Angry Can anyone help Me..

I was in default 7/2007. ON 7/31/07 i paid what was stated on the reinstatement letter. My loan is now current and my lender is saying im pass due. They said default fees charge on 8/31/07 and 10/1/07 where never paid. I asked why these fees where not on the reinstatement letter and they said until i pay them im considered pass due. Does anyone know if this is true? Can a continue to charges you fees once you bring your loan current? I need help because now they said i should not pay march and do a loan mod. for this payment and the fees. I dont want to pay the fees. Please help!!!!

Welcome to the forum and thank you for joining...

Who is your servicer/lender? When exactly did you pay the reinstatement and when do they say these fees originated? It is against Fair Lending Rules for them to tell you not to make a payment, make your payment....do not ever let the loan go past due....

When a servicer/lender tells you this, do not listen to them make your payment then report them to the BBB and to your State Banking Commissioner and State Attorney General and for good measure HUD and FTC.

Please let me know the answers to the questions above.

Thanks Poppy for the quick reponse. My lender is Ocwen and i made a payment of 6,321/00 on 7/31/07 by wire. This is what i needed to due as per my reinstatement letter. These fees were charge 8/31( 2 fees, one for mail and the other misc), 10/1(title search). I did contact my Attny General and BBB today by email. After that call things just didnt seem right so i got alittle more proactive. Hint why im here looking for advice. Nice to see there is help for the little people. Thanks again...

OK, HUD is investigating them and decided to do so about a week and a half ago, make a big complaint to HUD...www.hud.gov or www.fha.gov and for good measure try www.ftc.gov They are extremely abusive and you paid the reinstatement per their statement with all of the fees to bring it current and then they tacked on some new ones for good measure...

QWR the file that would also be one of my favorites for moronic servicers like Ocwen, I will include that below. File some major complaints with the Federal Agencies listed above and with your State Banking Commissioner and The AG's Office for your state. Have at it and include the copies of the documentation and tell them that they told you NOT to make payments. That ought to go over real well if you are in a Fair Credit State, NOT. Get them in more trouble, they need more trouble to get themselves straight and deal with their customer's honestly.

The QWR is a demand for all the documents in your file and a Life of Loan History, do that tomorrow...three times certified return receipt requested. QWR -- there are examples of the letter in the Tool Box. In that letter demand your Life of Loan History, copy of Note, Deed of Trust, Riders, all Assignments of the Deed of Trust, TIL, Right of Rescission (if refi), Lender Final HUD-1, copy of initial loan application and final lender loan application, all disclosures and all loan documents in your file, copy of appraisal. Send this three times certified return receipt required and also send it to the Broker, Title Company and all others in the Chain of the Transaction.
