Frustrated with Bank of America!

I read through these threads and see that everyone is just as frustrated as I am. I have been dealing with BOA for over a year now. My husband passed away suddenly in Dec 2007. I was able to make payments for a few months after but then fell behind. Eventually in June of 2009 they set me up on a forebearence program for 3 months. I made the payments as required and during the last month I contacted them to find out the next step. I was then told I did not qualify under the home affordability program and that I could try for a "traditional Mod" (what ever that is) so I sent off the paperwork again waited two weeks called again was referred to NACA have not been able to get anyone there to respond to calls or emails. I am completely overwhelmed now. I have not received any paperwork from BOA since I started the forebearance program. When I call the house is not in foreclosure yet, I really want to work out something but can't get anywhere! Spoke to BOA two days ago told them NACA was not responding so they just gave me a different number still nothing!

i'm surprised no one has replied yet. lets see.. welcome to the board. sorry about your husbands death. if your on a forebearence plan then your already ahead of some here. personally i'd deal directly with boa. naca has done some great things for people but i have read of anything great lately. email oop if you haven't already. dealing with advocates and negotiators is a different ball game than dealing with the monkeys. theres alot of info on these boards.

The forebearence program ended in August and that is where the ball dropped. I had a person I was dealing with but when the forebearence ended and I called him he was no longer with BOA. I am just sick of the run around and need a direction.

Hello Sprinklergal09 - I commented on a post you made earlier.

I am terribly sorry to hear about your Skank of America experience. I too have them as my servicer, Fannie Mae is my investor.

1. Do you have a negotiator? If not, you need to get one. A negotiator is a bank employee who is specifically assigned to your file. Please read this thread for more information. Escalating your Making Home Affordable Program request to the Office of the President
2. I hate to say it, but you might need to send your loan modification application again. Please try sending Barbara Desoer an email. Tell her your situation and ask that a negotiator be assigned to you right away. Due to their non-compliance with the Treasury Directives, you are now in a position where foreclosure is eminent. Send the same email 5-10 times a day until you get a response. barbara.j.desoer@bankofamerica.com
3. As soon as you have the name of your negotiator, call them as many times a day as it takes to get an answer as to when you will be put on a trial modification, and then you will be put on a permanent modification. Tell them if they are of the opinion that you do not qualify for the President's program, they need to put it in writing and they can send it to you either by regular mail or email.

Please start your own "thread" so that we can all follow your story and help you.

Here's a NACA number that will respond: Kevin Winn. 617-250-6222 extension 1254. You will need to leave a message. Tell him that BOA referred you to NACA but you haven't been able to get a response and you are desparate. I'm not sure what he can do since you don't have your info into NACA yet, and I've never asked him about this, but maybe he has a back line number you can call to start the process. Give it a try.

Who owns the loan? Was this forbearance offer with BofA or did it come from someone like Fannie Mae? Have you specifically requested a HAMP mod? They just released a new directive for HAMP that they must start sending out written notices regarding denials under that program. It is hard to give you specific advise without knowing all the details. We will try to help out as best we can! Hang in there!

The new HAMP directive only requires the notices as of 1/1/10, only encourages before. It will take awhile for servicers to get the notice in their computer systems.

And it only applies to non GSE's but we don't know as you asked who owns. And only HAMP

This is a GREAT move forward for us but we have to hope the GSE's will also do the same reporting why denied.

But will servicers have to have 4 different decline notices since they can't coordinate with each other, like Fannie, Freddie, GNMA and than all the non GSE's. Each now has their own rules with differences contributing to the mess

The loan is still held by BOA, they also handled the forebearence. I will start with the email and numbers you have all provided and let you know if any responses. I am a very patient person and understand the banks is overwhelmed however, my falling behind was not due to an adjustable insterest rate or anything else I could have controlled. It seems to me they could have worked with me from the start and then I would be one less to process!

So I emailed the person listed above in Nativelasvegan post and I received a phone call from a woman claiming to be from a chairman office of BOA. I have returned her call and left a message so I can't wait to see what she has to say!

I too am frustrated with BofA. First it was Taylor, Bean & Whitaker. Since August it has been BofA. I have done everything advised on this website. Today I received two phone calls from BofA from two different people one tells me that everything is looking good and that I need to fax over some more information. About an hour later another gentleman called me and told me that I did not qualify for the MHA program and the best that they could do is drop my interest rate from 7% to 5% Payment will go from 1900 to 1700. I told him that if I could not afford 1900 and was requesting a loan mod that I wouldn't be able to afford 1700. Was informed that was the best he could do. I wonder if the left hand knows what the right hand is doing? I will continue to fight for my home but I have spoken to so many people over at the BofA that you think that they would just give me a loan mod to get rid of me.

Well I received a call from Juanice Neal in the chairmans office. She requested I send over my information (again) and she will get me a negotiator. I hope I at least get that far! I explained that I have already gone through a forebearance and am extremely frustrated. I was calm and polite because that is really the only way they listen to you! Has anyone else dealt with this person?

This past August I was contacted by Kanise Butters after I sent a certified letter to Barbara Desoer's office detailing my 7 month run around with BOA and begging for just one person to verify that my request for modification had been received and that we were under consideration. She was very nice, empathetic and seemed sincere about trying to get a response from loss mitigation. We are severely behind in our mortgage and I explained to her that my husband is 74 years old and not well. I needed to get some feedback to begin to prepare for the reality of foreclosure although I have told BOA that our financial hardship is temporary and we want to keep our home of 20 years. After Kanise promised to follow our application status to a disposition and assure me she would be in touch regularly with updates, I have not heard from her other than a short note thanking me for contacting BOA. I wrote her a follow up letter last month and left a voice mail but I've not heard back. I hope your experience is better. I can only imagine the overload that HAMP has put them under but I don't think that having access to a knowledgable loan officer to discuss a serious situation with our loan after 7 months of letters, faxes, phone calls and e-mails should be a luxury. We have received 5 BOA door hangers in the past 5 months demanding that we reply immediatly. Each time I call the same number and I am told that there is no additional information to be given. Sorry about the diatribe. Yes, Kanise is a very nice person, she is likely under the same avalanche as everyone else at BOA. Keep your chin up.
