Provident Funding -foreclosure sale 1/29/08-HELP!

What can I do to save my home???
We were 1 month behind on payments. Our dog had to have a major emergency surgery and we ended up being another month late. We were going to pay a payment at 62 days and Provident Funding said they wouldn't accept it. They said we should do a loan modification. We applied for that, and it took months to go through. Our rep there said not to worry because he was 100% sure we'd get approved because our income, etc looked great. Then it came back as denied last Friday!
So on friday the rep said that nothing had been filed yet and that our foreclosure sale date wouldn't be until March. Then that SAME day, we get a letter saying that we have a foreclosure SALE date on the 29th of this month!!! I have been scrambling all week trying to figure out what to do. The loan is in my roommate's name but we are both on the title. I have just been trying to get a new loan in my name, but my middle credit score is 580. We have $100K in equity in our historic home! But no one will work with me and this mitigation company sounds like they might be able to help.

Yes they said that we were denied because when we applied for the loan modifiation, they said their "audit team" looked back at our original loan documents & they said that we "mis-stated our income". This is not anything we would have ever done on purpose!!! We submitted our paycheck stubs, W2's, etc. to our mortgage broker. He gave us the option of having both of our names on the loan at 7.25% interest or to just have my roommate's name on the loan at 7.0% (because of my credit). We chose just to do the 7% and have only her name on the loan. But apparently the broker put BOTH of our incomes on the loan combined. He submitted a stated income for her at 6333 a month...which is our combined income...not just hers. So Provident said that "we lied to them" and that they wouldn't have given her the loan in the first place so there is no way that they would do any type of assistance package!!

Welcome to the forum and thank you for joining..............

The modifications given are up to the investor on the loan and a loss mitigation company will still be going through Provident on your loan..........so if they are telling you that they can do any different, they can't............they just want to take your money and the end resut is going to be the same.

What you may want to try is NACA and see if they will be able to help you..........they are a non profit that will work on a modification proposal and negotiate with the investor on your loan.............they have their own programs that the work up and their services are free..........

Thanks for the info ***. So what about the law office that is listed on this site "Law Offices of Griswold & Agdeppa"? They charge $3000 but it is worth it to save the house. The NACA makes you become a member...and I don't mind paying the fee or anything but it says that you have to go to a class & I don't have time to before my sale date.

You do not have to become a member to do the home save program which I provided the llink for...........there are no guarantees either way.......so that would have to be your decision on whether to hire the attorney or use the non profit.......but you have options from which to choose.
