also sent a QWR letter too. I faxed JP Morgan and EMC everyday with updates on how my modification was going. Every morning before I would bring my kids to school I was down stairs faxing every morning. I faxed everyone from JP Morgan and everyone from Bear Stearns. I also filed a complaint to the BBB about JP Morgan and Bear Stearns. It took from December of 2007 to April 2008 to make this happen. It is a fight but never ever give up. I also got in touch with Senator Dodd. I emailed and called anyone who would listen.

My Documents came last Friday, I signed sealed and sent them back on there way the same day. They were next day aired back and I got a tracking number and the papers were delivered yesterday at 9:18AM.

I had an issue with EMC back in November. They didnt post my payment on the right date before the 30 days not from my fault but EMC. I threatened legal action and they called back about an hour later and apologized and posted it correctly. You might want to get in their face like I did. Of course it doesnt matter now when they are holding on to my shortsale but at that time it worked!

Hello Everyone,

I received my modification on April 24th with EMC. They still have not updated my account and now I received a 60 day late on my credit report. I called them and they have my payments but they have not updated my account yet. I called today for them to update my account. What do you think I should do? There is nothing wrong with the modification it is all on there part. Any advice?
