HUD letter stating reply within 20 days or remove yourself from the property?

Ok, done FHA cases before, first time I've seen this though. Normally there was a letter recieved just stating if occupancy/employment is correct etc and are they going to continue occupying the home. This time we got 5 page letter that included the two latter items but also a writeup that regardless of modification thats been in review for months, that they are going to initiate foreclosure and will transfer ownership to BAC Home Loans Servicing, and then transfer ownership to HUD. Goes on and on, but says must respond to this letter within 20 days of Notice Date. That date says Oct 29th, they just got the letter and 20 days from the 29th is 18th next week. Its says they'll have to pay a months rent up front etc etc.

HUD doesn't know anything since its not in their ownership yet, and BofA doesn't know either, have spoken to the specialty department and home retention, nobody knows what to do with this letter and just keeps saying they have the modification in review (since July/August)

I take it there wasn't a signature from a person on the letter that you can call and ask to speak to?

How about faxing the letter to your hud counselor and BOA contact. Tell them you need to know how to respond as there is no time left to respond to their request.

Did that with HUD this morning, they don't even know what to do. I even checked with HOC office, again, they don't know. Thats one reason why I never understood why they have these people as most seem like hourly paid employee who know nothing. I remember years ago when my partner had the residential branch we used to always have to talk to the HOC offices on certain thigns for FHA loans and they never knew which hand was doing what.

BofA literally talked to them this whole morning for about 2 hours total on this file, and everytime they transferred it disconnected eventually after being on hold for 30+ minutes, spoke to Advocacy Department and Retention etc, now their saying they don't have documents for this file (when we have everything documented and been in review for months), stated that, they don't care and said to resubmitt. But they don't know what to do about that letter.

Ok so still all day been dealing with this case, still no answers, not even from foreclosure department.

Also this file has been in review for months, I keep an log online to track everything. Now today their saying they have no package and to resubmitt... basically have to start over now and go another 4-6 months and pry have them do the samething over again. Sent copy of log of all follow up and items and what was done on certain days etc... their response... well sorry sir we have no record you'll have to resubmitt.

They just pulled this on another file that had been in review for 5 months, any updated items need along the way were sent promptly. Out of the blue they start saying no record of any package in review and issue a sales date quickly. Client had to file BK.

I haven't had to deal with BOA but I've seen people who do have a BOA loan they contact the OOP and leave her a mssg.

I believe her name is Barbara Desoer. Something like that. I'd contact her and let her know that you have a log of info, etc. and you'd really appreciate her call because no one at BOA knows what you should do except resubmit.

I heard someone (same type of situation) say that he has a log confirming doc's were rcvd and someone over there must have stolen your information to commit identity theft.
He threatened to contact the attourney general of his state if they didn't search their files and find it. Also he contacted the supervisor of the rep who wasn't willing to budge and the rep quickly changed their tune.
He said that got them going but he had to strong arm them.

worrywart - that last piece is a GOOD one! So they claimed they lost the docs and he threatened to file re: identity theft and the found them. that is an angle I have never heard before. I have always wondered what they have done with the hundreds of pages they have about my identity.

Worrywart, that really is a great angle. I sell compliance software and this is something that everybody is taking very seriously these days. The fact is that all these people who have been faxing and refaxing in all their personal information and the servicer says they don't have it... Where the hell is it??? This is extreamly risky! Is this laying around in the mail room for a $7 an high school mail room kid to take home or put in his trunk and go sell your information to the highest bidder? I think more of us need to take this approach. Contact the FTC and let them know you think your lender has compromised your identity and more than likely has violated several compliance laws for safeguarding your information. I'm going to dig a little deeper on this one....

Finally figured out what the letter was for, moreso it was a version of the continuation of occupancy, I say version b/c for whatever reason I've had other ones from BofA that were not worded as this one was, HUD and HOC office didn't know about it either even though it specifically mentioned transfer of rights to HUD . This is moreso if they go through foreclosure and issue sales date and go from there, why they sent this so early don't know as it says respond in 20 days, but of course by the time they go the notice only had a few days left .

do you think it could be some sort of scam letter from someone trying to hurt the family and writer may not be who they claim to be? Just a thought.
