Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | I am currently delinquent for June, July and now August. I called and went online in an attempt to make my June pyt. They refused it and said I must pay all arearages. Ok, I get that as a concept. But seriously folks...I'm desperately trying to keep out of foreclosure. Do they want my house that bad? They are the servicer, Bay View Funding is the lender. Background: I have equity in my home........lived here over 15 years, just have a first mtg and while it's an adjustable, I'm happy with the rate which is around 5.5%. We fell behind due to unemployment, reduced income. I can now pay June, will be able to pay July within 10 days......and August...hopefully sometime in the first two weeks of Sept. Then will continue working on bringing it current. Should I call again and plead my case? Should I be forceful, should I beg, should I threaten {threaten what?}. If push comes to shove, would filing BK temporarily stop then from initiating foreclosure? I dont' want to incure any more fees. I'm at a loss and welcome any thoughts. SusieQ |

Filing BK will stop the initial foreclosure but it is only temporary. I suggest before going that route you continue to call because different reps usually have different info to tell you. Also request to speak with supervisors/manangers if possible because most of the time they seem a little more professional.

Also, from reading on other post another way to pro-long the foreclosure process is to do the "produce the original note" procedure. I am not sure how it is done but when the market was really good our loans were sold over and over and it's very time consuming for them to provide that. Though they may have retained the rights to service your loan it may be with someone else and you don't even know it. This may buy you some ammunition/time so it's worth looking up. Or, you can wait the 10 days that it will take and make the June/July payments together. I don't see how they can demand that you do August also since the month is not over. You can say that you will be paying that in the next coming weeks and will include the late fees with that payment. I agree with Evan... sounds like you got someone who just wants the day to be over and doesn't want to bother w/you. Good Luck! |

I was emphathatic to knowing they had rules, but also trying to pass on my determination that I wasn't going down without a fight. I got another rep and I'm cautiously optimistic this time. She did say she would accept two payments, provided they are paid by the end of the month....... I understand that completely, so will wait till I have the full 2 and pay then. I think I'll be ok as long as I dont' let it go 60 days again. If I had just paid the June payment on the last day of July, I would have apparently been ok. Still, received the certified letter of intent on Saturday and it's a horrible feeling.......... Thanks for the encouragment........... SusieQ |
