AHMSI SUCCESS With Help From LoanSafe

I happened to run across this site while I was looking for help and I see so many people that have been helped. I need some of that Help too.
I am in chapter 13 bankruptcy. I have an ARM that can reset every six months. I requested a modification with AHMSI in Oct. '08. After calling and calling, I was finally given the name and extension of my negotiator, Walter in December. He would rarely answer calls and I was given the run around until about the end of Jan. He eventually got a modification showing 5.89 and sent it to me. I sent it to the trustee who agreed and then faxed the paper work back to Walter. After faxing the paper work, I called him to verify that he received it. At that point, he told me that the terms were not fixed and he could not accept the trustee's info and that I would need to ask them to approve another ARM. About a week later, he faxed the paper work showing an ARM to the trustee which was not approved. They are only approving fixed rates. I have been on your site and contacted Jeanne on yesterday. I am at my wits end. Is it unreasonable to request a fixed rate? He told me that he couldn't do it because I was in bankruptcy. PLEASE give me any advise you can

Welcome to the forum and thank you for joining...............

The modification given is going to be up to the investor on your loan and what they are willing to do as far as fixing the rate..............
You will need to see if Jeanne's office is able to work with you because of the bk..............if they are they will let you know what they will need you to send in at that time......

Is it possible to personally contact the investor? I am still waiting to hear from Jeanne's office and would like to have options.

Might want to see if you BK attorney can slow down your final discharge,etc in the event some watered down version of HR 1106 passes the senate soon that may help you.If you get sick or have a family emergency, hearings can be reasonably delayed.

I feel a little better. Today I was contacted by original negotiator and was offered a fixed rate. Still didn't get all of the details. I just hope that it will be approved by the trustee. I pray that this will be taken care of by next week.

Great news!!!! We have been able to get a modification. I spoke with my negotiator today and he is sending the papers to us. We should have them in the next five days. We went from an arm 9.75%-15.75% to a fix rate of 5% that will adjust upward to 7% over the next to years and remain fixed. I never would have been able to get this done without this forum. We were told by the negotiator that he couldn't do anything else, but hen I called Jeanne's office they were really able to help us. Don't give up! Hang in there. I'll update again when I get the paperwork in my hands.

We received the mod papers and have sent them back. We were initially told that we didn't have to send any money, but when the papers arrived we did have to contribute $1352, but at least it is done. I can't say thank you enough for this forum. It was the difference between my family being ******** and being in our safe home. You are doing a great work. Be Blessed.
