Ditech/Gmac "Stealing" my home

my story is long so I probably won't tell it all yet. Jay and I bought our first house in 1972 in so cal. I was 19 and he was 21 we had already been married for over 2 years. In 1979 we sold it and bought a house in Garden Grove, CA we lived there for twenty eight years, the end of 2006 we sold that house and bought this house outside of Austin, TX. We were able to pay cash for this house. we had equity from 35 years of home ownership. We moved here because we are raising our granchildren Oliver is 10 and suffers from Aspergers Autisum, Kyra is 4. My husband has been in the flooring business since 1967. first as a carpet installer apprentice, 1971 self employed flooring contractor, in 1999 we purchased A flooring shop in Anaheim. We worked our rearends off. We never could afford retirement accounts, 401Ks etc. We always put every thing into our home. When we got to the big Tex. J applied for a job at lowes in flooring. He was hired the next day. He didn't plan on staying too long because his experience is very great. Any way we made a big mistake we got A 100,000 dollar loan from GMAC, We wanted forty but they couldn't charge enough for themselves in points. Texas law? Well our payment was to be 757.00. I asked for a escrow account. payment 1097.00 more then 1/2 our income, but we paid off all bills, car, truck everything. i knew we have to use our savings left from the loan, but I was sure J would find a good honest shop to work in. There are 130 flooring stores in greater Austin. Then the recession began. We had been through them before and knew to hunker down and keep this job. Well in July 08 I got a letter fron attorneys for Williamson county that our prop. taxes hadn't been paid 1600.00 and a 580.00 penalty. I called Gmac and told them they missed those taxes and I would be paying them with my check card as soon as we hang up. Which I did. In aug. 08 I got a letter from ditch/gmac that our new house payment would now be 1744.00 we have a FIXED rate fannie mae. 8.25% . I almost died right then and there. This was nearly 100% of our income. I tried to request waiver of my escrow account. It wasn't their policy to waive escrow accounts till loan is 24 months old. Then they also took more money from our escrow account to pay williamson cnty after I did. Williamson county sent me photo copies of a letter they sent back with uncashed checks stateing the home owner had already paid them. To this day I don't know if that 22 hundred dollars was ever credited back. there is alot more to this. My loan was taken over 12/08 by Nationstar. I have to say they seem to be way better. We are going to have to get a modification or we will lose every thing we are to old to start over, and I have two little kids to raise. one with a handicapp. I have alot to do, but I feel better that ya'll are out there. I'm not alone. Just wish we all didn't meet under these circumstaces. gramma
