Hi everyone, my mother just went through a divorce, and was awarded the house, the house was put up for sale the very next day, and hasnt sold. This was at least 6 months ago. shes been in foreclosure, talking with the mortgage company, so they know her situation. She is also on dissability due to illness and cannot work. Just yesterday she had a man come to the house and hand her the summons, which said she has 35 days to respond or something like that. Anyone else gone throuh this before? Im just afraid of whats next. The house has been lowered more than 100,000 and still no one is buying. |

There are steps to take once being served that document...........I have posted here the N.J. foreclosure law so that you can see the timeline of what needs to be done and what will take place............ In N.J. the foreclosure can be put off by either the homeowner or the lender.......in a short sale situation you would need a contract on the property for the lender to do that. I suggest that your mom speak with a real estate attorney and a cpa because in N.J. a deficiency judgement is allowed and this way she will know what to expect if a contract comes in soon or if the house were to be foreclosed on....... I hope this helps........ New Jersey Foreclosure Law
