    AHMSI, Wells Fargo, Deutsche Bank PSA Waiver

    I am currently fighting AHMSI and the sole reason for my denial for modification is a single paragraph in in a 1000 page document. I am looking to hear from anyone that has been fighting to save their home from AHMSI. I feel if we can organize ourselves we will be much stronger in our fight to save our homes. Also if any one is working with Wells Fargo (master servicer) and Deutsche Bank (investor). Please dont waiste time if you have info lets share now as I am down to the last days to fight.

    We have a lot of members here like yourself currently pursuing a loan modification with both AHMSI and Wells Fargo. Here check out the links below we have a section for both these mortgage servicers.. What was the reason why you were turned down for the mod?

    I've been desperately trying to find anyone in the same situation with AHMSI and Deutsche Bank. We've been trying to get our mortgage modified for the past year and a half. Each of the last 4 times, AHMSI tells us that we're perfect candidates to have our mortgage modified and then the same answer is returned...
    We were told that OUR contract has a "non-capitalisation clause" in it which prohibits the mortgage from being modified a 2nd time. We were stuck in of those ARMs that went crazy in 2006/2007, and as it was adding thousands to our principal every month....AHMSI modified THAT mortgage back in 2008 into a 30 yr fixed as we had to then **** down a new $3200/month mortgage payment....more than doubling our monthly payment.

    As it turns out WE don't have a contract that has a "non-capitalisation clause", AHMSI has a contract between themselves and the owner of the loan, Deutsche Bank. Their contract puts a restriction on modifying the mortgage a second time.

    We finally decided to stop paying our mortgage to force AHMSI's hand, but it appears to have not changed anything. Although they recently contacted me, asking me to submit all new paperwork AGAIN (this would be round 5) because we SHOULD be perfect candidates to have our mortgage modified!

    I'm anxious to see if anyone else has ever heard of this clause (I can't find it anywhere on the Internet) or if anyone else has found a solution.
