FF/HLS Mortgage Modification

So to make a long story short. I have been TRYING to work with First Franklin/Home Loan Services for 6 months now. I notified with my change in income one month before I knew it was going to change. I have been using the HOPE people to help out (who have been great).

JUST LAST MONTH around the 20th of December, I get a call from HLS who says he is able to actually get a modification done. He reviews some numbers with me and tell me I need to get a payment in NOW to make sure I don't fall one more month behind and they would have to do a pre-modification if I fell one more month behind.

I was a little concerned about his explanation and his lack of wanting to document the reason for the payment. I trusted him and sent a Cashiers Check next day FED-EX to the payment processing.

I got the payment back on January 6th saying the could not accept the payment since it was not the full default amount and that I was in foreclosure.

I contacted him and told him that they would not accept the payment since the foreclosure was filed. He said, yes it was filed on Dec 6th. I guess we have to do a pre-modification he told me.

I was very concerned asking him WHY does he not know the status of my account and his agreement on the phone constituted a verbal agreement to accept payment during a foreclosure proceeding to stop the foreclosure for the modification to take affect.

They don't care what they say or what is legal or required under the law.

He sent me a pre-modification that is MORE than the actual money payment right now. Then he told me the modfication would be around $218 less a month than the current payments.

I told him thanks but this does not HELP me and will not let me keep my house. I need, for a short term, something that has a little more discount. He tells me that is best he can do.

I try to contact his supervisor and they dont really let people contact the supervisors. I finally got a hold of one after the rep form the HOPE line really let them know that they have to let us talk to a supervisor. She told me the most they ever do for people is bring them $200 month positive and that is all. That is what they have done and they wont do anymore.

She gave me the sad story of the investors and guidelines (which they dont let you see) not wanting to do anything more.

I just wanted to share what FF/HLS has told me on modifications after working for them for MONTHS! They could have just told me from day one what the deal is. It would have saved them money and myself.

Funny thing is, they are willing to do a short sale and lose 200k BUT not any type of interest rate reduction or principle reduction for the home owners even in short term solution to make it work out.

I guess my final solution is BK 13 and they can lose the whole 2nd (100k) and I can keep the house. I have some other technical violations I am thinking about that would stop the foreclosure but if they are not willing to negotiate any in reasonable manner they dont leave me many options.

I really dont understand the relutance to make a better modification for people. They would rather foreclose than make it work out. Nice people.
