Just fell out of 2nd Chapter 13 Bankruptcy last month when my boyfriend told me about this website called LOANSAFE site he had found. After reading some of your stories decided this may be the right place for me. Nobody in my family nor my friends can even come close to relating what I have gone through and that has left me feeling so alone. With that said, I wrote the following letter to HOMEQ in hopes of remodication of loan. Any advice or suggestions or changes that I should make to letter before sending would be greatly appreciated! ----------------------------------------------------------- To Whom It May Concern: I am writing this letter to explain my unfortunate set of circumstances that have caused me to become delinquent on my mortgage. I have done everything in my power to make ends meet but unfortunately have fallen short and would like you to consider working with me to modify my loan. My number one goal is to keep my home that I purchased proudly on my own almost 9 years ago. I would really appreciate the opportunity and your consideration to do just that! The main reason that caused me to become late on my mortgage was when I had surgery in April 2006 and was placed on disability an additional 9 months longer than the 3 months anticipated. This immediately effected my monthly income earnings as the state disability checks were considerabley less. After recovering and completing therapy I obtained the release from my doctor stating I was able to return to work and to the job I enjoyed so very much. I returned to the same company I was working for prior to my surgery and thought I should be able to get caught up financially within the next couple months. About a month later though the owner of the company informed me the business was closing. It had now been over a year since I had any "real" income plus faced with having to look for another job. The next year or so I found work here and there but nothing permanent or remotely close to the income I had earned previously. This had adversely effected me financially and therefore set me back even further. I filed for Chapter 13 Bankruptcy in July 2007 and continued to meet the court obligations along with payments each month and planned on it while seeking long term employment. In April 2008 much to my attorneys surprise my case was dismissed along with many others that filed less than a year earlier. The judge said it was not because of anything I had done or not done but simply the courts were so overwhelmed by the amount of cases recently filed. The paperwork alone was too much for their staff to support or manage. My attorney told me it would be only a matter of time before my home would be in foreclosure and I should make arrangements. I really could not afford to even move anything and had nowhere to go so I continued looking for steady work while I waited for the inevitable. A few weeks later my attorney called with some possible good news as he received a letter from LA Superior Courts regarding my case. The Judge had arranged and under special circumstances that I would be eligible to re-file my case for a second time. Of course, I would have to complete the entire process from the beginning but nonetheless there was some hope. I wanted more than anything to keep my home so I quickly met with my attorney and filed for Chapter 13 BK again! During this time I had also secured full time employment with a guaranteed salary and also the potential to earn additional bonuses. From that point on it seemed things may just work out for me afterall. That was until a couple months ago when the Automotive Industry that I am employed within received some serious financial set backs. Thankfully, I am still employed and do not foresee that changing any time soon or in near future. However, my income is now lower and has decreased enough to effect the status of my Bankruptcy. Unable to keep up financially with court obligated payments the last couple months my Chapter 13 Bankruptcy case was dismissed on April 17th, 2009. Unsure of what to expect next or how long until I receive notification of foreclosure I am pleading with you to consider a remodification of my loan. I have fallen further and further behind and now it's to the point that I have exhausted all my resources and income that I am turning to you for some help. As I mentioned above I have secured employment and have been working steadily for almost a year now and would truely appreciate if you will work with me to lower the amount delinquent or owed into a payment that will allow me to keep my home. I would also like to make amends with your firm. I truly hope that you will consider working with me and am anxious to get this settled so I can move on! Staci, I have never heard of cases being dismissed because of back up in the courts. Something does not sound right here. Then again LA Courts...not surprised of this kind of manuevering. Have you consulted with another BK attorney? I sure would get a 2nd and third opinion on this. Something does not smell right here and your attorney, well I get red flags. Personally, I dont think letting the lender know your BK has been dismissed (or any of the details of your problematic BK) is a good idea or in your best interests. Sometimes less is more. |
