ASC Success, What a Mess I've Got Myself Into

I called America's Servicing Co today. First I called the Negotitor of course I had to leave a message. Then I called back at the Loss Mitigation phone number. The agent looked on the computer and said my loan was now current and a payment is not due till 1-1-08. That was good news. But it shows my payment and interest still at $1757.22 at 8.2%. I told her it is suppose to be at $1640.21 and interest at 7.250%.

She said she would send an emal to the Negotitor that the interest rate and payment had not been updated according to the Loan Modification.

My loan balance has been updated to include the two payments for Nov and Dec and my loan account is up to date and a payment is not due till 1-1-08.
As soon as they get the interest rate correct and the payment correct my Loan Modification will be complete.

Then I can have my story moved to the Successful Loan Modification section.

So I just have to wait till 1-1-08 and make my new payment.

I know I am over $60,000 upside down due to them overappraising my home but at least I can stay a while. Later if my husband and I decide to use are VA entitlement we can after we get out credit back on track.

Bellieve it or not the Agent from America's Servicing Co called me back this morning. She said she had received an email back from my negotior and she had changed the interest rate in the computer to 7.250% and the payment to $1640. 27 what it should be. The first payment is set up for 1-1-08.

I feel so much better now that everything is listed in the computer correct.

That's great news Evelyn. You are most definitely a success story. You have fought this for several months now and you have had a successful outcome that you can live with and it works for you. So, it works for me too.

This thread is going to be officially moved to the success section and should be used as an example of what a woman can do when she is driven by will and extreme patience to save her home. Her home, sweet home.

You're a woman of great character and are a great example for all other homeowners to follow.

You were knocked down countless times, but you just kept getting up, brushing off your knees and kept fighting till the 10th round.

I received an official letter from America's Servicing Co today telling me my Loan Modification was official and that I will be receiving a statement in the mail very soon telling me where to mail my payment and to who.

Just so everyone out there knows...I am going through ASC too and experience the same non-responsive service. My home may foreclose any day now and am still waiting to hear back on a loan modification. It is very frustrating now knowing...it is like you are just a number and no one really cares. I feel that I was lied to and decieved by the lenders as well. Now here I am am facing the worst crisis in losing my home and my credit...and as they take their time losing paperwork each day...I owe more and each month...my credit drops! At first...I was trying to short sale the home and worked with an invester for months who supposably had the same issues trying to work with ASC that they just gave up. Now...several months later...I may be foreclosed on any day now! This new bill that was passed is a little too late...as I owe so much in lates and back payments that I do not qualify as this new program only saves those that are current. HELP! I feel that I am at a loss and at the mercy of the lender, that doesn't seem fair. I feel that I have failed. This was/is my first home and I have a little boy, I feel I am sending a negative message to him...mommy was not bright enough to read the fine print or aware enough! Very sad as I know so many of you are in the same boat!

YOU ARE NOT A FAILURE! And I'm sure you're very smart. The best message you can send your little boy is even when things go wrong or bad, you can still keep your head up, make the best of it, and learn from your mistakes. Don't worry about him, he'd love you even if you were swinging from vines in the middle of the jungle. As matter of fact, he'd probably love you more. Boys and jungles you know.

It's very frustrating going through this, I know, I'm dealing with it too, but don't give up hope and lose heart. My heart goes out to you and my prayers are with you this Christmas. I hope that no matter what happens you'll find your place in the world. Things WILL get better. Don't trust me -- Trust yourself!!!

I wish I could give you moreto lift your spirits, I know this is a tough time. Just no someone out here is thinking of you and your family.

Thanks for joining LonSafe.org and sharing your ASC story. One that has you can see, is all too common.

I feel for you and one of the reasons I started this forum and my blog was because of these abuses that are happening out there. Lost paperwork, hung up phones, lost faxes and on and on and on........... IT NEEDS TO STOP AND LENDERS AND SERVICERS NEED TO BE HELD ACCOUNTABLE!

By sharing your story, we expose what ASC is really doing. All these companies can really do is accept money and they have no reasoning and loss mitigation capabilities.

I feel that our governments needs to hold these lenders accountable and MAKE them properly staff and run these departments. Right now it is terrible.

But with that being said, as you can see for Evelyn's story, she did make it and save her home, so it is nit impossible. She worked on it daily for 3 plus months, so there is hope, but you have to keep fighting and not give up.

By no means are you a failure or incompetent. You are the victim of a system that went terribly wrong.

Stay strong for you son and all of us here are thinking of you and please keep us up to date and we will help you in an way we can.

Thank you jacmac and moe for your kind words. I am relying on God to see this through. Thank you for your thoughts and prayers. I will keep you posted. Finally, ASC has responded and have confirmed that my paperwork is in the system now...I must call in each week to double check that this gets in the hands of a negotiator and that it works out in my favor. Time is of the essence because he says if he does not have everything he needs they just kick it back and have to start at square one. Yes, these lenders must be held accountable! Who must we contact or cut and paste these threads to congress or whom? I dunno anymore. Sometimes, you wonder if they are on our side. But, I will keep my head held high and leave it in God's hands. I will be deligent in calling and logging everything with them...even getting the name of the person I spoke to! Thanks again for your kind words! Can someone modify my title. It says Ameriquest Success. It needs to say
America's Servicing Co Success. (I did have one loan with Ameriquest but that was paid off).

The loan I got a Loan Modification with was with America's Servicing Co.
Can you please correct the title for me.

I think it is important to have ASC (America's Service Co) show in title, as they are hard to get a Loan Modification approved with.

what do you guys suggests i do???? for all those who have gone through successfully with this mortgage company when you guys when through with your modification did you guys get both loans (for those who had 80/20 like me) successfully modified....and how did you guys approached this????

also on your letters how come it doesn't state the word "fixed" but the manager and reps tell you verbally that the rate is fixed....is it okay to sign??? if not, and i call what should i say on this matter????
