Well here we are we long story short, Dec '08 we started contacting the bank (indymac/onewest bank) to tell them we were out out work, the bank offered us an $500 reduction in payments, being out of work we needed alot more. so they declined us in March '09, we started doing a loan modification in June with yes I am sorry to say Acorn Housing. they were told finally by the bank in Sept that we were declined and they would not look at acorns mod. and that they were going to forclose. I contacted a lawyer and he said because we were $300K upside down on the house to walk, or get a mod that would lower the home to FMV. I submitted all the forms, days after we got the notice of sale date. I called the bank and they told me that it was to late and there is nothing they could do.
I have talked to some professionals and they said they might talk to me after they buy the home back. (no one would by this home, we owe $789K and the market for our home is $400K)
I have sent our package to there corporate office, the mod center and to the trustee. I intend to send the mod package daily to the mod center just to irritate them. Maybe by sending it daily someone will look at it.

I too had a sale date on my rental with them (oct 27th). Sending the QWR got it delayed. Then I got a short sale buyer, went through hell until I contacted Kelley cooper spencer, she got me with loss mitigation people. Got hell again later and no responses so this time I contacted her again and sent a letter and emails to all the contacts I found on this board. Wow! I now talk to my negotiator, he is working to get the short sale approved (it is less than 50% of loan but that is where the value is today). The foreclosure was postponed again and we should have resolution soon. They did ask for me to bring $8k in over 5 years which I insisted I couldn't do as I am still unemployed. My negotiator got that waived too so persistance pays and so does emailing and calling all the reps you can. Please take copious notes with name and id's of people you speak with. I read the notes back to the them to verify what they have said too. GOod luck
