Unhappy Begging For Help

I have less than 25 days or i will lose my home someone please help me. I recntly got a letter stating their is a lein on my house because of delinquint sewer charges. Apparently i haven't paid my sewage in 5 years but that is only because i never new i owed it. The town where my house is has sold the charges to wachovia bank and now they are threating to take away my home unless i come up with a $115,000 in 25 days which is impossible for me to do. I owe $22,000 in sewage i never paid the rest is late feees and penalties. i talked to my lawyer to see if he can get them to agree on some sort of settement where i can maybe get on a payment plan but they won't have that. I even called my mortgage company north fork bank to see if they would pick it up and i willl pay them but they told me they are in process of being bought out by capital one and they said at the moment they can't help me. I don't know what to do. I can't afford to come up with the money and i don't want to lose my home i am deperatly seeking anyones help or advice pleeeeeeeeeeease do not let them take my home away from me, i am beggggggggggggging for someone to help me.

Unfortunately the circumstances that you have outlined need you to continue working with your attorney as we are not attorneys and we can't offer you legal advice. The attorney is the only person who will be able to help you to stay the foreclosure or offer you advice on what your next move will have to be.

Unpaid back taxes and Bancroft's/sewer & water line installation bills are a huge problem. Your mortgage company should be called and you need to speak with someone in the Servicing Department Management side of the world and tell them that their security is about to be foreclosed by Wachovia for back Bancroft/Sewer & Water Line Installation Costs....this is not monthly bills, this is an improvement bill.

They at the mortgage company will not be real happy, but they will have to pay it if they want to keep getting mortgage payments as I do believe that the Bancroft/Wachovia will supersede their lien on foreclosure....you need to share with them that they are about to be thrown out of bed. In other words you will not be making payments and the lien on the property is causing foreclosure on the property.

Other than that if they do not appear to care...then you really, really need an attorney very badly....

At the time these improvements were done did they offer you a payment plan, they usually do...

thank you so much for the response. I already tried calling my bank but the problem is i only owe less than 10,000 on my mortgage and the lien is for 115,000 they told me they won't pick it up. I owe 22k the rest is fees. I don't know what to do i don't want to lose my house.

and it sounds like that needs to be done fairly quickly...

Badlyindebt,

Also contact your local council person or commissioner, whoever is your elected representative in the jurisdiction that is placing the lien. If you were never contacted they may be able to help you, but also you need an attorney to work on this pronto.

pleasssse help me

I recently had a lien placed on my property i have come up with the money to pay the seweage charges that got the lien placed in the first place. I am hopefully paying the money on monday. I was just wondering after i pay this money is this lien gonna follow my house. Will people find out there was a lien on my house after it is paid off. If so is there any way to erase this devsistating information from the history of my property.

Hello Badlyindebt,

I am not 100% on this, but I believe a lien is what is held against your property until it is paid off and than the lein disappears. There may be a record of it, but it is gone when the debt is gone. If you contact the office that placed the lien they will be able to give you more information.
