I am behind in my mortgage to Wells Fargo by three months so they will not reaffirm my mortgage nor will they take payments so I can get current. They have filed with the court to get my loan out of bankruptcy and may have already gotten permission to do so. They then want to file foreclosure on my home (or so tha paperwork stated that they filed with the court) When I speak with them they say they just want my loan out of bankruptcy so they can make payment arrangements with me. However they asked me (and I already sent in) a hardship letter, consent from my lawyer to work with them, proof of income etc. What should I do now? My lawyer is no help -- he didn't even tell me about Wells Fargo asking the court for my loan to be released and I did not get a letter about it. I want to reaffirm my loan because the alternative sounds crazy - them not reporting me to the credit agencies and I can't sell the house until it is paid off and they won't work with me on anything. I need some sound advice. PLEASE. Thank you for any help. I am getting very hysterical. Susan |

Sometimes I think bankruptcy attorney give homeowner bad advice and time their bankruptcies all wrong. I also feel it is just so they can collect legal fees and pay their bills. My thoughts are that you attorney should do their fricken job and give your proper legal advice. I am not an attorney, but I have been around them a lot of the last 2 years and what I have seen is scary in regards to how they practice law. The courts, through the BK have placed an automatic stay on your creditors and this makes it so they cant deal with you because if they do, they would be in violation of the court order. Wells is very difficult to work with and you will have to get the automatic stay lifted or removed in order for them to deal with you.

My lawyer said this will cost $800 which I don't have because I used all my money to bring my mortgage current so Wells Fargo would reaffirm. I don't understand how my bankruptcy is closed - I just had the meeting of the creditors the first part of July 2009. I would like to know how can I get my mortgage reaffirmed without paying my dumb as* lawyer $800? Thank you, Susan |
