    My Servicer is sending my file to Attorney to begin forclosure

    I owe July, August and now September mortgage payments. My servicer Statebridge informed me today that my file is ready to be sent to the attorney to begin foreclosure. I live in California and not quite sure what the process is. I've tried repeatedly and begged Statebridge to modify our loan and to no avail. We had a death in the family (funeral costs) and my husband is also disabled and we have medical bills for him and our two boys. Statebridge will not modify our home loan. Does anyone know that the process is from here. I owe 5490.00 for missed payment and will not have the money until the end of October. Does anyone know what the process is in California and if I can still pay and keep my home?

    Any information would be great.

    I'm very sorry to hear about the death in your family and all the hardships you are facing. Although I'm not familiar with Statebridge and do not believe they participate in the government's making home Affordable Programs, on their website it states they do offer this type of assistance and almost every servicer has their own in-house loan mod programs. Here in CA the foreclosure process is generally taking at least 8-12 months before a foreclosure date is scheduled. Have you received a a "Notice of Intent to Accelerate?" If not I would not be worried about foreclosure proceedings occurring anytime soon. Keep in mind that they most likely will not accept any payment from you unless it is for the entire past due amount along with any late fees they have tacked on to the account. If you make a single payment or a portion of the past due amount those funds will just be held in a suspense account until the dues are satisfied.

    Hello Evan, Thank you for responding and providing me with the information. Yes, the NOI letter was sent on July 16 and has a date of August 20th to pay the past due in full. They also initially sent me a modification package for me to complete and return however the financial form was ruined when I accidentally spilled coffee on it and asked if they could send me another form and they're refusing to send it because they claim they are going to deny the modification request. I'm not sure why my rep is being so difficult and not trying to help. She continues to threaten that in addition I'll have attorney fees and will have to pay those as well. My rep isn't helpful and told me that maybe I should think about a short sale but that the bank may or may not approve. I am aware of a new bill going into effect in October in the state of California and not sure if this is the reason for them being so difficult. Once again, thank you for your help.

    Wow I cannot believe they sent you an NOI the first month you missed a payment on the account and the way this rep is treating you is just plain wrong. I would definitely suggest next time you contact them to request to have your account reassigned to another rep who will actually be willing to assist you with the modification. Without reviewing your account there is no way she can determine whether or not you may qualify for a mod. If you cannot get a hold of anyone at Statebridge who can assist you, you may want to contact HUD and have one of their counselors send you the loan mod application for you to fill out and also contact Statebridge for you to get things going.

    Does anyone know if I'll be okay if I pay at the end of October

    Hi, I posted earlier this week and just have a question or seeking information.

    I'm currently behind three months on my mortgage (due to a family death and funeral costs) and fell behind on my mortgage. My servicer Statebridge has my June payment in a suspense account and has threatened to foreclose on my home if I don't pay all payment/fees. I'll have the entire past due amount + Sept, Oct (payments) by the end of October but wondering if this will be too late to save our home. Can anyone tell me if they have been able to avoid foreclosure or am I going to loose my home? I can't sleep/eat and biting my nails. Any information would be helpful. Thanks~

    As of yesterday my servicer (Statebridge) announced on their website that they're now participating in the HAMP program. I called the HOPE number and was told that I qualify from the information that I provided over the phone. However, we're not sure if my investor is participating. My investor is BONY. We called the services but my rep wasn't available we left a voice message. I'm waiting for a call back from my servicer and keeping my fingers crossed.

    I just spoke to my REP and she stated that my investor isn't participating in the HAMP program. I'm submitting my paperwork for an inhouse modification and keep my fingers crossed that they approve me. Thanks you!

    I would call back tomorrow and ask who the investor of your mortgage is. The rep you spoke with could have been mistaken and you always want to verify with multiple reps to ensure you are not denied for mistakes on their behalf.

    Thank you Evan for responding. My investor is Bank of New York Mellon. I spoke to HAMP late this evening and they advised me to call the servicer and ask for "loss mitigation" department. I plan on contacting Statebridge first thing tomorrow morning.
