    Exclamation Don't Just Sit There - File A Complaint!!

    So you're Mortgage Broker screwed you royally and you are :

    P I S S E D OFF! ! !

    WELL I DON'T BLAME YOU!

    What are you going to do about it?


    FILE A COMPLAINT:

    Here in New York mortgage brokers are governed by the New York State Banking Department. But in my dealings with them, I filed a complaint and basically the broker said, Oh, no, she's lying. Here's my fraudulant document that I made to prove that she knew about my outrageous Yield Spread Premium, the terms of the loans and the prepayment penalty and the Senior Bank Official at the Banking Department said, "Okay" -- basically, I don't think they WANT to enforce their rules.

    So I went further. Here in New York the Governor formed the Halt Task Force:

    What is it?

    The interagency HALT Task Force was formed by Governor Eliot Spitzer in early 2007 to address the issue of predatory lending in New York State.

    The task force is charged with: exploring regulatory reform; pursuing enforcement; creating statewide outreach and educational opportunities; and developing loan and refinance programs.

    This is a newly formed Agency -- there may be one in your state, too. Do an internet search to find out.

    You can file a complaint with these organizations if you live in New York but remember, if you're not in New York, you can do an internet search for the equivalent governmental bodies in YOUR STATE and file complaints with them.

    What if the lender already went 'belly up' and declared bankruptcy last summer - lender is First Magnus.

    I'm not sure. You might want to follow up with whoever is servicing your loan now, in terms of having them repair the damage that's been done. You might also consider filing complaints against your Mortgage Broker, if you believe they defrauded you.

    I don't think, unless the company filed bankruptcy but emerged again as another company that there's much you can do against them. Maybe someone else can chime in here.

    The majority of First Magnus loans were bought by Countrywide , Wells Fargo, and Washington Mutual......

    Oh, thank you Erika. It's the least I can do. But a lot of other people are helping out, too. The list of the phone numbers for the Banks, I think Tom put something up (I can't remember his handle here) so we're all helping each other, and that's what makes this a very special place!

    First Magness did the majority of their loans as Agency loans, very little Alt -A until late in the game. Check your loan, if it is a fixed rate with First Magness, probably Agency - FNMA/FHLMC or FHA/VA. If it is an ARM....Country Wide, Aurora, Chase, and EMC. They were a client site for me at one time.

    I copied your list to add to my list of places I need to contact. I thought this Federal Reserve list was one along with some of their links a bit more specific to individual needs.

    The Federal Reserve : If your bank is controlled by the Fed Res.
    the following links will be helpful.

    They have a new consumer line to call (below), and accept complaints via the email address below. Any additional documents should be sent to the Minneapolis address, no matter by which Bank your respective bank is covered, this address is the receiver who send on to the appropriate Federal Reserve Bank. It is there that they assign your complaint to an examiner. Include any review. Also any and all documents. They say you can't send too much information. They want it all.

    I found out about this a little too late. They take about 60 days to examine your file. I don't have 60 days. My lender Popular is trying to foreclose on me now. I will be sending my complaint anyway. I want to see that the involved parties are reported to the appropriate authorities. And they will take action if they find federal crime.

    I have wondered if I could file a complaint against the lender because I didn't receive a good faith estimate until the day we were supposed to close and that was only because I needed to know how much to bring to closing. Additionally, I was not aware of the PMI attached to my loan until i saw it listed there which was $232 a month!! i almost died and didn't realize i could have backed out of that loan.

    I was wondering if we could file a complaint. None of our copies have signatures on them. We also never received the sheet that tells us where our money went to. Do we have a valid complaint? Our papers were also not notorized in front of us.

    You don't receive copies with signatures at the closing.......the only thing that has a signature on it is the HUD, and Buyer Settlement Statment........the rest do not have any signatures.....
    when you say that you didn't receive the paper that says where your money went to.........do you mean the HUD?

    A notary not being there who has to witness your signature and is signing to that fact is a violation.......

    Where was the closing at?....ie.....Title Company, Brokers office.......

    In order to find any and all violations of RESPA and TILA you would need a doc review which is offered on this site on the left side of the forum......

    Cat we signed papers at the brokers office but no notary either.. the copies of hud and buyer's settlement we have no signatures.. For us we have someone elses' bank account and asset..Is this legal?

    If you both feel that you have violations of RESPA and TILA from your closing you need to consult with an attorney..........
    I am not an attorney.........so I would not be able to tell you what is or isn't legal in your states and how closings are conducted in them..........

    We do offer the Loan Document Reviews here on Loan Safe if you feel that your loan was predatory in nature.....

    I was too! Me too, no Notary..! and I think the RE lady was actaully a Broker I KNOW because I am BROKE-ER! and she lied about alot! Please where do I call to find out? I want to report her to Real Estate Board, I want a Atty. I need to do this fo r my sanity.. as I sit here and Possibly do my last 300 days
    Once I search ALL my Options!

    There are multiple ways to register a complaint about your mortgage servicer or to report fraudulent activity. Here are several ways you can file a complaint below:

    - File a complaint regarding your servicer with the federal Consumer Financial Protection Bureau: https://help.consumerfinance.gov/app/mortgage/ask

    - Report a scam to the federal Financial Fraud Enforcement Task Force: StopFraud.gov - Report Fraud

    - File a complaint with the Federal Trade Commission.
