Unhappy National City & Loan Mod/forclosure

Hello all...

I am new here so forgive me if this is posted in the wrong place

I was given this link by a friend who knows I am needing help.

Let me start from the beginning:

In October of 2007 we refinanced our house with National City Mortgage. In July 2008 when the rates were dropping we tried to refinanace again only to find out that from Oct-July the value of our house went from 210K to 180K. (We owed 188K)

My husband works fulltime and I was working fulltime when I lost my job in August 2008. I called National City because I was afraid that there would come a time soon that I would not be able to keep up with the payments. At that time they said there was nothing they could do for me until I was behind.

Also at this time the property taxes rose. Our payments went from $1200.00 to $1889.00


In October 2008 (By this time I was behind 30 days) I was hired on as a temp. to work through Jan.2009 with the possibility that I might become a permanent emlpoyee. Well, the week before Christmas we were let go.

I had already started a loan mod. with National City in November.

So, in Jan.2008 I receive forclorsure papers in the mail. So, I hire an attorney to go to court for me.

Every week since Nov. 26 (when they say they received my paperwork )I have called them to check status. My lawyer continues to go to court telling their attorneys & the judge that I am in a loan modification with their client.

In March finally I get an negotiator. I continue to call in every week and finally in March am told on the phone (by a c/s rep.) in the Loss Mitigation dept. that says I am approved for the modification.

Two days later I receive a message to call the negotiator back. I call her and she says that the "investor" has apporved the loan mod. but the PMI company has to approve it now? I am to send in all current income documents. I fax her over all the new stuff which includes my unemployement stubs. (Not a paystub anymore) When I try to ask her about the terms of the loan mod. she becomes very snippy with me and tells me she cannot tell me any of that info.


I don't ever hear from her again even though I have left her messages.

I still continue to call in every week to check status and am told "the loan mod. is still in process"


So, in March I received more papers from National Cities attorneys trying to "push up" the forclosure of my house. My attorney once again gos to court and tells them and the judge that I am waiting to here about my loan mod. that supposidly was approved...

On April 8th Fed X shows up with a package. It is my loan modification documents.

I look through the documents and they have shaved off $100.00 from my mort. payment and extended my loan out 9 years and added 20K onto my loan. They have also included several riders to this modification.

1: being that if I ever rent my house to anyone that they will collect the rent themselves. 2: that if I move that I will not take any appliances, Curtains, Rods, Blinds...etc. etc etc.

Now the problem I have with that is:

The washer/dryer/refrigerator were all bought with cash after I had the house for a month. There were no blinds or curtains at all in the house as this was a forclosure when we bought it.

Most of the appliances that were left failed after about a month of us living here and we had to replace them.

So, I call in to talk with my negotiator about this loan mod. paperwork I have received from her. I am told that my negotiator is someone else???

So, I speak to this other person (she is actually my processor) and she tells me that the loan mod. they did for me was done off the original paperwork submitted in November 2008 not the new paperwork I submitted in March.????

I am trying right now to get all the paperwork together for the Making Home Affordable Plan and am really at a loss at what will come of this.

I was told that (if I qualify) this program will put me in forbarance for 3 months @ 1/2 of my payment and then a loan modification might happen??

I am worried that by posting all of this there will be some sort of repricussion from National City

I really need some education/info so I can deal with them as I am left to do this all on my own at this point.

***Update***

As of today we are still fighting forclosure. I applied for the Making Home Affordable Plan the beginning of July 2009. Every time I call they tell me my paperwork is still "under review"
The only thing they have asked for in the last 11 weeks is a copy of my Com-Ed Bill.
We will be making our 4th forbearance payment in Sept.

Today is another court date and more money to my lawyer

They also did a scond BPO that is not even close to the first.
I owe $188K
First BPO done in Feb. 2009 says value is $179K
Second BPO done in July states value is $115K (-$64K) ??

Last Friday I came home to a "call tag" on my door. They are now sending people to my home to make sure I am still living here even though for the last year I have told them every week when I call in that I plan on keeping my home and am not moving.

Tomorrow will be 1 year that I have been trying to get something/anything done with National City Mortgage.

***update***

It is now November and I was officialy denied for the MHAP at the end of September and kicked off the forbarence plan.

So I was told to resubmit the paperwork again..so I did and received paperwork again to get back on the forbarence plan.
Now the payment is double but still less than my original payment.

I now have to fill out all the paperwork again. This will be the 5th time I have filled out the same paperwork for National City..now PNC.

Every month we go to court and tell them that we are working with PNC.
Their lawyers spent the last 6 months saying we were not and finally last month acknowledged that we were working with PNC.

This week I received notification that they want to go to court on the 10th instead of waiting till the 30th which is our next court date.

I am still fighting but some days I want to just give in and let them take my home.

WOW that really is horrible! Have you been making any payments during this time at all? Hopefully you are able to get something done.

I have made 6 forbarence payments and then was denied for the Making home affordable plan and told I could not continue to make them.

I now have a new package sitting in front of me for another forbarence plan and the payments are now double what the first was.

I found out on Monday who my advocate was but have left several messages with no return calls.

Were you given the reason for failing on the MHA? Maybe it is an invalid reason.

Victory Now,
the reason I was looking at this was because we have a friend in San Diego who has National City and they were turned down for a mod 3 times now they are using a lawyer.
National City seems to suck more than most servicers.

They used our original income from the Loan Mod. (Nov. 08) instead of using the current (at the time) income from after I was laid off.

And I quote: "Failed to meet program eligibility requirements"

This is after waiting over 90 days and after calling in every week and being told that we were approved and just needed to submit a electric bill proving we still occupied the property. (Which I did)

I am doing alot of the legwork as my lawyer fees are high as it is due to them dragging us into court every month to get a summary judgement against us.

Finally found your post. Wow, you were not lying when you said NCity has dragged you through a lot!
Your story is sure putting me on notice so that I am going to be VERY careful how I tread with them: check and re-check everything I am sending to them and make sure I leave a lot of paper trail.
I wish you will get a break in your own case tho... Praying for you.

Victory, I have read your post and your have obviously been through the ringer. I know most of us on this forum have been fighting for our homes and our lives for almost a year and in some cases more. If I can say one thing to you that would be too keep on fighting... Don't give up, that's what all the servicers would like us to do. We have to stand together and keep fighting. We are all tax paying Americans that have worked very hard to buy the homes we live in. I for one will not go down without giving every ounce of blood sweat and tears to save my home I worked so hard to get. It's not our fault that many of us have lost jobs and have had our income cut in half. We have done things right and what they are doing is wrong. I hope many of us can give Thanks in the coming weeks as we reflect and realize we are in this together and must all stand together. We will get through this... Keep on keeping on and don't take no for an answer.

Thank you for the words of encoragement!!!

Here is the update from my 2 hour phone conversation yesterday to N/C now PNC.

I spoke with the L/M dept. (I cannot get in touch with my advocate).

Here are my questions and their answers: (she talked to me like a child the whole time)

1) Why is it that in May I had a payment of $840.00 when I first applied for the Making Home Affordable plan and now on the second go round my payment is $1495.00??
" Lorna says that the first go round was a "forbearance agreement" not a "trial plan"

Ummm....looks like the same paperwork this time as the last time??

2) So I ask what is the difference??

"Lorna states that it was lower payments to give me some time to get back on my feet" She also stated that they are going off of the financial statements that I gave them.

Ummmm....I have all those and they say something completly different than the numbers she read to me??

Now I am getting frustrated so instead of going off I change the subject...

3) I tell her that my payment went up in Dec. of '08 to $1888.00 from $1631.00.... she tells me it did not. I tell her that I am looking at the coupon book dated December 2008.
She tells me that she is not sure why I have that but that it is wrong?? Seriously??!!

4) I ask her if I am being considered for any other options ie; and in-house mod/loan mod.

Lorna states that " You cannot be considered for two at the same time, it is one or the other since they are two different departments..."


At this point I was getting irritated and asked to be transferred to the forclosure dept. as I had other questions for them. As for this conversation...I cannot share that at this point

I am going to have my attorney go over all the new "paperwork" and our financials on Monday.


There is a game being played and instead of picking up my toys and moving I am going to keep guarding my net
