Ok, here's my story in short. I finally rec'd my perm. making homes affordable loan modification after a long painful battle with Bank of America.
On March 30th, I received a loan (in-house) modification which required me to send in a payment right away. I was told that that payment was for my May's payment. I sent in that payment.
On April 19, I received another perm. loan modification with a lower amount...this one was making homes affordable modification
I was able to cancel out the in-house modification and get the lower modification (making homes affordable).
Ok...here's the drama. After signing the perm. making homes affordable modification, I thought everything was going to be good. I started making my new payments...ALL OF THEM...DID NOT MISS ONE PAYMENT.
Today, I got a certified letter from Bank of America. The letter was an intent to Accelerate to Foreclosure!!!! What? How could that be...I JUST GOT MY PERM. MODIFICATION AND MADE EVERY SINGLE PAYMENT ON TIME.
I was on the telephone with Bank of America from 11:30 am to 5:15 pm...Literally! I was switched to other departments about 60 times today!
I was told that I was behind on my payments for two months! How...I made all of my payments and my checks posted to my account, right?
Yes, they did see that but then I was told that my payment went up almost $600. How? I just signed my perm. modification in April...how is that so.
I was also told that I owe late fees???? How is that possible when I was never late.
Then I was told to ignore the "Notice OF INTENT TO ACCELERATE" FORECLOSURE because the computer system made a mistake...I was told that my payments were not being applied to my mortgage...that they were being applied to my escrow. WHAT?
Finally, they manually applied my payments to my mortgage and I am not behind 2 months but I still owe the late fees, and they cannot remove them...What the hell!
Oh, and the system does not show my new modification payment amount...it is showing a monthly payment that is $600 more then what my perm modification papers show. Go Figure!
So the moral to this story is even when you finally get your Perm. "Making Homes Affordable" Modification, YOUR NIGHTMARE IS NOT OVER.
BUT I AM STILL FIGHTING!

Hello and welcome to LoanSafe.org! Thank you for sharing your story and I sincerely apologize for the late reply. My son and I are the main, fulltime question answerers. Most everyone else in this community is here because they are suffering from the same issues as you.
It looks like you've been taken through the loan modification wringer. This is BS and I would not stand for it if I were you. But as you can see from the thousands of stories on the forum, you're pretty much at their mercy. The only way to save yourself is to kick, screen and fight until you get the help you deserve.
You see, this foreclosure crisis is so large and Bank of America is the nations largest mortgage servicer. Since so many mortgages are going bad, they're completely inundated with requests for loan modifications, short sales and deed in lieus. Unfortunately, because there are so many requests, many mistakes will be made. Just like you are experiencing now.
Are you sure you're in a permanent loan modification? Were you ever on a trial loan modification with the making home affordable plan?
Based on what you stated above, you said that you are an inhouse loan modification and they then came back with this new proposal under the gov't plan. But I didn't see you mention any trial loan modification payments.
Just FYI, many homeowners who are put on trial loan modifications are reported late while they are on this plan. This has been the standard since day one. However, many of the same borrowers are fighting to have their credit scores restored in some are winning the battle.
Please feel free to join other discussions here in the community. Once people get to know you as a regular member, then they'll be more helpful and you all can network together. It will definitely help you with the stress that you're going through now.
