My Litton Loan Story

Hi guys well here is my story with ocwen. back in may 2003 we got a loan for our house for $134,000.00 at 6.5% interest we needed a second morgage to make the $168,000.00 house closing wich we got .and my wife put the second morgadge on a loan payout thru her credit uniuon with a lower rate ok right after closing ocwen sold our loan to litton and we received papers for it. last summer we were behind in our morgage so she got money paid 3 months worth of payment but the last payment she made she did not tell them it was for auegest payment they just put it toward escrow and said we still owed $45.00 in late fees witch we paid anD they said they would apply the payment to augest .So in january of 08 we called and said we WANTED TO MAKE 1-1/2 PAYMENTS TO THEM AND THEY SAID OK . WELL OUR DOUGHTER LOST THER HOUSE AND WE HAD TO COME UP WITH $1200.00 PAYMENT TO THEM SO THEY COULD RENT A HOUSE . WE HAVE GOTTEN BEHIND AGAIN AND WANTED TO MAKE LATE PAYMENT ARRANGEMENTS THEY SAID WELL YOU CAN MAKE A PAYMENT BUT YOUR GOIMG IN FORECLOSURE SO IT DOES NOT MATTER PLEASE HELP WHAT CAN WE DO AND WHY DID WE STAY IN FOREBARANCE THANKS BOB HUTCH

Hi Bob,
Welcome to the forum and thank you for joining and posting your story....
Just please know with Litton you have a fight on your hands....but you can do it if you really set your mind to it......getting them to modify is like a second job for most, but the outcome is the reward for the hard work....
If you would like to get the modification process started instead of a forebearance agreement, which is sounds like you do.......

This is the woman I used. I won't put her name but you will here it on her voice mail 800-2479727 ext. 4913 if she doesn't answer which she is the one that called me back late this evening not very friendly hit 0. That will send you to another foreclosure person.

I also called 800 247 9727 ext 7719. this is the portfolio retention department. Whatever that means. They are the ones who told me it was still in processing. titanium solutions transferred me to this department after no one would call me back so I called titanium solutions that so they went ahead and transferred me and I got an ext. number from them so I could bug them also.

I also called customer service several times and I would just ask them a lot I mean a lot of questions and then they would forward me to someone else in the foreclosure or loss mitigation.

Also I will post information regarding a QWR next which is a Qualified Written Request along with an example and an address to send that to........that will prompt the lender to send you the Life of the Loan history and how payments are being applied so you can see just where they are putting the money....

Here is the QWR info so you can get that going as well.......

QWR - mail it to the address for servicing they must comply, mail another to the main address, in all mail 3 by certified, return receipt,it is a serious regulation put in place to tame these guys, if they do not, report them to the FTC and HUD, HUD is starting to investigate these servicers, one was slated yesterday to go through some very intense scrutiny...very intense for servicing abuse....

QWR - there are examples of the letter in the Tool Box. In that letter demand your Life of Loan History, copy of Note, Deed of Trust, Riders, all Assignments of the Deed of Trust, TIL, Right of Rescission (if refi), Lender Final HUD-1, copy of initial loan application and final lender loan application, all disclosures and all loan documents in your file, copy of appraisal. Send this three times certified return receipt required and also send it to the Broker, Title Company and all others in the Chain of the Transaction.

The problem as they see it is that you did not keep the forbearance agreement and as such they feel that they are compelled to proceed with the foreclosure. The foreclosure is never entirely closed out during a period of forbearance. The numbers that *** gave you should help and you need to stress that you want to get back on track. I understand very much the desire to help family members, however doing so put you at risk with Litton. You must if you have a forbearance agreement meet all terms of it or they will reinstate the foreclosure.

At this point you have to get very proactive and focused and call Litton and get them to meet you in the middle as this appears to be the 2nd or 3rd forbearance agreement that you have with them. They are not able due to investor pressure to make and have the agreements broken in their eyes over a short period of time 2 or 3 times. This time if they are willing to extend another forbearance with you, you have to regardless of anything continue on the program as you are at risk of them not making another agreement again.

Please use those numbers that *** gave you and do the best that you can to explain the situation and then if you have it the proof of the assistance to the family member so that they have evidence of the hardship.

HI AGAIN THANKS FOR THE INFO I CALLED THE NUMBER YOU LiSTED AND WE WILL SEND A PAYMENT WESTERN UNUION ON THE 7TH AND SHE SAID TO CALL BACK NEXT WEEK TO SEE WERE WE stand.
she said that the 1-1/2 payments we made in january for november and december that the 1/2 payment still is sitting in forbarance. therefore not posted as a payment uh ah i dont understand that .if we had made another 1/2 payment it would have posted for december .so now that we did not make the payment before march 1st thats why that it can go into foreclosure according to the letter we received in january. god what a nightmare thanks again . i asked about loan modification they said its too late ?i guess i need to make a harship withdraw but i need the letter from them first right.

No it is not to late for modification you need to be in a department where they do modification and presently it appears that you are in collections. I have a thread in the top of Tell Your Story with Litton Loan Contacts as well.

They can not post partial payments to the actual payments, so they put them in suspense toward the full payment, kind of like matching two pieces of the puzzle together so when the amount comes in to make the other 1/2 up they can then post them to a payment. They are all restricted that way, only a whole payment can post to the payment due, not a part of it. So they took the one full payment and applied it and left the partial payment in the suspense account tied to your loan until they got the next 1/2 to put with it.

Please try calling and speaking with another party there to get the modification package mailed to you to start the process.
