I do not believe this prohibits the bank from proceeding with foreclosure if you are currently in review for a loan modification. This has been a problem for years now and thousands of homeowner have bee foreclosed on in the process, California has just recently announced the "CA Homeowner Bill of Rights" and is finally prohibiting the lenders "dual tracking system" in which they will be reviewing ones account for a loan modification while at the same time continuing with foreclosure proceedings and setting up a sale date.
