Screwed by Wells Fargo

I won't talk long. I was told by Wells to stop paying the mortgage to get a mod. We stopped in November 2008. My lawyer and myself filed all paper, financial s, letters etc numerous times from November through March. Got a mod meeting in court in April, May and in July. In July we had to show more financial s that were paid down (credit cards etc). The final mod date 8/22 we were supposed to get our deal done. At the court meeting the lawyer for Wells Fargo didn't have any paper work and told us to re-submit all papers again. one week later we got a letter from Kandour Captiol stating they are the new servicer of the note and they own the note. Kandour says they will sell me the note at a discount if I can get a mortgage. The problem is whos going to give me a mortage now being 12 months late. Is there any bank or broker that will work with me. Is there any legal recousre with Wells Fargo. Don't they have any right to finish my mod. All financials and paper work were in order. Please help!!!

OMG. I have to think about this. OMG. This is outrageous. Can you contact the court you worked for or the attorney you used? Okay - Evan - what's your take on this one?

Re: Screwed by Wells Fargo

your chances of getting a new mortgage with the mortgage lates are slim to none, what does your attorney say about all this? wells has a right to sell your loan at any time, usually the company that purchases these non-performing loans know what they get into with an owner who is behind.

its more than likely that the new servicer is willing to work with you for a loan mod, there first course of action is probably to try to get you to find someone who can get the loan to pay them in full (they probably bought your loan at a big discount)

talk to them about a modification, it may be a blessing in disguise, wells is impossible sometimes.

There is a company call Affinity Lending in CA. They gave me this web sight. They say that they can have a company clean up my credit and then they have FHA lenders that will loan to me, knowing that I have mortgage lates. Something like 7% rate. Anybody have any truth to this. The company that holds my note doesn't want to mod my loan. They will probably sell it to another company. The lawyer that was representing me doesn't know what to do, (doesn't know what he's doing).

Re: Screwed by Wells Fargo

OMG! What will these bast****ds think of next! They sell the mortgages for 1/2 of what they are worth so they don't have to carry them on HAMP now and just cut their losses without having to go through foreclosure! It's like they foreclosed in advance by finding a buyer. God I need a drink now! Didn't even see that one coming.
