What to do?

Hi everyone this is my very first post...well, here goes...The auction date for my home is today 12/30/2008. I tried working with my lender Citi Residential to get a loan modification, but was told we didn't qualify. So I tried to refinance the loan with Bank of America and was approved for the refi...but was upside down on mortgage...tried to do a short refi but was denied. Then the next day a Mr. Steve Gilson called me to tell me that the auction date had been canceled and we could try to work something out. My husband and I talked with a credit counselor and an attorney...the both said if I couldn't get it in writing that the auction had been canceled,move to another time that we should file Chapter 13 bankruptcy. So I called Mr. Gilson back to see if he could send written confirmation , he told me that he could not. So with that we filed Dec 24th. I'm sure that Mr. Gilson was truthful, but we were terrified of loosing our home with no paperwork to back it up. My question is can we still try to follow through with a modification even though we filled bankruptcy? We received a letter from Chase saying that Citi sold us to them.

Hi vaytee,

Welcome to the forum and thank you for joining...........

If your loan was sold to Chase, you would need to wait until the file gets transferred to them and ask Chase what they require you to do if you want to apply for a modification. They may need permission from the court and your attorney in order to speak with you...........as soon as you get the letter with the contact info for Chase, call and ask what is needed to go through the process while in a Chapter 13 bk.
