SPS Loan Modification Track

Hello everyone. I'm a newbie hear. Excellent website. Been doing alot a research. I have a question. I filed for BK13 on 2/2/09. Before the Obama Plan came into affect. I called the mortgage company and did a modification request. They got all my paperwork, just waiting to hear back from them. I have Select Portfolio Servicing. My question is what are the chancing of getting approved for this plan. I wanted to dismiss my BK13. We are paying too much for the plan and we are almost broke every paycheck cause there is nothing left. I am able to pay all my credit cards and mortgage if the mortgage company can modify my loan. I'm currently on an Arm 1st mortgage is 7.98% $133k and 2nd is 10.95% $33k. I'm 12 months in arrears and this includes taxes. I've requested modifications from them before and have been approved. But the forbearance agreements that I was put on were extremely ridiculous. I need some thoughts on this.

These are the qualification terms for the MHA modification........

• The home must be an owner occupied, single family 1-4 unit property (including condominium, cooperative, and manufactured home affixed to a foundation and treated as real property under state law).
• The home must be a primary residence (verified with tax return, credit report, and other documentation such as a utility bill).
• The home may not be investor-owned.
• The home may not be vacant or condemned.
Borrowers in bankruptcy are not automatically eliminated from consideration for a modification.
• Borrowers in active litigation regarding the mortgage loan can qualify for a modification without waiving their legal rights.
• First lien loans must have an unpaid principal balance (prior to capitalization of arrearages) equal to or less than:
o 1 Unit: $729,750
o 2 Units: $934,200
o 3 Units: $1,129,250
o 4 Units: $1,403,400

Thanks ***. How long is the process usually taking? SPS told me about 30 to 90 days. I thought that was alot. But from my understanding after reading the Obama Plan that have to cease any foreclosures until the modification is either approved or denied correct?

I'm going to have to dismiss my BK13 case. I know I'm putting myself in a bad position. But I really don't have a choice. Any feed back is greatly appreciated.

you would need to speak to your attorney regarding what will transpire after the automatic stay is lifted...........

the timeframe for the modification is about accurate..........but sometimes it can take longer..........

try to contact SPS as soon as you can to begin the process....

I called SPS they received my information. So now I'm in the waiting process. My attorney suggested I wait until the modification is done and if it's approved they can take my mortgage out of the BK and leave the rest in there until it's discharged. Anybody waiting for an SPS response...Want to hear your stories. I'm wonder what the time frame is and what they are offering. Thanks ***!

What the modification will be is going to be individual to your financial picture................the participating servicers are following the same set of guidelines across the board..............you can look them over in this link to see what to expect from the modification process...........

you mentioned the MHA qualifications does your debt still have to be 31% of your gross income. If so why do they use gross and not net it dosen't make sense to me?

SPS Loan Modification Track

For those of you who have SPS I'm tracking there timeframe with the Loan Mods just in case anyone wants to know. Mailed all my documents including hardship letter and 4506t on May 7th. All information was entered into the system and they opened a case on May 9th which is odd cause that's a Saturday. Ok I called on May 20th and all my documents have been scanned and sent to the underwriter to compile and to prepare for a case worker. I called May 26th and documents are in the process of going to a case underwriter for reviewal and a proposal of a modification plan. The rep stated it will take between 1 to 3 weeks to get the proposal together and then another 30 days to submit all the paperwork. So I guess I just have to wait and see. That's pretty much all I can do at the moment. I will keep you posted.

When you completed the 4506-T what year or period requested did you use?

So I called today to get an update. Spoke to the rep and they stated that it didn't show the financials, hardship letter nor the 4506t have been scanned. I told him when I mailed them. He told me to fax him all the documents asap so he can start the process. He reviewed all the financials that he did have when I did it online. And he said everything looked good, all they needed was the paperwork. Everything was faxed this morning. Now I just have to wait. Will call in another week.

They sure are taking a long time. Everytime I call I get the wait 30 to 90 days and then I call in another week and they tell me wait 2 more weeks. Seriously...why is it taking that long?

Received a letter from SPS apologizing for the delay. They stated they are currently working on getting the modification done. And just wanted to apologize for the delay. Well I guess that was nice of them. I'm about to get my bk 13 confirmed tomorrow. I'm nervous and I was sure hoping the modification would be done by then. I guess not. Ok will keep you posted.

Called SPS to check status. Spoke to the actual underwriter. She stated my modification has been reviewed and is sitting on the manager desk for approval. Won't keep my hopes up until I get a proposal of some sort. I'm so nervous. Went to BK court today, my court date was on continuation until July 17. My attorney said I was 99% complete and should be ready for a confirmation. So I guess I'm sitting around waiting for a confirmation and a modification. Oh guys I will keep you posted.

Here's an update. I called SPS and they told me the mod hasn't been approved, but he was able to give me some numbers of how my mortgage would look. I currently owe $35,000 in arrears. My payments use to be $972.50 @ 7.98% this didn't include insurance nor taxes. He quoted my new payment as follows: $1544.03 @ 5.75% this includes taxes and insurance. All my arrears will be wiped out he mention that to me. He stated this wasn't approved yet cause they are still working on it. Then I asked about my 2nd mortgage he said they haven't started working on that yet, not until they have approved the 1st mortgage. He said call back in 2 weeks.

They weren't kidding when they said it takes 60 to 90 days. This is a lengthy process. But will keep you posted.

Made a call to SPS on 7/2/09 and the rep told me that my modification was approved and mailed out today via Fed Ex. I haven't received anything as of yet. But she was unable to give me exact numbers. She told me they didn't do the modification on the 2nd mortgage, because they wanted to me to start on the 1st mortgage. Makes no sense to me...but ok. I should be receiving some paperwork today. Waiting on Fed Ex. Will keep you posted...

I called SPS cause I hadn't received any paperwork. So I called and asked them if they can fax the modification agreement. They did. Not what I expected but I should take what they give me. My arrears of $35,000 were not capitalized instead they were added to my note. So my mortgage went from $132,839.00 to $175,502. 78. They added my arrears to my mortgage. I thought those were going to be forgiven. I guess not. well here is the break down of my new mod.

Was:
$972.87 with no escrow @ 9.85% interest

Now:
$1,490.65 with escrow @ 5.750% interest

First payment due on August 1st, 2009. Hooray...I'm happy now I can take it out of my BK13.

I would wait to see the paperwork. I thought my mod was fine until I saw the paperwork. I have a balloon payment at the end of 30 years. They didn't say that on the phone. I would have your chapter 13 attorney read loan mod to make sure it is a good deal for you. You don't have to accept their first offer and you definitely don't want the loan to default again.

Both my attorney and I received the paperwork and reviewed it. It's the best offer we can get. I was in arrears a little over $35,000. So I think we couldn't ask for anything better. We got a fixed rate. There is no balloon payment. I read all the terms. I think everything is good.

Neither did the offer they gave me. I read somewhere that SPS is not putting that many people into the Obama Plan. They are first trying to put people into their own mod.
