Please, i need some advice (hsbc loan)

Please any one help or advice

In 2005 I lost a business and filed for bankruptcy. For some reason my lawyer did not tell me anything about requesting a re-affirmation with my Mortgage company (HSBC), so since the bankruptcy was completed I been making (what they call)voluntary payments on my mortgage.

I being paying my mortgage every two wks for the past 4 yrs. But he months of Oct - Dec 2008 I was only working one or two wks of each month due to layoff. Due to this fact I got behind on my monthly balance because I was not making full payments every two wks.
HSBC never contacted me, and today when I was going to make a payment, they told me that my mortgage was in a forclosure review and they will not accepted my payment. I asked the lady I they can make some kind of arrangement, she said not because I never rerquested a re-affirmation during the bankruptcy procedures.

Imaging what when thru my mind when she told me that, by the way I have not told my wife yet.

Please I need some advice soon.

Welcome to the forum and thank you for joining..............

For the answer to this you would need to go back to your BK attorney and have them go over your file to see how the property was listed in the bk..............and also ask the attorney what you should do at this point with the property going to foreclosure because it would seem that HSBC is not willing to talk with you.............but they may talk with the attorney.

Hi ***,

I contacted my bkr lawyer like you sugested, but the guy asked me for another $3,000 to file for a chapter 13. I told him thank you I don't need your help.
He said he never do mortgage re-afirmation for his clients when he file for bkr, because is better for them (the clients) to walk away is something goes wrong.

Do you think I should contact my mortgage loan originator office to see if they can modify my loan from a 20 yr to a 30 yr?

You would need to see what the options are from the investor on your loan................it had sounded as though you had already asked and they were not very helpful....................

Call
HSBC Default Resolution
1-888-648-3124

and see what options for modification there are.........
