Bob and I have only been on this mod trek since November of 2008, starting with a predatory law firm/real estate broker....thankfully got out of that after losing $950. We started with WAMU/Chase the end of March, 2009. Again, thankfully, we started this process a little over two years before our mortgage will adjust to an out of our range of payment possible as a retired couple. We are in a Chapter 13 to boot, hoping for the cramdown legistlation to eventually pass. Already this has been the worst business experience I have ever dealt with -- finding documents, being questioned over and over, explaining things over and over, sending the same copies more than I can even remember, waiting, hoping, and praying for some relief. When we FINALLY got our Trial Mod package on 10/13, the first payment for November was due 10/18!! WHAT? Not only that, there was conflicting info in the documents stating first payment and signed plan due 10/18 and then on another page said they were both due 11/1. No one could clarify. To make matters worse the 18th was a Sunday and again no one could clarify that anyone would be there to get the Fedex on Saturday the 17th or whether it would be considered late if received on the 19th....Basically, we had to turn the payment around within 5 days....like we have the money lying around!! It seems my days and nights are filled with paperwork, writing, reviewing, calling, emailing. It is a full-time job. Thank goodness I'll be retiring soon (not that I can afford to early), but stress and my fibromyalgia, do not mix! This process has definitely increased the stress and it's taking its toll on me already. When all was said and done regarding the trial package, I slept poorly instead of soundly, woke up grumpy the next day, depressed, on the verge of tears for two days after submitting the package and first trial mod payment. Tell me this was not caused by emotional abuse? Seriously, I'll bet many of us have had health problems resulting from the stress of working with Chase or the other servicers. So, my question is, can we sue on the grounds of emotional abuse? My thought.....Only two years to adjustment......Hate to think this will go on for as long as many of your matters have gone on. If I have been made to feel this way in just less than one year, I just can't imagine, what many of you are feeling like right now with so much at stake for your families in a shorter deadline, makes me physically sick to my stomach. I admire all of you. Arlyn |
