Hardship Letter Hello, I posted this a few days ago but it started out wrong and I asked the moderator to remove my original post. I'm self employed and looking for any others who may have had a successful modification themselves being self employed. Also, any contact information would be greatly appreciated. Any advice on my hardship letter would be greatly appreciated. Name: Address: Lender Name: Loan #: To Whom It May Concern: This letter is to explain my unfortunate set of circumstances that have caused us to become delinquent on our mortgage. We have done everything in our power to make ends meet but unfortunately we fell short for a time. We are requesting that you consider working with us to modify our loan in a manner that would allow us to resume payments. The circumstances that have led to us being behind are a combination of: a) reduced income, b) medical bills, c) damage to our home d) my wife being involved in an auto accident to which she was at fault. All of these events/circumstances occurred within the past three months. The greatest of these factors that caused us to be late is the reduction of income. I have been successfully self employed in the custom woodwork and fabrication business for seven years. However, from the second half of October 2008 to the end of December 2008, work slowed to almost nothing. Then several accounts receivable became delinquent and all my efforts to collect fell through. Much of my work is tied to the construction industry, which is in a downward spiral in my area so getting new contracts became extremely difficult. In early December we had some medical bills because my wife had to receive emergency medical attention for a burst cyst in her abdomen. Due to the fact that we are uninsured, this set us back even further. To add to this our furnace quit working in November. This we have yet to fix as we are trying to get the company that installed our furnace to take responsibility. So, we've been using electric space heaters to heat our home. Then on the first of January my wife got in a minor auto accident that set us back even further due to the insurance deductible. Despite the setbacks mentioned above our situation has begun to improve dramatically. We have worked very hard to increase work through new products and cut unnecessary costs. My wife has begun working with me in my business to help generate more income. I have been able to secure some contracts and collect payment from some of my clients who were past due. Our situation has improved to the point where we are now in a position to resume payments. However, work is definitely much slower than before so to make up the past due amount is not possible at this time and looking at our budget it would greatly help to have the payment or principle reduced to reflect current interest rates. We have worked our budget to only included the bare necessities. We've dropped our home telephone. slashed costs to bare minimum in every area. Under our current terms our Principle and Interest payment is $2,004.17, with a escrow amount of 210.73 for a total of $2,214.90, which, up till the time of the economic hardships mentioned above, has been completely affordable by our family with respect to our income and secondary credit obligations. However, with the recent economic downturn my intent is to either have our interest rate lowered, have a maturity date extension, a forbearance on payments or a combination of afore mentioned. We will do whatever it takes to work out an arrangement that works for both of us so that we may keep our home and fulfill our obligations. I have spoken with several Realtors in my area and home values in my city have declined 19.2% over the last year. This can be confirmed at We greatly appreciate the opportunity to bring our payments current. I built this home from the ground up so I am very much attached to it and would like to do whatever I can to keep my home. We would appreciate if you can work with us to adjust our payment to a slightly more affordable level so we can keep our home and afford to make amends with your firm. Thank you for reposting the letter... It is good..........you would need to contact GMAC to find out what else they would need you to fax in..............the modification is going to be up to the investor on the loan............so call and see what options the investor has. For self employed you will need to ask what they will accept.........it is usually tax returns, bank statements, and a P & L........ GMAC Loss Mitigation 1-800-850-4622 ext. 2362609

Let me know if you have anything that might help me as well. Thanks in advance! January 10, 2009 12:49 pm: Called HOPE. Said an agent will call back. Agent never called back. January 12, 2009 10:30 am: Called HOPE again and spoke with Edward 866-520-0922 extension 280. Said he thought I was an excellent candidate for loan modification and thought that I should pursue the Streamlined Modification Program and that I could possibly get my loan reduced to 38% of my monthly income. He said he thought this was possible through a variety of methods including. He mentioned, forgiving the past due payments, interest rate reduction, principle reduction or perhaps others. He said my budget looked in order. January 12, 2009 10:55 am: Called GMAC Loss Mitigation at 800-850-4622 and was on hold for 18 minutes and got disconnected. January 12, 2009 11:11 am: called GMAC Loss Mitigation back at 800-850-4622. On phone for an hour. Finally got a gentleman who said that my loan was through Fannie Mae. He took some information. He said he'd need to transfer me. Forty Five minutes being transferred all over the place. Got hold of Ann in the Specialized Collections Department. She said account is scheduled to go into foreclosure on the 17th of January so I must call in and make a payment by that time or at the very least set up a post dated payment no later than the 26th of January. She told me to call back on the 17th to 800-799-9250, or 800-850-4632. She said both numbers are for the Specialized Collections Department. She said by doing this it will buy time . . . but she also said that the mitigation would put this process on hold for a month. Which is true? She said I looked good for a modification so she'd submit everything to the necessary department. Oh, also, she said I didn't need to send in my hardship letter as she asked me for the information over the phone. This sounds really weird to me. Anyone else experience this? |

I never had to deal with a department called 'Specialized collections". When I first contacted them I was transferred straight to loss mit. May be in your case it's because you are so close to foreclosure? Call the loss mitigation number posted on this site again. Make sure you are talking to loss mit. |

Your dealings so far with GMAC are pretty much the same as all of us with loans through GMAC. I didn't find out until 1/9-/09 that my investor was Freddie Mac (this after calling and ASKING many times who the investor was since 10/08 The different "help" will range greatly from no we don't need anything from you we can get it all over the phone - to we'll send out a package fill it in and send back. I have heard - no you can't have a loan mod because you don't have an adjustable to - send in a regular payment PLUS $100 and we'll get a loan mod for you. I am now 4 months behind and gone through every agency known to man FINALLY 1/9/09 I was told by loss mit in IA that info had been sent to FREDDIE MAC it takes 6-10 weeks from that date (I had been told 7-14 days) and only be concerned about the FEDEX pack from them - not any other standard letters of default. That was my concern that I would come home and find the locks changed or something! Hang in there and keep calling - never give up! |

Hardship Letter I went from speaking to some rude nuts lady about 1 month ago telling me that I was rejected telli ng me my wife would eventually find another job and there are others who need more help than me blah blah blah to......receiving a loan mod offer out of the blue on my doorstep. You know what I think did it? Pestering the heck out them! Emails, calls, voice mails and finally contacting the top brass. Mr Jaberi. Try emailing him. However, I did read a post someone saying he no longer works there? Can anyone confirm??? |

I contacted HOPE and the representative (named in an earlier post) told me to keep talking to them myself as well. Did your HOPE rep tell you this as well? Anyone have names and number to people they talked with? emails? I think I'm going to have to add minutes to my cell phone plan this month! Thank you all so much for your help. Hardship Letter Yep - told by the loss mit sector and followed up by calling HOPE (I don't BELIEVE anything anymore) and was told that info was sent to Freddie Mac and in certain cases it is taking 6-8 weeks to get a reply. I know you're in SoCal so your somewhere close to me - I'm in N San Diego county - don't know why the difference - you're Fannie and I'm Freddie?? Would that have anything to do with? Not sure. Oh and RUDE!! Most were pretty friendly - maybe not the most informed on the situation but a few - let me tell ya if I could have drug them throught the phone I would have! But kept my nice sweet lady attitude while grinding my teeth! Congrats again on your loan mod. I think that when this is all said and done I want to throw the biggest down home BBQ and all who have made it through are INVITED!! BYOB LOL! |
