Has anyone ever had a successful modification from LITTON? 1st let me say the I totally comply with all the qualifications to have a modification. A victim of a predatory broker, self-employed unable to refi, make about 89K a year, pay about 48% of my gross to my mortgage payment. Back in July I started the 'trial' modification program. OK, all is going to be good, these folks are going to help..... I have supplied all the paper work they have requested, faxed & fedex!. At almost the end of the 3rd month they requested paper work I could have sent 2 months prior. My '08 taxes were on extension and had not been done. I had told them this at the beginning and they said the '07 taxes were ok to send. SO, I had to scramble to get my '08 tax to them. After that was sent another month went by [yes that's right]. They requested a Profit-Loss.. I said they already had that with my taxes,, they said, no, for '09... OMG!. Folks, I just dont do my books like this. I am a very small company I told them, I do my taxes at the end of the year. SO, I had to basically do my taxes, in AUG, to create a P&L for '09. It get's worse.... It took me 5 days to rummage through all my papers to basically do my taxes for '09... I sent that on the 14th of Sept. I called them on the 13th to say It was coming on the 14th, did they want me to fedex it as well? They said no.. Forward to today. I called to make the OCT payment, because they say not to be late during the modification process. To my horror, the operator states the old adjusted payment..... then says the modification was denied.. I said she had better get someone on the line! I supplied ALL the paperwork and I was more than qualified for a modification under the Obama plan. I asked why did they deny it? She stated that I didn't supply all the paperwork. I said what paperwork did you ask for that I did not give you...? She stated the P&L Before I was about to go ballistic, I said I worked VERY hard to provide that document, that you really didn't need! She said they denied on the 23rd and I said I faxed the P&L on the 15th! She went into the the system and it was there! she said she reinstated my application but would not give me the name of the person who goofed and said I didn't send the P&L. I am thinking that LITTON is looking for any reason to deny my modification simply because it is so cut and dry. What do I have to do to get this company to follow through? Do they have to follow through? Can they tell me to screw off regardless?? Thanks for letting me vent.. regards David Wood |

If its HAMP the directives say after the 2nd payment you get forms and have to verify either latest quarter or year-to-date income statement that is within 90 days (if self employed to compute net income from self employment). At least they TOLD you the problem so you could insist on them checking and you got reinstated. But you didn't need such a hassle and aggravation which seems to be the goal (to hassle) of most servicers. |

I more than qualified for help, but when I started the mod process they told me that they were not utilizing the Obama plan, that they were doing it in house. I too am self-employed. My first payment was due 08/01, they called one week early to ask in if could send it in early? WTF? but ok, so I did. I made my 09/01 payment and my 10/01 payment. The next day, 10/02 they called from Loss Mitigation and asked for an audited profit and loss for 08 ( I too have not filed 08, filed an extension, had a business loss for the year so I was not too worried about IRS) and they also wanted a profit and loss for 09 thus far. This was on Fri. I said "hmmmm, how long do I have to get this to you?" They said one week!!! I said you are just now asking for this now?? She said "Oh, sorry. just get it to us" I called Brenda Garza in the Executive Resolution Team and she said it was ok just to send a tax return instead of audited profit and loss, as well as the 09 profit and loss... My questions: 1)you say they asked for the tax return almost at the end of the third month of trial, is that right? 2) how much time did they give you to prepare it? You said your loan was predatory. That's what these laws are meant to uncover. Just search this forum for QWR or "Qualified Written Request" and there are samples.... Also - is Litton just your servicer, or are they your lender, too? If you don't know, that's something to ask.... Good luck. |

I am pretty sure my loan was predatory as well ( at least very lax in terms of underwriting), but the statute of limitations is 3 years from origination of the loan. |

I keep my papers then add all at the end of the year. I dont keep a running tab. so, I had to literally do my taxes to get the P&L done. I ran into the same situation were they gave me little time to get the P&L to them. I had to scramble. I had the same complaint of time, why did they not tell me 2 months prior about needing the P&L?? I think this is done on purpose to decline modifications outright. They asked for the '08 return at the end of the 3rd month and only when I called in to make the loan payment. they said they sent a letter, but that wasn't true. I already had the '08s done it just had not been sent in because i am in the middle of a divorce. as for the predatory loan, I think this is the case with most adjustable loans and I did mention it to them, they said nothing about it. I emailed Litton from the emails on this website [4 addresses]. in 2 days I got a phone call! so the email complaint/email worked. They said they were sorry for the mix up about the P&L and said they would send an inspector to my house in 10 days, that was 7 days ago. so we will see.. regards dw |

Today I received a trial modification pack.. as if nothing had occurred. ..as if i have never been in the system at all, since July. I really am in a nightmare.. Re: conversation with Todd Rab****** on Friday Oct-30 2009 Litton – As Mr Rab****** explained today, it appears Litton re-started this modification, really, for no reason and for no fault of mine, for something as trivial as a signature that I wasn’t even notified of in the beginning. This condition is unacceptable and further displays and beckons LITTONS reluctance to finish this process.. ALL of my documents are complete. I have been in the system since July. I fully qualify for this modification. You are withholding the final DOCs, why?? This is the big question. Again one needs to ask LITTONS true intentions here. Surely you are not asking me to accept the explanation for this delay? Why do you want to drag this out? I can only assume LITTON is looking/searching for something to decline this modification, that is the only conclusion I can draw. There is really no other interpretation I can come up with, this is how it looks I’m afraid. I would ask to talk to someone with some answers, maybe Mr. Litton? Your owners Goldman-Sachs? Obviously there is a benefit to keeping me in limbo all these months. If you are waiting for me to make a mistake, you have a long wait, I wont make one. Please can we finish this or tell me your true intentions. If there is another entity I could get in contact with, let me know, otherwise I will do some research. Best regards |

I will say that the MOST frustrating and DIFFICULT time I had was in getting Litton to ACCURATELY tell me what documents they were "missing" since it seemed they were always "missing " something. And of course they'd send out a form letter describing things I'd sent, which I would dutifully SEND AGAIN, and AGAIN, and AGAIN. Until they FINALLY, months in, clarified WHAT THEY WANTED. If I could give any advice to anyone in this LIMBO, it would be DO NOT STOP CALLING AND CALLING CALLING AND CALLING until YOU HEAR THE WORDS "YES, WE HAVE ALL NEEDED DOCUMENTS" and better yet, GET IT IN WRITING and then CALL AND MAKE SURE THEY AREN'T REVERTING BACK TO "document-missing in inaction" mode. I have been told that I "passed" all these various things and that NOW, they are JUST WAITING for the FINAL DOCUMENTS from the iinvestor.... in other words, you did your part, and we did our part, and stop calling us because NOW the ball isn't in my court or theirs. Oh well, you do what you can do and that really IS all you can do. I've signed the petitions, I've filed the complaints, I've complied with doing my end of the deal they sent me... I am in LITTON LIMBO and having NIGHTMARES, and I AM HAVING NIGHTMARES, about foreclosure notices, and about denials coming to me FED EX, lol. I have woken up in a sweat at least once a week since this started and I am completely disillusioned by the whole process. There is NO reason why this couldn't be better managed. The thing I've read is that there may be some sort of BIG INSURANCE PAYOUT for Litton that will make it far more profitable for them to screw us over en mass than to actually follow through and finalize these deals, I hope that is NOT true, but given the stalling and the waiting and the way the documents disappear, who knows-- NOT ME. I don't know what is going on, but NOTHING WOULD MAKE YOURS TRULY HERE AND MY TEENAGERS, MORE THANKFUL THIS THANKSGIVING THAN BEING ABLE TO HAVE THANKSGIVING KNOWING THAT THERE IS SOME SECURITY AROUND HAVING A ROOF OVER OUR HEADS. I HAD the money to pay my mortgage, I didn't go for the variable rate even though it was initially lower, I did figure, it wouldn't stay like that, so I had a fixed rate--- BUT my income stagnated, it flat lined, then I was self-employed working for someone else, but they terminated the contract and took over that work themselves when their revenues were slowing down due to the economy. NOW I need a modification that will be affordable for me. I have had to do repayment plans that were brutal when stuff happened along the way. Unanticipated expenses, like replacing the engine on a 2 year old car! And a broken water heater, any big expense, and I'm done. Just had another $500.00 car repair, needed to pass inspection, if the loan gets modified THEN I will be able to manage that sort of thing, if not-- forget it. |

My Dec 1 statement is all correct, I have gotten a copy of my signed, notarized and recorded loan modification agreement back from Brown and Associates and in yesterday's mail I received a letter from Litton stating modification is complete.. Keep fighting and don't take no for an answer.. I started this process in April... It was a long road but its done.. NOW for the fight with Chase.. I am working on a mod for my parents.. Talk about a nightmare..Litton was easy compared to Chase... |

I continue to send in updated info. I have been in review for months. I have written everyone I can think of, signed petitions, made calls, etc. I won't give up. I will call Litton every two days and be as sweet as pie while I ask about my progress. I won't give in. They just might give me a mod to get me to leave them alone! |
