Thank you so much for sharing your experience with GMAC. I'm writing to tell you that I too and battling GMAC for a loan modification. Is there any possible way you can email me all your contacts at GMAC so I can begin having further discussions with higher level people other than their Customer Service and Collections department? I am still waiting for a loan modification specialist to call me back, but I'd like to be proactive.

Any help/advice you can give me, I would greatly appreciate it! Your thread has given me hope and perhaps we can team up together.

Looking forward to hearing back from you.

GMAC Modification Attempt

I am just so distraught of what is currently going on with my home situation. Let me start by telling you that I am newly married and have spent my newlywed months pondering on the decisions I made the years prior to meeting my husband.

In May 2006 I bought my house in California for $1.023 million. This was not my first house purchase. I first bought a condo in 2003 with my boyfriend at the time, then we purchased an investment property in early 2004. We broke up in mid 2005 and he bought me out of our investment property and I bought him out of our condo. I decided to move out of my condo to rent it out and then made the decision in 2006 to buy the house I thought I would live in forever. Then and now, this is the place I chose because this is where I want to start a family and raise my future kids.

1 - I bought my house with 10% down and an option ARM loan. You may ask how in the world I got approved all by myself as then, a 29 year old female. Similar to many cases, the loan agent over stated my income. I was advised by my Realtor that I would be able to refinance within one year. In one year's time, the chance of refinancing was extremely slim. My same model across the street sold as a short sale for $900,000. Despite this, I still thought I had a chance to refinance. I spoke to several lenders to see if they would approve me for a fixed loan. Throughout the year I continued to try for the sake of having something more stable for my soon to be husband and I to start our new life together, but I got no where with any of the lenders. A few said there was a possibility, but as soon as they checked comps, their maybe turned into a no. All the while in that year, I paid all my supplemental and assessment tax bills.

2 - I am now even more upside down on my house. Two years later, my same model just sold in late April 2008 for $771,000. Why did I buy in May 2006? As much as I followed real estate because it's always been a passion of mine, I never thought this sort of decline would have happened. My first mortgage payment has also adjusted in May. Before May, I had contacted GMAC several times to request modifying my loan(s). I left several messages for my supposed Asset Manager, but she never returned my calls. I spoke with Customer Service, then the Adjustable Rate Mortgage department and both departments said they would not discuss modifying my loan until I showed default on my mortgage. I have sent copies of my letter to GMAC and Homecomings to 6 different departments/people. My letter indicated that I would not be able to make my new payment in May and it shows the comps in my area since May 2006 (all of which show a decline since I purchased mouse) and I also kindly request a loan modification so I will not have to result in foreclosure or a short sale. I have heard from no one. We cannot afford to pay the new mortgage payment amount and refuse to look at renting a room and getting a 2nd job, etc. until we are at least in a more stable loan program.

3 - I missed my May payment for my 1st and 2nd mortgage and someone from GMAC finally called me back today from their Collections department. I explained my situation (all of which I've indicated above) and he asked me several questions to help determine if I qualify for a loan modification. Either way, he says their modification never involves reducing the principle balance. Based on my information as well as providing them my husband's income, etc. he said he will pass my file along to the Loss Mitigation department and they should be contacting me within 14 days. He would not give me a direct # for that department nor the contact person who would be handling my file. He asked if I'd like to make any payments towards either of my mortgages, but I declined. I told him that I'd much rather wait to see if I can keep my home before giving GMAC anymore of my money. So, I will wait, I guess, but I can't just sit here.

My new market value compared to what my loan balance is for is sickening, but I take ownership for signing for a loan such as the one I did. I do not blame GMAC entirely. I am a grown woman and should have thought things through more, etc. The fact is, there are many people today in my same situation. While waiting for Loss Mitigation to call me back, I would like to be proactive and try to contact the higher ups, etc. What do you think the chances are that I can get them to reduce my principle balance, put me into a 30 year fixed loan and lower interest rate? This is what Chairman Barney of Massachusetts is pushing for, but I don't want to wait to hear the government's response. I know this is a long shot, but this is my wish list and I will not stop asking and pushing for a response from GMAC until they give me a for sure NO as an answer.

Any help/advice anyone can give me would be much appreciated.

Thanks for staying in touch. Your support and concern is much appreciated. Sorry for the delay in getting back to you. I've been emailing and sending mail everyday since we last spoke. My email/mail package included: QWR talking of my experience with GMAC and the attempts I've made in trying to reach someone, etc., market comparables since my loan origination, my ideal loan situation detailed out, and an explanation of how I got to this point.

Finally two people Loss Mitigation left me messages. I returned both their phone calls and someone called me back right away. He was really nice and believed they could help. He went through two different loan modification scenarios and said he would be submitting the proposal to the investors for approval. He is hoping to have this process completed by 6/15/08. So, all I can do now is wait. He did indicate that at this time, GMAC is not offering to reduce principal balances to fair market value, but they are offering lower interest rate when modifying to compensate. So, keep praying for me surreal and wish me luck!

I believe loss mitigation is located at Homecomings in Dallas,TX and that is where Javid Jaberi is located. For all those who have GMAC or trying to reach Homecomings, below is updated contact information. That is Good News!

From my own personal experience, I would not wait for their callback, I would give them a call regarding the status of my case, no later Friday, June 6th or on Monday, June 9, and I would be relentless. Also, send a thank you note to your specialist and make sure that you copy all of the parties on your original letter and be sure to place Mr. Jaberi at the top of your list. Mr. Jaberi is located at the home office -- and remember that all decisions that are ultimately approved, come from the corporate office. Javid Jaberi is located at the corporate headquarters located in Horsham. Remember the investors GMAC has investors to deal with and depending on how your loan was repackaged and sold dictates much of what they can do by way of modification.

Don't wait for someone to decide your future, your life is virtually in their hands and I would not wait to hear from them. Hopefully, they will call you before you make your next attempt. Show up to the party, everyday! Because your state of mind and the important lives that you cause and effect that matters most.

I am praying for you, continuously and I believe by the Mighty Power of God the Father that you will be handed yet, another gift. It is by his grace and mercy that we were led to this site.

Yes, send out thank you notes to everyone -- just make sure that you include Javid Jaberi, along with cc's to all of the top brass. It is essential that you keep them current as to the progress you are making as well as where you are in the process and what your expectations are. Just because you are begging, doesn't mean that you've relinquished your Power as a Homeowner with a Performing Loan that will cause their investors to continue to Win and reap Profits. It also gives major Kudos and further incentive for Parrish to get you the best possible modification....remember my modifications was at 6% for 3 years and then I sent Mr. Jaberi another note asking for reconsideration and when my papers arrived, it was a 5% fixed for the life of the loan! It is so important that you acknowledge everyone, while gently reminding them that you are but 1 of many more to come and you want to be able to truthfully and honestly echo the sentiment that they helped you regain your peace of mind, preserve your dream of homeownership and sooooo much more. Please keep me posted.

The faxes you send go into a central processing area, which are re-routed into a sophisticated imaging center...most huge operations like GMAC have gone paperless, thereby creating an instant archive of all documents, papers, notes and materials received and sent. At the time they receive your fax, distributions lists are created and then sent out to everyone on you list, so make sure you are sending to both "866" and/or "800" numbers, for both Homecomings (our Servicer) and GMACMC LLC in Horsham (Corporate Loss Mitigation, our loan originator), that way the top brass knows what is going on, also make sure you send an e-mail to Mr. Jaberi. He is a man of his word.

Update to Everyone Fighting:

Last night when I arrived home there was a small slip of paper stuck on my front door that read – “OUR REPRESENTATIVES TRIED TO REACH YOU TODAY, BUT YOU WERE NOT IN. Please call us at 800-850-4060 (which is one of the default number for GMAC) at your earliest convenience and ask to speak to a "Loan Counselor". The small slip of paper had my name and loan number affixed to it. The name of the group that made the contact was Enterprise Servicing Company. Needless to say, I was surprised to find any type of notice attached to my door. I called GMAC this morning and was told the due to more than "half" of their loans being considered for modification, sometimes the backlog does not catch up to the field for several weeks. Also, the customer service rep offered the information "WE ARE FREEZING ARM LOANS FOR 2-3 YEARS SO THAT PEOPLE CAN GET BACK ON THEIR FEET" and eventually refinance. CAN YOU BELIEVE THAT TYPE OF INFO coming from their customer service people.

Everyone -- it is so important that you reach as high up the food chain as possible and remain persistent. Do not wait for your loss mitigation specialist to call you back...keep calling every couple of days or so....keep writing....keep requesting a response to your QWR....keep faxing and most of all ...KEEP PRAYING AND BELIEVING.that GOD has worked out a positive solution for you and that your FAITH will sustain you through this process. PLEASE make sure that you ask for a solid offer...learn from my efforts by accepting the initial offer and asking for reconsideration to something lower. If I can get a 5% fixed rate for the term of the loan, so can you but you cannot let fear stop you from asking. Wait until you have a commitment from your servicer and then ask for reconsideration and then Stand Stand Stand Stand. Who knows, hopefully you won't have to ask because the initial offer will be just what you need.

Hi all,

I just wanted to provide my success story. I began this thread in May 2008 with attempts to get out of my Option-ARM loan on my 1st. After sending an email and letter every day to the CEO, and other executive level people, I heard from someone after 1 week. In my email and letter it included a QWR, financial worksheet, market comparables, hardship letter, and my ideal loan modification explained. After a little over a month of speaking with GMAC's loss mitigation department out of Texas, I was approved for my 1st mortgage (jumbo) loan modified at a 5% fixed fully amoritized loan for 38 years. Their other option to me was a 2% fixed fully amoritized loan for 5 years. I chose to go with 5% for 38 years. Because of the requirements of the investors of this loan, I did not need to provide pay check stubs and bank statements. Everything I originally sent them was suffice.

I received the paperwork confirming approval and all the details about 2 weeks later because their Iowa office who does the processing has been really backed up and floods were occuring and they were in the process of transferring this office to the Philippines. Nevertheless, I received the paperwork indicating everything we discussed via phone and there were no surprises. Bear in mind, with this modification, once approved, they asked for a deposit by certified funds which we discussed since the beginning so that also was not a surprise. This was to initiate the loan modification, etc. Shortly after, our new modified payment was due. It is a stressful process and you need to have the monies ready so once you're approved, you don't need to stress over the deposit and new payment due. Also, as stated for loan modifications on 1st mortgages, we needed to now open an escrow account to be billed for our property taxes as well. That is now tied to our monthly payments to them.

As soon as I had our 1st mortgage loan was situated, 1 month later I requested the same thing for my 2nd mortgage loan and provided the same documentation. My 1st mortgage loan loss mitigation contact was able to give me a new contact for who handles my 2nd. Not only was there a whole new contact for this loan, but there was also a different process. Because of the different investors of this loan, they also required to see our last two pay check stubs and bank statements. My contact said, it would be a quicker approval process. Last week, (the same week I provided her all the information) she called to say I was approved for my 2nd mortgage loan modification at a 5.75% fixed fully amoritized loan for 28 years. I should be receiving the paperwork from Iowa confirming everything in a week or two.

I am a big believer in trying everything and anything before accepting that you will need to short sale or lose your home all together. This site and everyone's insight has helped me through the process a great deal, but you also need to have persistance and determination to have success in this whole process. If anyone has any questions, etc. with regards to this GMAC ordeal, let me know! I'm here to help. I'm now working towards the same thing with IndyMac Bank for my investment property. I'm taking notes on that with a different thread.

We were offered 1% for 5 years, so we took it. I just sent in all of required paperwork to start on our second with GMAC, so I will keep you posted.

We do have our first payment due on Aug 1st, and since they have not updated our account online, I tried to call it in. After waiting on hold for 45 minutes they said to wait on the payment because the modification was not completed on the computer. I am scared to pay past August 1st but that's what they say to do. It's weird, we sent our notarized paperwork in on July 18th.

My Homecomings GMAC (2nd) is due on September.1. DaveandBrandy did your mod docs include a borrowers copy? My copy had a address and person to mail my payment to just in case the mortgage statement with the new amount is not posted. rj
