Thank you for your email.
Fannie Mae is refusing to acknowledge their non-compliance of the President's Making Home Affordable Program. Please see their response to my email below.
In response to Fannie's email to me:
1. I do not need guidance or counseling to resolve my issues. What I need is for Fannie Mae to abide by the Treasury's Directives and direct their employee, BOA to modify my loan.
2. I should not have to consult with an attorney or financial advisor when this is such a blatant disregard of regulations, it doesn't take an attorney to figure this out.

As the entity appointed to oversee compliance of HAMP, I am requesting that you contact Fannie Mae to ascertain the reason they are refusing to comply with the written Directives. Such failure should warrant an investigation by you into their practices and a written order that they start complying and continued failure to do so will result in severe penalties.

I have been in touch with Paul Kiel of ProPublic. As you might recall, he recently wrote an article entitled "Eye On The Bailout.... Freddie Mac, Given Oversight of Mortgage Mod Program, Falls Down On The Job." I have asked Mr. Kiel to make my modification journey public. As reported in this article, I will also be relying on the National Consumer Law Center for their support in exposing the flagrant disregard of the President's plan. Diane Thompson of the National Consumer Law Center has suggested that meaningful penalties be imposed on servicers who fail to comply with the program. I support her suggestion.

I want to thank everyone for their participation today. I received a call from my negotiator/bank employee who told me that they HEAR me. And I should expect to receive my documents next week. He said he would call me next week with a FedEx tracking number. I hope he isn't messing with me. I try not to get happy but I feel a bit of relief. I WANT MY LIFE BACK. I have, as most of you here, spent countless hours on this crap and I am sick and tired of it. I'll let you know if I do receive the elusive trial documents next week. Been trying since March. PRE-qualified in July..... time will tell.

I specifically asked my nego if he could give me a tracking number and he told me he would have no idea about that (basically, it would be news to him when I call to say I got the packet). Maybe I will have to push a little to get that information. My first effort on a mod I was told to wait 2 to 4 weeks for FedEx and it took 2 months! I've been at this since April so I know how you are feeling. I guess I may have to do a little squeaking!

Although you have not received a response from mha, at least they know there is more than one person who is holding them responsible for their oversight of the President's plan. If they continue to get complaints of non-compliance, they will hopefully be held accountable for their dropping the ball. Thanks again to all who have participated.

They really do read them, I sent my complaint to everyone at Bank of American and I also copied in the MHA compliance email address along with the senate, house of reps, every senator and every news outlet. I recieved a number of repsonses.

Dear Ms. Caldwell,

Here is the reply I just got. I guess we all better flood the 888-995-HOPE hotline if MHA is going to listen?

We regret reading that you have not resolved your issues concerning the Home Affordable Modification Program (HAMP). In our previous response, we informed you that the Homeowners Hope Hotline (888-995-HOPE) is the resource which can best explain the HAMP process, servicer obligations, your servicer's response, and can work to bridge any gaps in communication between you and your servicer. The Hotline has an established process to investigate and escalate your issues, if necessary.

Please do contact the HOPE Hotline. They should be able to work with you towards resolution of your concerns.
