In between two loan servicers

here is our situation- looking for some advice/help.
we were with another mortgage company and reached a stipulation agreement we thought was good for us. After paying 8k to get set up the first month we had to continue the payments we agreed aupon we received a letter telling us we had to pay agrrement plus anothe $700 per month on top of agrrement as our loan adjusted from 7% to 10%. They said they had the right- we could not pay new amount and we were trying to work something else out. now hous is scheduled to go to auction in December- now we find out loan has been sold to Litton loan- now what- is there a way to cancel auction to work something out with litton- already tried to call them but they d not even have our files yet- also have been reading horror stories about Litton- hope they are not all true. Has Litton changed there tune since being bought by goldmans sach ?
HELP

Hi titantic,

Welcome to the forum and thank you for joining.............

The modifications given are up to the investor on your loan.........when the servicer has changed, the investor might not have........so you would need to check with Litton as soon as they get your loan and see if the investor on your loan has other options for you......

okay but the law firm who works for the former service said they wil not stop auction unless old servicer agrees- what now-

popular mortgage who I am told has sold to Litton- and according to their attorney is folding their tent and going out of business- he is just worried about getting his legal worke paid for from popular- he could careless about our home at this point.... any advice...

we are desparate- auction right before christmas- If we can restructure to affordable loan we can make payments- otherwise we will be out on the street...

I have called litton- not sure who I spoke with but they seemed friendly but told me that they will not get the files from popular until November 1st plus or minus a week and a work out takes 90 days- we do not have ninety days- auction is december 3rd- she suggested I look now for a place to rent- not mean like but more with a realistic outlook- I am now like Jimmy Stewart in it's a wonderful life- If my life insurance would pay out I might like to check out for the sake of my family- Christmas this year was already going to be hard on my three kids. It' really was a wonderful life-

Well............the executive team would be able to put a foreclosure sale date off while you are working on a modification if you get pre qualified for one and if the investor on your loan is doing modifications.........
and that office doesn't take 90 days to escalate a modification.........

In between two loan servicers

Looking for help.
First does anyone have an example of a form to petition the court to delay an forclosure sale- Is this even possible- issue is I am in between two servicers- popular says they transfered to litton- litton says they have assigned a loan number but do not actually have the loan yet- will not get until 10th or so- auction scheduled for december 3rd- Kind of feel that popular screwed up on stipulation and trying to make it just go away- by auctioning off our house- Litton says they will look at it to see what they can do but cannot do anything until they get all documents- popular, their law firm have all washed their hands at this point- I sense a delay tactic- originally told november 1st it would ll be sent to litton now told 10th or later... at that point may not be possible to delay auction or work something out- litton says the need 90 days.... help, ideas- I called litton and they said until they actually get all loan information they cannot do anything...can I submit a petition to the court ?

You would need to ask a real estate foreclosure attorney familiar with the foreclosure laws in your state that question...........we do not have legal documents on the forum........you might also want to try googling the form that you need.............
