    Countrywide is trying to kill me

    I am a little nervous, as thi sis my first time posting....here is my story. Due to my 3 year engagement ending in Jan 08 and me assuming by ex-fiance's portion of the bills which included an additional car note(I have since returned the vehicle to the bank). I missed my first house payment in March 08. I called Countrywide ath the beginning of April and was put on a repayment plan which increased my monthly payment from $973.06 a month to $1157.50. I though that we had agreeded that the due date for each month would be the 17th(when the funds are guarnteed), only to find out someone incorrectly made it the 10th. This was a problem since they don't have a grace period. Needless to say, the first month is was due I couldn't make the payment on the 10th, so when I made the payment on April 17th, I was given a new repayment plan of $1148.50 and received a notice the next payment was due on June 17, 2008. I mailed my June 17th payment off on June 12, 2008(5 days in advance) trying to ensure I was not late. On June 17th I called to see if my payment had been received and posted, only to find out that it hadn't been. I then spoke with a "Customer Service Rep" at Countrywide who took another payment for June over the phone and advised me to stop payment on the other check that had been mailed because they had no way to stop it from being put through for payment and if it was returned, I would be charged a $35 fee. Immediately after, I contacted my bank and stopped payment on the check. Well my bank inadvertenly stopped payment on that check and the check payment made over the phone because they were for the same exact amount. and to therecomouter it seemed as if the same caheck coud have possibly been put through as a draft. Just my luck, on June 19, 2008 the check that had been orignally mailed on June 12, 2008 had been received and deposited for payment. After learning this, I went to my bank and obtained a letter stating what happened and faxed it to them. Around June 25, 2008, I received a letter telling me my payment had been returned and advsied me to send another payment(1148.50) immediately, I did so along with another copy of the explanation letter from the bank. I then calledCountrywide later that day and was assured that my repayment plan would not be cancelled due to the circumstances and that my account had been thoroughly. Low and behold, a couple of days letter I receive a notice in the mail stating my repayment plan was cancelled. On July 1, 2008 I then contatced Countrywide to explain my situation and informed them that they had received my payment for this month on June 30, 2008 and asked for that repayment plan to be reinstutied. I was then told that I would need to be put on another repayment plan. I then explained to her that I could not afford any more increases to my monthly payment. She then took my financial information and told me that I pre-qualified for a loan modification and my case would be assigned to a loan negoiator for review.I would call and check the status of my case once a week and was told that I would be contacted by July 23,2008. After not hearing anything, I continued to call my assigned negoiator and the customer service dept.

    To summarize my story after waiting for approval, I am now 4 months behind. I have never received any documentation telling me that why I did not qualify for a loan modification. After calling and calling on August 4, 2008, my loan negoiator told me(over the phone) that I did not qualify because of my income. She then told me to call and see if I requalifed for a repayment plan. Well then called the customer service dept. they told me that I did not qualify for a repayment plan because I could not afford it. At this point, I became frantic and began to panic. After talking to a couple of different customer servic reps., I finally reached one with a heart. She and I went over my financial information and determined that my surplus is about $300 per month. She told me that the computer was showing I only qualified for a loan modification and my case would be referred to another loan negoiator for review. On Monday, August 11, 2008, I went on Countrywide's website and saw that my second request for a loan modification had been denied and regular collection activity would be resuming on m account. I then called Countrywide the next day and was told that my case had be referred to the Heart team for fast track service of my loan. Since learning this, I have called the Heart Dept and they don't have my case yet. They tell me that Countrywide sends out the documents Fed Ex and then they explain the paperwokrk to the clients and I souldn't call them until I receive the package. Hearing this numerous times, I continue to call Countrywide's Loan Servicing Dept on a daily basis to check the stauts of my loan. All the reps tell me that I am in default for 4 months of payments and my Notice of Intent expired on July 18, 2008. But then in the same breathe, they tell me that my loan has been referred to the Heart Dept. and I should be receiving documents via Fed Ex within 10 busisness days from August 11, 2008(but may take longer because the progam is in high demand). With all this being said, I am wondering the following:

    1. How long does it take for foreclosure in Ohio?

    2. Since I have been referred to the Heart Dept. does that mean that I
    qualify for the Home Saver Advance or do I have to worry about
    becoming further behind and having them tell me I don't qualify after
    anxiously waiting?

    3. If I make this months payment, will that disrupt the process the Heart
    Dept. is currently working on? It is my understanding that they are
    going to offer me a Home Saver Advance which deals with specific
    figures regarding the default amount?(per a Countrywide Rep)

    4. If they were trying to see if I was qualified for a loan modfiication(sine
    Jul 1, 2008, doesn't that count for something?

    I welcome any hep or suggestions that anyone has to offer. I don't want to lose my home. My 13 year old son passed away in his bedroom two years ago from terminal cancer and this would be very devastating to myself and my other son who is now 13. Also, can someone give me a number for Tabitha(at Countrywide). I just don't know what to do, it seems like I keep getting the run around all while I'm running out of time. I am so scared I am not doing to get those documents from Fed Ex by the specified.

    1) In answer to your questions here is the Ohio Foreclosure Law timeline.......

    2) For Homesaver Advance if they are sending you the paperwork then you must have qualified. Here is the information on it and there is a contact number for FannieMae who initiated the program.........and here is another number for that program in case it is different from the one you have been calling. These are the numbers that you can use to check on the status of the HomeSaver and see when the paperwork was sent.

    3) Since HomeSaver is a loan on the default amount to catch up the payments, if your figures are already done, all that making the payment will do is to put it in a suspense account, so with the paperwork being sent you might just want to hold it for the moment and use it for your first payment on the program.

    4) The HomeSaver is part of the modification process for loans that are backed by FannieMae and in default, so they have been working on it and 6 weeks is a quick turn around time.

    Thanks for allm the helpful information. I have been calling the same number you have listed for the Heart Team almost every day since learning my account was referred to them, only to be repeatedly told that they don't have my account information yet and Countrywide is the party responsible for sending the packages out. However, if I am lucky enough to get someone willing and able to check my account statuts when I call Countrywide at 800-669-6607, they tell me I will receive my documents within 10 business days from Aug. 11 after telling me how many payments I am in default and an Intent Notice expired on July 18, 2008. I will call the Fannie Mae number tomorrow and see if I have any luck. Do you still think I am ok if they are saying my documents should be mailed? I don't want to seem overly paranoid, but I am troubled that my account information varies dependent on who I talk to that particular day.

    Thanks for the support danbailey! Has anyone had any luck receiving their documents in the specified timeframe now that this program has been in existance for a few months???

    You also might be able to check the status of your account online..........they tend to update that a bit quicker..............CW members have been able to do this..............if you have not already done so......check and see if you can too.
